The cabal operating in Aso rock have instigated an oil war by their manipulated appointment into the board of the Niger Delta Development Commission to suit their whims and caprices against laid down rules and the act establishing the NDDC. The Cabals who are operating within the office of the SGF Boss Mustapha and the Chief of Staff Abba Kyari are said to have planted their chronies and proxies in the board of NDDC against the wish of party faithfuls in the various Niger Delta states with a view to using such offices as a conduit pipe to siphon NDDC fund. The appointment which was hurriedly put together without the knowledge of the president is causing serious tension in the Niger Delta. By the provision of the act the Chairman of the board is supposed to come from Delta State but the Cabals decided to pick the chairman from Edo state and the MD from a non oil producing community of Urhobo , a tribe where the newly appointed minister and the Deputy Senate president hail from. This action has generated bad blood and tension everywhere as there are similar occurence in other states like Bayelsa, Rivers and Akwa Ibom states. With the issuance of quit notice to all oil company workers operating in Itsekiri land to vacate the territory by a pro Itsekiri militant group and similar threats from Ijaws, Nigeria will slide into economic recession soon as Itskiri areas alone produce about 30% of the nation's crude oil export. Another group has filed a suit against the federal government for breaching the NDDC act. The directive that all ministers should report to the office of the Chief of staff is a clear indication that Buhari is not the one ruling this nation. They prepare whatever documents they like for the president to sign without knowing the content of the documents.

Ndokwa/Oshimili Communities Protest New NDDC Board Appointment

The recent Federal Government's appointment of the new board members of the Niger Delta Development Commission (NDDC) ), today, at Asaba recorded a huge minus.

Large number of youths, women and men drawn from communities within Ndokwa and Oshimili Local Government Areas registered their displeasure over the recent appointment.

They took their protest to the state's house of assembly and the government house.

At the state assembly the angry protesters were received by their respective representatives, assured that they understand their grieviances and ready to work round the clock with them at correcting the anomaly.

As contained in an address John Obi, the organising chairman, Ben Elu, Esq and Chuk Ozulu, the protesters rejected in its totality the deliberate marginalization of the entire Delta North Senitorial District in the constitution of the commission's board since 2000.

Part of their address to the state governor, read in part thus; "rather than at least consider we that have never benefited for 19 years, the same Urhobo and Isoko groups that were appointed into the out going board were again rewarded with the Managing Director and Delta State representative positions respectively for an unprecedented two consecutive tenures"

Speaking to our reporter, Chuk Ozulu, pointed out that, among the five oil producing ethnic nationalities in Delta State, it shows that the Urhobos had being appointed five times; the Isokos, Ijaws and Itsekiris had enjoyed appointment at the commission four, four and three times respectively.

He also maintained that the current Deputy Senate President, Minister for State Niger Delta (the only minister from the state, Chairman of the NSITF Board as well as outgoing NDDC Executive Director (Projects), he said are all Urhobos.

The group's leader, John Obi, urged Niger Delta Leaders and Governors to persuade the president to reconsider the list and allow Ndokwa Nation produce the next Managing Director and Delta State representative in the new NDDC board.

Comrade Hero I Hero and Odili Ebere, in their chat with our reporter decried the exclusion of Delta North Senitorial District in the appointment of the commission's board.

They also noted that Ndokwa nation had contributed a lot towards the Indepedent Power Plant (IPP) project of the nation with ten oil companies peacefully operating within their domain but lamented that all that is their lot is no jobs and appointment to their people.

Rt. Hon. Funkekeme Solomon, received the angry protesters at government house today, with the assurance that the state government is ready to work with them on this issue.

He also reminded them that their royal fathers had before now paid advocacy visits to his office and their letters to the state governor had equally being sent to the presidency.

Rt. Hon. Funkekeme Solomon thanked them over the peaceful manner they conducted themselves during the period of the protest.

