I know its highly unlikely and almost impossible but if buhari is disqualified by the tribunal or found ineligible to qualify due to him not having ssce or not attaching it to his inec form cf001,who takes over? Is it vice president osibanjo,atiku or the senate president? What does the constitution specifies? Is there any precedent? krendo: If Osinbanjo becomes the President when Buhari gets disqualified over certificate issues, I'm sure Osinbanjo's eligibility will be challenged up to the Supreme Court. By all rationality, if Buhari is disqualified, Osinbanjo is ineligible considering the joint ticket that brought them both on board as President/Vice-president,. The next in Line would be the Senate President, Ahmed Lawan. If it were to be the United States of America, the House Leader, Nancy Pelosi and not Senate President, Mitch McConnell will be next in line after Trump and Pence is removed. We vote parties in Nigeria and not individuals That’s why Amaechi was able to replace Omehia in River State If the tribunal disqualify Buhari because of certificate then Osibanjo as the next in line in APC takes over and then nominates a new VP That if the court determines that Buhari lied on his INEC form but upholds INEC declaration of the election that APC won. There is however overwhelming evidence and if the court go by the evidence they will disqualify Buhari but also declare PDP winner of the election based on the contents of the real result sheets 2 Likes |

If you people no fix that fraud of a Constitution una no go ever progress. Also Nigeria's Supreme Court need a revamping, a nonpartisan supreme court is what the country requires to deliver real justice. |

Dansuqi:That is in cases where the person can't function as a result of events after declaration (post electoral issues, eg he is found guilty of misconduct while in office). In previous instance where an election winner was found ineligible to contest, the court gave the mandate to the party runner-up. This applies not just to president, it applies to governor and legislative members. However, I don't know how similar rules apply to deputy/vice as we are yet to have any of such case. 2 Likes |

Dansuqi:Has any president ever been disqualified? Has any gov been disqualified? Answer is NO. However, a flawed candidacy by virtue of fake cert in other elections have been decided varying depending on the locus standi of the petitioner. Here the pdp/atiku are the petitioners seeking to be declared winners or election canceled. It therefore goes without saying that will be the beneficiary in that event. |

printemps:If disqualified, the party pry runner-up takes over or the v.p. The pdp or any other party can't get the mandate. Buhari was disqualified, not the party. Party owns the ticket, no one voted for Buhari but APC in the eyes of the law. Except we have an unusual case like that of Zamfara and Rivers where the party was disqualified which is very unlikely as it was an in-house work(APC members challenging themselves) 1 Like |

krendo: Your position is not correct. If Buhari is disqualified, Osinbajo and APC also stand disqualified. The implication is that APC had no valid candidate in the election. The validity of Osinbanjo’s candidature depends solely on the validity of Buhari’s candidature. One is not valid without the other. Consequently, the party with a valid candidate that scored the highest votes and meets all other constitutional requirements will be declared winner. 3 Likes |

Every judicial case is unique and has to be tested in a competent court of law. Making comparisons with past judicial cases is nonsense. |

OlujobaSamuel: The ruling or whatever constitutionality behind the idea that people vote for party and not candidates is flawed.If electorates vote for party and not candidates then no campaign for individual candidates of political parties should be allowed, parties should just campaign for themselves and appoint or apportion positions to their members or candidates. You see why the Nigerian Constitution and the whole judicial system in Nigeria need a total clinical overhaul. The present system by which Nigeria operates is a total mess. |

OP,if the president gets disqualified, then Atiku will be sworn in. It is as simple as that. That is exactly why you have first runner up,second runner up,third runner up etc. Disqualification of the president simply implies that the party ticket is nullified;of course, the party ticket bears Buhari and Osibanjo. Don't misconstrue it with impeachment, in which case the vice president takes over. 1 Like 1 Share |

All the votes acquired by APC would be considered as void votes. PDP would be declared a winner. More so there was no other candidates except President Buhari during APC primary . |
