A senior advocate of Nigeria and rights activist, Femi Falana, has said that President Muhammadu Buhari cannot single-handedly approve establishment of State and Local Government Areas police.

In a brief statement in reaction to the recommendation of the Presidential panel on election reforms, Falana declared that the issue of establishing state police is a constitutional matter.

He said President Buhari cannot decide on it.

The senior lawyer said without going through the National Assembly for amendment of the Constitution, whatever decision unilaterally made by Buhari would not work.

“Issue of state police is a constitutional one; there must be an amendment of the constitution in order for the president to approve the recommendation of the National Human Rights Commission.

“The president cannot single-handedly give approval for the establishment of state police,” he said

A president/governor can do whatever he/she likes and nobody nay institution will do any thing abt it,d masses can only raise alarm for maximum of 2weeks,afterwhich d issue is swept under d rug.e.g: Dasuki vs Buhari govt,El-zaki vs Buhari govt,Gandollar vs sanusi etc.

Agreed. The Constitution must allow State Police Commission(SPC) that will be responsible only to States' Governance.

Whatever that's beneficial to the common man in Nigeria , the executive or legislature will lack power to pass such bill .But if it's to pay huge subsidies and awarding of multi billion naira fake contracts, both arms of government have the power to append their signature . We need constitutional amendment as the one we have currently has lot of errors and holes .

There is standing mutual suspicion and rat-race between Senators/Fed Reps and their State Governors. "Abuja politicians" as State Governors tag them will never approve state police to avoid handing their respective state governors a tool to oppress them and chase them out of the state.

Of course the constitutional is supreme while the NASS is a medium to effect that initiative.

if buhari doesnt know book or have brain to reason well, doesnt he also have people with good brain around him? this country is really in a pity state.
how can one in his right senses approve creation of such a very finance - demanding institution without the consent of of the national assembly, no budgetary plan, no amendment of the constitution? or he thinks na yan - banga (vigilante) he is approving for creation?

U will never see falana speak about the tyrannical approach on issues concerning what is going on in judiciary by the tyrant himself. Always do everything possible to remain relevant in the news.

This is the problem with press releases by Buhari and the so-called Presidency

They can't stand by their word, they use press releases to buffer, if it get muddled they deny it

Buhari should be addressing us in major policy decisions personally not hiding behind Presidency
