In legal terms, admissible does not mean sufficient. While relevance is the test of availability, it says nothing about the weight to be attached to evidence nor it's particular probative value. I put it to you that proper examination of said Evidence Act will reveal that allegations of rape require a higher standard of corroboration, even though it is not stated in those terms.
Note the following:
1. You cannot secure a conviction on character evidence. In fact, you cannot even build a case upon character evidence. See s. 82 EA
2. The res gestae in this case lacks probative value because: a. There is no way to ascertain the truth of what was discussed between the brother and Mt Fatoyinbo. b. The brother will legally be considered a tainted witness whose testimony will itself require corroboration.
To illustrate, the frailties of your case, defense counsel could simply argue that the accusations against his client were blackmail on the part of Ms. Bukola who then misled her brother and Mr. Fatoyinbo had no choice but to settle.
How do you reply as the prosecution? Remember that you must adduce evidence to establish any facts on which you seek to rely upon. S 131 EA
is she had gone to the hospital then and her medical report showing that she was raped, it will help her case but in the absence of that, if Police charge him to Court, he will use the case to file for Malicious Prosecution. |

She gave details, timelines and vivid descriptions of how everything occurred. The pastor could not provide any concrete defence to refute her allegations. He only gave a watery set of excuses. And then stepped down from the pulpit.
Anyone who believes he has been falsely accused, would not be sitting down without making stringent efforts to clear his name. If I were in his shoes, and someone made such false claims against me, such a person would be behind bars in 24 hours.
Fatoyinbo does not have the guts to arrest Busola or sue her for defamation, because he knows she is right! Pastor is not required to say anything. He who alledge must substantiate and Bysola must be ready to prove her case beyond reasonable doubt though not every shadow of doubt. 4 Likes 1 Share |

While I don't support the actions of Biodun, the pastor, isn't there a statute of limitations in Nigeria as to how many years from an event occurrence one has to report the case? 20 years might seem such a very long time ago to prosecute. Even here in the US, the statute of limitations is often 3 years in many states and her complaint may not be entertained. no statute of Limitation to Criminal matter in Nigeria, you can report a case at anytime but you must have prove. 1 Like |

Can you name one logical/factual evidence that shows she's telling the truth? No sentiments, no emotional bias just straight up evidence. This will be the determining factor whether the case even makes it to court or not. Eye witness accounts are as valid as any physical evidence. Mrs Dakolo mention many other people involved in the alleged rape, like her sister, brother, mother and a few church elders. All would be examined and cross examined in court. To lay out a pattern and history of rape and sexual abuse by the pastor, many other alleged victims would be encouraged to testify in court, examples Ese Walters, Tunmise Oluyede, and others. Under the English common law received into Nigeria by the Supreme Court ordinance of 1914 and Interpretations Act in section 45, Bukola Dakolo would have no case because of the common law doctrine of Res gestae which rendered Criminal cases useless if the evidence was not contemporaneous in time and place.
The law is dynamic and evolves to serve situations like this, thus the enactment of the Nigerian Evidence Act which renders the rules of common law void when it is inconsistent with the provisions of the Evidence Act.
Section 4 of the Evidence Act, 2011, attached below provides to the effect that evidence which occurred at a different time and place related to the fact in issue is relevant and therefore admissible in court.
Thus, the provisions of that section when read in Pari materia with sections 5-10 of the Evidence Act, makes circumstantial and character evidence admissible in court.
This is not an American Legal movie where videos (documentary evidence as defined by section 258 of the Evidence Act) and forensic evidence are required. According to the acclaimed victims story, her brother went to make trouble at the residence of the alleged predator when he became aware and there was settlement. That very act and testimony of witnesses of that act and the terms of settlement after the victim's brother's action, at about that period is enough if corroborated as circumstantial and character evidence to prove the case. @ the bold. It only goes to prove sexual assault but not rape. This is because as u know the position of our courts, rape can only be proven by corroborating evidence, which is medical evidence to prove penetration. Mere word of mouth and even an eye witness who may have seen the rapist on top of the victim, with his waist moving up and down to indicate kpa kpa kpa tinz (u know waramin) would not prove rape but it would prove sexual assault, e.g, attempted rape or indecent assault (Okoyomon V. The State) . The only instance where rape can be proved without corroborating evidence, that is, medical evidence, is when the rapist confesses to the crime (Popoola V. State). So all those sections of the Evidence Act(supra) are acts of sexual assault. Now, if that settlement that u referred to cannot be proved, the brother's testimony becomes mere hearsay, as it was Busola who TOLD him (her brother) that she was supposedly raped.