It is not about Ijaws alone, the appointment did not follow the act establishing the commission. The oil in Delta is produced mainly in Ijaw and Itsekiri areas. It is unfiar for Urhobo to have minister, Deputy senate president and MD NDDC when the major oil producers dont have anything. To make matters worse, the MD is from a non oil producing community. The owner of that community which is the father of the MD migrated from the village of the DSP to his present location some few decades ago. So the whole appointment is a fraud.[code][/code]

NDDC: Lori-Ogbebor faults appointments, demands positions for Itsekiri

Rights activist, Chief Rita Lori-Ogbebor, has faulted what she termed the sidelining of Itsekiri ethnic group in the appointment of  Managing Director of Niger Delta Development Commission, NDDC, and Chairman of the board of the commission, describing the action as against the Act establishing the NDDC.

She explained that the Managing Director designate, Mr Bernard Okumagba is not from an oil and gas producing community, noting that the Itsekiri as the highest oil-producing community in Delta State deserved the appointment.

Briefing newsmen yesterday in Lagos, Lori-Ogbebor, who read a protest letter to President Muhammadu Buhari, called on him to cancel the recent appointments.

She said: “Our protest is based on the non-compliance with the NDDC Act, lack of equity, fairness, and justice. We know that you stand for these same values. It is also important that you address this continuing and odious impunity being undertaken by some persons acting for and on behalf of the Nigerian state to deprive us of our rightful dues.

“The NDDC law takes cognisance of the oil and gas producing communities in appointments into its board and staffing. Indeed, one provision of the law for appointment into the office of the chairman is that the candidate must come from an oil and gas producing state in alphabetical order.

“Assuming that the appointment of a Chairman from Edo State was necessitated by an appointment of Managing Director from Delta State, why should the proposed candidate be Okumagba, who does not hail from an oil and gas producing community?

“Agreed, the present Managing Director designate, Okumagba is from Okere-Urhobo in Warri South Local Government Area, Delta State. He is not from an oil and gas community or even from an “impacted” community as defined by our laws and practices.

“Somebody who is not from the oil and gas producing communities cannot know or feel the pains of the people and therefore, cannot solve their problems.

“Our one and only NDDC Executive Director, Omatsuli Tuoyo, served for two years instead of a four-year term because the board to which he belonged was dissolved by the current administration.”

We demand that the recent appointments are cancelled and a new appointment in accordance with the rule of law, equity and justice be made.”

Protest in Edo over NDDC nomination

The All Progressives Congress (APC) in Ovia North East local government area has kicked against the nomination of Dr. Pius Odubu and Chief Victor Ekhator in the Board of the Niger Delta Development Commission (NDDC).

Odubu was nominated as Chairman while Ekhator was nominated as Edo Commissioner in the NDDC Board.

The APC, in an open letter to President Mohammadu Buhari, said Ovia North East as an oil producing local government has not produced a Representatives in the Board of NDDC since its inception.

It said the two other local government areas Orhionmwon and Ikpoba-Okha have produced Edo Representatives interchangeably.

The letter signed by its chairman, Blessig Idubor and Secretary, Orhinokpa Osayande said Dr. Odubu and Chief Ekhator hail from Orhionmwon and Ikpoba-Okha respectively.

It said the current chairman of the Edo State Oil and Gas Producing Areas Commission (EDSOGPADEC) Mr. Kennedy Osifo, also hails from Ikpoba-Okha.

The party said: “Your Excellency, with due respect, your careful analysis and assessment of all the issues raised above and if your opinion and position is not in doubt but in the affirmative, Ovia North East should be given the opportunity to serve in the Board of NDDC.

“Orhionmwon Representative have served in NDDC for 18 years while several Representatives from Ikpoba-Okha have served for eight years.

“We pray to your Excellency to graciously and kindly consider the wisdom to apply the principle of rotation and zoning as provided by the NDDC Act Section 2(1) and appoint the current NDDC Chairman and Commissioner positions to the indigenes of Ovia North East who have been denied any representation for the past 26 years.

“We pledge our loyalty to your Excellency and we can assure you that we will hold the office of the Chairman and the NDDC Commissioner in trust for the people of Edo South senatorial district.”

Also, some youths of Ovia North East led protest through some major streets of Benin City over the nomination NDDC Board.

The youths led by Imadeyogie Stephen said Chief Ekhator was imposed as Edo NDDC Commissioner by Comrade Adams Oshiomhole.

