The FUNDAMENTAL (INDIVIDUAL) HUMAN RIGHTS in the constitution is the most important part of any constitution.

Govt cannot deny an individual of his fundamental human right except expressly determined by a lawly constituted court. Any foool who has done law no this.

This is why the Govt cannot kill a confessed criminal except the court say so. It is why the Govt cannot detain any person for more than 2 days except it brings him to court and the court says so. It is why the Govt cannot take over your private property wighoiut a court order, etc etc. Those fundamental human rights( right to life, right to free movement, right to property, etc) are so sacrosanct that no body or authority except the courts can deny any individual those rights.

In fact, the only way those rights can be denied is if it those rights affects the fundamental rights of others.i.e public interest. And it is only the courts that can determine and declare this.

That Malami is advocating otherwise, tho painful to peeps like us, is not surprising at all. Afterall, he has been the chief law officer in the last 4 years in Buhari Presidency.

Those kind of laws allow for indefinite detentions, human rights of a person to be violated, privacy to be infringed upon, disappearances of individuals deemed dangerous to the country etc most also dont know that credible intelligence shows that iran is indeed providing weapons to shi'ites in nigeria, a lebanese guy with links to hezbollah (shi'ite terror group) was caught with massive amount of weapons in kano not long ago. Who determines the issue of public vs private interests - the executive or the judiciary?

If the executive makes a presentation to the court and the court still believes the citizen should be granted bail, why should the citizen continue to be held in detention?

What these men are practising is not rule of law.

That should have been the question posed to him, the politicians are just using our heads. We all know public interest is above individual right.

That is a known legal principle but it does not hold water where the courts have ruled in the individual's favour. It only applies to detaining a person over a matter for which judicial decision has not been taken or longer than allowed by law pending proper arraignment. In this case court has ruled in his favour. So keeping him in jail is illegal.

Yes Saudi interest, stupid that was why the US didn't take Osama to court despite every human being has right to fair hearing in court. The interest of 300m Americans superseded the interest of just 1person ,hence the reason US didn't bother to capture Osama alive and begin to take him to court
So, US is so sound and simply took out Osama in a covert operation over a decade after 9/11 in far away Pakistan. Smart!
Arresting him will require legality and they dump his body at sea cos he was stateless as of the time.

That is how nations handle clear cases of public interest. However arresting zakzaky/dasuki then refusing due prosecution as well as violating court orders is dumb!

Let me brief you quickly.
Long time after it has fully been established that Osama was in Abbotabad, only known by Barrack Obama and few intelligent member. They further needed to ascertain if truly Osama was the one just to avoid mistake of wrong identify. Even the Pakistan govt wasn't aware of his presence at Abbotabad. They secret agents took over 2 years in their findings. They went around Abbotabad pretending to be vaccine/ Polio eradicators. It was the process , they went inside the compound to give Osama children vaccine and they collected the kids saliva samples. Inside the compound , no electricity, no Radio nothing internet which would have given Osama away .It was the sample they finally used in confirming true identity of Osama.

On the day of operations, just Osama , his wives a gun around him though he made attempt to reach out to the gun.before he was shot in the head.

Every Friday during Jumaat prayer, roads are blocked and citizens simply either bypass such roads or waited till the prayer is over.

Same with Christians during their retreats/conventions/crusades.

There are all Manners of religious organization across board that are para-military sort of. These have all been tolerated and managed but, Shiites procession is seen differently why?

. As much as you are right, you are as well totally wrong.

It is left only for the supreme Court to decide that and not the president. That they decided it in Asari's case does not mean it should be decided in Zak Zak's. The law must be obeyed at all cost.

The FG had been "smart" to prefer that of Kaduna court.
