We’ll Soon Review Procurement Act — Lawan by zakim(m): 6:04am On Jul 02, 2019
Senate President Ahmad Lawan has said that the National Assembly would soon begin a review of the Public Procurement Act to bring it in tandem with current realities. Lawan said the Public Procurement Act, as it is, frustrated the processes of contract awards and execution which, he said, should not be allowed to continue.

Speaking during a visit by the Secretary to the Government of the Federation (SGF) Boss Mustapha, the Senate President said the National Assembly would do its best to address all the loopholes in the Procurement Act.‎ He lamented that the cost of executing projects in Nigeria was usually one of the highest in the world, saying the situation must change in the face of scarce resources. “The Public Procurement (Act) in Nigeria as far as I can see is not the best in the world.

The Public Procurement must be reviewed and amended. We must see how we can make it more practical and holistic within the shortest possible time. “From the stage of bidding to mobilization, the costing of any government contracts must be uniform in order to avoid imbalances and embarrassment in the processes.

“A situation where about 20 agencies of government buy the same brand of vehicles at grossly different prices is not good. Market prices must be determined and adhered strictly to in ensuring that Nigerians are not short-changed through abuse of processes or over-invoicing.

“Even the 15% mobilisation fee specified in the Act by realities on ground is more of demobilising contractors than mobilising them with attendant loopholes for fraudulent practices,” he said. He said the yet-to-be constituted Public Procurement Committee of the 9th Senate would be very strong so that members of the panel would do the needful when the time came.

SGF Mustapha had earlier expressed hope that the 9th National Assembly started on a vibrant mood, calling on the lawmakers to work for the interest of the country at all times. He said members of the National Assembly should continue to ensure a good working relationship with other arms of government for Nigerians to get the best of the current administration.

Be committed to anything that will bring progress not setback.Obtaining uniform price across all boards will be difficult because the civil servants who are in charge of the award of contracts at MDAs are neck-deep in corruption asking for kickbacks and "kickfronts"from contractors that is why contractors factor in all the exigencies so that they might not break even or run into losses after executing contracts.

Quite possible.

But tbh that Act has lots of shortcomings- and reform is way overdue.

The PPA does not encourage ANY SUSTAINABILITY issue, neither does it compel buying Environmentally friendly goods/services. With all these floods and climate change, the PPA is one of the most effective means to tackle the excess carbon monoxide in Nigeria’s air.

The PPA does not encourage purchase of Local Contents. One would think that a procurement act will

1. Compel government agencies to buy local
2. Compel government agencies to patronise local service/goods providers.

But No... many government agencies just do what they like with Bidding processes; often collecting bribes from contractors before awarding the contracts - especially the Oil Market. If you have some time just go and read the Malabu Oil deal and the Egbin Power contract saga. The cases have been in courts for years - and you ask yourself how Nigeria would not be backward- when all our resources are lost to corruption.

The most painful part is that - they will embezzle and inflate contract prices - and will still end up doing shitty jobs. Before 4 months the roads starts having potholes - become flooded with water; so that they can award another contract for repairs soon.

I wonder why our politicians are so greedy.

The cost of executing projects in Nigeria is one of the highest because the whole process is entrenched with bribery. As a contractor you bribe before, during and after securing and executing the contract.

Infact if you quote for a contract you might be told to pad it so the powers that be, those who push files collect money, accountant approving the funds collect money.

It's a whole convoluted quagmire
