I'm not arguing with you that the technicality was not based on the provision of the law, but it's not a constitutional provision. It's mostly a case law of a previously decided case. We are talking tribunal here, you are talking of normal court. Is a normal court presided by 3 judges? You know the answer yourself.

And stop arguing with me, I'm an election petition lawyer currently and have carry out proceedings before two tribunal members where one was absent. The Crux of the matter is that the other member in the Osun election tribunal was absent when the main trial commenced ( calling of witnesses) which was very fundamental.
You sound like christiannorth.anyway if you look at the apex court since tanko came, most cases are decided based on preliminaries or technicalities.apart from technicalities, adeleke would still have lost in the other grounds of the main suit

PDP deserved this loss, to be honest. Foolishness should not be rewarded.

Osun under Aregbesola (APC) was absolutely shocking. APC should have been roundly trashed in that election. Any half decent candidate should have won the day for PDP. Same thing that happened when APC took over Edo State after the disastrous tenure of PDP’s lucky igbinedion (Curses be Upon Him!)

Then PDP shot themselves in the foot with their choice of candidate. Because, no matter how poor the APC was as a party, many Osun voters couldn’t bring themselves to support Adeleke who doesn’t look cerebral in the slightest.

PDP keeps shooting themselves in the feet with their choices of candidates. They chose poorly with Adeleke, and chose poorly with Atiku.

Both Atiku and Adeleke clearly won their elections and were rigged out so what's your point ..It's a shame the supreme Court has towed this path of dishonour as any sane lawyer will tell you there is no way the supreme Court can say Adeleke lost that election

There were irregularities in d conduct of zamafra primary election by APC... While for Rivers it was very clear PDP won d election. But as for osun it was day light robbery. Supreme Court dismissed the appeal due to absence of Justice obiora in the tribunal. we have accept the supreme court verdict and we have moved on. As far as I'm concerned, johnnyessence will be much alive on nairaland in the next 4 years of oyetola government. my voice will never cease in the name of the Lord Jesus Christ. when there is life there is hope. we in the pdp has moved on.

Justice Obiora may have been absent but the Appeal court made a verdict on the matter.

The supreme court affirmed the appeal court and once again, PDP has been defeated.

Ekiti gone, Osun which was in the bag until the alliance with Omisiore - gone.

Nna, these are difficult times for the once "largest party in Africa".

The will of God and the good people of Osun State prevailed. This is victory for democracy and the rule of law. Kudos to the Supreme Court justices for ensuring justice is done to the case. We shall celebrate Buhari’s victory at the PEPT as well soonest.

What we failed to detect earlier! What we couldn't have prevented even if we had early detected: "Justice Obiora's Intrusion" Tribunal sat for 90 days. Justice Obiora missed a day. Justice Obiora seemed to have been planned to missed a session. He was then TECHNICALLY positioned to delivered Tribunal Judgement. APC had no interest in winning Tribunal than achieving THE TECHNICAL ERROR that was planned by them. Immediately, the Tribunal Judgement was delivered and before living the Court Room, Dr. Ajibola Bashiru came up with Appellate Ground on TECHNICAL ERROR on dissenting judgement. I keenly followed him during the proceedings. And on TECHNICALITY Appellate and Supreme Courts Truncated the will of the good people of Osun State. Yes, they have done that on Osun People but not on the Almighty God. # IBS

Respect yourself.if they clearly won, what will you call the victory of seyi makinde? If adeleke won well, all these controversies wont crop up.what evidence do you have that atiku clearly won? Was he ever leading in the polls? Is there any state he was leading but later lost
