The Public Interest Prevails Over Individual Rights: Malami On El-zakzaky

The immediate past Attorney-General of the Federation, Abubakar Malami has argued that where an individual right conflicts with the public interest, the public interest prevails.

This was in response to a question by Minority Leader, Senator Eyinnaya Abaribe on why he cannot guarantee the rights of Nigerians who have been granted bail but remain in detention. This question bothers on the continued detention of some people, including Shiite leader Ibrahim El-Zakzaky despite the granting of bail by courts.

Malami also said over $779 million have been recovered by the government in its anti-corruption war.

Malami was addressing the Senate on Friday during his screening for a ministerial appointment.

During the screening, Abubakar Malami from Kebbi state went on a long speech about his achievement as the number one legal officer of the country. He spoke at length about the government’s war on corruption

Malami revealed that during his time as the chief legal officer of the government, the balance in FG recovery account from N19bn to N279bn and 12, 412 criminal cases were prosecuted.

“In three years 12, 412 criminal cases were successfully prosecuted in three years. During my time as AGF, we increased the balance in FG recovery account from N19bn to N279bn.”

In his remarks, Deputy Senate President, Ovie Omo-Agege said: “You are a good man, a brilliant attorney. More than that, you are a fearless anti-corruption warrior and that is one of the programmes promised to Nigeria by President Buhari.”

Minority Leader, Senator Eyinnaya Abaribe asked a controversial question:
“Why have you not been able to guarantee the rights of those who have been granted bail but are still in custody?” This question bothers on the continued detention of some people, including Shiite leader Ibrahim El-Zakzaky despite the granting of bail by courts.

Malami argued that where an individual right conflicts with the public interest, the public interest prevails.

Who now weighs d scale to know where d pendulum points btw public peace and human right. The issue with this govt is that while they love lies they do not know how to lie. It is d duty of d state Attorney to furnish d court with fact to buttress their arguments of public interest vs individual rights and it is d duty of d judges to weigh on d justice scale and give verdicts. That is why there is room for appeal of cases to a superior court if u loose out at a lower one. Malami is not in d position to superimpose his master's selfish interest in interpreting a clear court pronouncement that once bail is granted it must be obeyed and possibly appealed

The Sunni Muslims barricade roads as well...So why focus that to the Shiites??

Although I hate the Shiites procession and their aim to islamize the country. But the government can handle Elzakzaky and have him fall into its trap for proper persecution!!

Yes Saudi interest, stupid that was why the US didn't take Osama to court despite every human being has right to fair hearing in court. The interest of 300m Americans superseded the interest of just 1person ,hence the reason US didn't bother to capture Osama alive and begin to take him to court

Please let the legal guys clarify this? Is public interest different from rule of law? Yes, This one I know. But is it just if ian le for a government to discard the rule of law to up hold public interest?

Malami should tell us his master is using to state machinery to drive home his personal interest. Thus, while Dasuki is suffering for his actions in 1984, Elzakaky is suffering for the oppression of the Sunni against Shi'ite.

Anyone government finds to be a threat to the unity of a nation just like a case of Asari Dokubo Vs FG years ago when Asari was granted a bail. But Obj denied him . The supreme court Verdict was national interest is above Asari interest because he was a threat to government
Elzazaky definitely is a threat to the unity of the nation. Or if She's is captured today and next week, he's taking to court and he's granted a bail. Will you say government should allow him the bail conditions despite he has a right to be bailed?

You are wrong and totally ignorant, Osama was killed outside US soil, the issue of US human right does not apply there. Same with those that are being detained in Guantano bay in Cuba.

Shiites are not trying to islamize the country, Fulani n Sunnis are the ones trying to do so.
In shia countries like Iran n Syria n many more, Christians n judaists have the right to practice their religion, while in Sunni countries like Saudi Arabia, there is no single standing church there

The whole point of the court is to avoid anarchy and interpret the law, so when the executive decides to take up that role, then there's problem.
