PlanetOfApes: I totally agree with you. The Busola's are more interested in the media than justice. Believe me, I want to believe the Busola's but the strategy is suspecious. Maybe he did rape her or maybe not but the question is, why did she come out now? And note: not in the court nor to the police but to the media. Isn't she doing more harm to herself than good? I know for a certainty that she can't go to the police nor sue pastor Biodun to court because it is next to impossible to prove that he raped her. She can never prove the substance of rape in court. Never. So what is really the deal here? Drag COZA church down? Plausible I guess. Because there is practically nothing to gain on her own side except bringing COZA down. Even if the rape happened yesterday, as long as she is not a minor, no semen was found, no sign of forcefulness, she can't prove rape. Freehuman: Let's not complicate matters, the case is simple. Prosecution, prove your case! This simple statement might seem like nothing but it basically renders the case dead on arrival. exlinklodge: She is not interested in the court ....except if you guys failed to listen to the interview ...she was trying to work herself thru the healing process quietly ...but when COZA gang sensed that timi was referring to their pastor they started sliding into his DM to raise paternity issues of her children ..thereby trying to inflict more pain on her . She came out to bare it all probably to help her healing process, save some innocent lady out there from people like fatoyinbo and shut the mouths of the COZA gang who were thriving on lies . 9jaRealist: Guilty or not guilty in the court of law as well as "beyond a reasonable doubt" is simply semantics. If someone is guilty in the court of law, it means he committed the offence being accused off. Note: in the real world, he may also be innocent of that crime. On the other hand, if the person is found not guilty, beyond a reasonable doubt in the court of law, it simply means the person is innocent. Note: in the real world he or she maybe or may not be innocent. Not guilty is the same as saying the person is innocent. Why, because u can't call the person a convict, and he or she cannot be tried on that same case again. Which will amount to double jeopardy. So it's just semantics. |

The Status of limitations is a time period specified by law during which a case must be brought before a court of competent jurisdiction. In Nigeria, repe cases are NOT time barred and thus status of limitations is not applicable. oyatz: Thanks for that piece of information and I brought up the issue of Status of Limitations because I'm domiciled in a different jurisdiction where Status of Limitations also applies to rape cases but now i know that it doesn't apply to rape cases in Nigeria. |

abbey621: Attached to this comment are screenshots of The Nigerian Evidence Act, 2011. Under the English common law received into Nigeria by the Supreme Court ordinance of 1914 and Interpretations Act in section 45, Bukola Dakolo would have no case because of the common law doctrine of Res gestae which rendered Criminal cases useless if the evidence was not contemporaneous in time and place. The law is dynamic and evolves to serve situations like this, thus the enactment of the Nigerian Evidence Act which renders the rules of common law void when it is inconsistent with the provisions of the Evidence Act. Section 4 of the Evidence Act, 2011, attached below provides to the effect that evidence which occurred at a different time and place related to the fact in issue is relevant and therefore admissible in court. Thus, the provisions of that section when read in Pari materia with sections 5-10 of the Evidence Act, makes circumstantial and character evidence admissible in court. This is not an American Legal movie where videos (documentary evidence as defined by section 258 of the Evidence Act) and forensic evidence are required. According to the acclaimed victims story, her brother went to make trouble at the residence of the alleged predator when he became aware and there was settlement. That very act and testimony of witnesses of that act and the terms of settlement after the victim's brother's action, the involvement of the suspect in cultism at about that period is enough if corroborated as circumstantial and character evidence to prove the case.