They protested to the Edo State House of Assembly and the Government House.

According to Stephen: “We demand equal representation in the NDDC. This is marginalisation of the highest order. We want relevant authorities to ensure that Ovia North East is not cheated.”[code][/code]

The people of the niger delta should have been fighting for total resorces control instead of protesting against one of their own who has been given appointment by the federal government. Why kill themselves for peanuts when they can have it all? Northerners who are currently enjoying their resources are very happy that they are not united their divide and conquer antics are working very well for them.

In an affidavit deposed to by David Odeli, Steven Etsano, and David Iwere Tisun Community against Buhari, the National Assembly, the NDDC and Okumagba, the community said

The people of Tisun Community of Warri North Local Government Area of
Delta State have approached a federal high court sitting in Benin
City, Edo State for disqualification of Bernard Okumagba's nomination
as the Niger Delta Development Commission (NDDC), urging President
Muhammadu Buhari to adhere strictly to the laws that established the
Commission.

In an affidavit deposed to by David Odeli, Steven Etsano, and David
Iwere Tisun Community against Buhari, the National Assembly, the NDDC
and Okumagba, the community said Odeli: "That I am the first
Plaintiff/Applicant in this suit and the secretary of Tisun Community
management council in the Warri North Local Government Area of Delta
State Nigeria. Tisun Community is a host Community to Chevron/NNPC
Joint Ventures, operators of the oil mining licence (OML 49) and by
virtue of which I am conversant with the fact of this case.

"That the 5th defendant is a Nigerian and from Okere-Orhobo Community
in Warri-South Local Government Area of Delta State, a non-oil-bearing
area/community and a card-carrying member of the Peoples Democratic
Party (PDP).

"That on the 27th day of August, 2019, the office of the Secretary to
the Federal Republic of Nigeria, announced that the 1st
defendant/respondent has nominated and about to forward the name of
the 5th defendant/respondent to the 3rd defendant/respondent for
screening and confirmation as the managing director of the 4th
defendant/respondent.
That the said announcement of the name of the 5th defendant/respondent
was published in all the national dailies including the vanguard of on
the 28th August 2019, the said vanguard publication is attached and
marked as Exhibit “B”.

"That I know as a fact that the 5th defendant/respondent is an
indigene of Okere Orhobo community and whose community is not an
oil-bearing community

"That I also know as a fact that the fifth defendant/respondent being
an indigene of Okere Orhobo community and whose community is not an
oil-bearing community/area cannot be nominated, screened, confirmed
and be appointed as the managing director of the 4th defendant."

Odeli stated further in the affidavit: "That I also know as a fact
that persons nominated, screened, confirmed as managing director of
the 4th defendant/respondent over the years have been persons from an
oil-bearing community/area.

"That I also know as a fact that one Engr. Omene Joseph who is from
Omosogar in Ethiope East Local government of Delta State, an
oil-bearing community/area was nominated and his name forwarded to be
screened and confirmed by the 3rd defendant as the managing director
of the 4th defendant.

"That I also know as a fact that one Emmanuel Aguvariawado an indigene
of Okpara in Otu-Jeremi in Ugheli South Local Government of Delta
State an oil-bearing community/area was also nominated and his name
forwarded to the 3rd defendant for Screening and confirmation in the
year 2013 though on an acting capacity of the 4th defendant.

"That I know as a fact that the 5th defendant/respondent is from Okere
Urhobo Community in Warri South Local Government of Delta State a non
Oil bearing community/area, the list of the oil-bearing
communities/areas in the Warri South Local Government of Delta State
are as follows: Omadinor community, Obodo community, Gbokodo
community, Wakanor community."

Arguing further, the affidavit stated, "That the nomination and
forwarding of the name of the 5th defendant/respondent to the 3rd
defendant/respondent to be screened and confirmed as the Managing
Director of the 4th Defendant/Respondent is not valid.

"That I know as a fact that the 5th defendant/respondent not being an
indigene of an oil-bearing community/area cannot be appointed as the
managing director of the 4th defendant.

"That I also know as a fact that the forwarding of the 5th
defendant/respondent name to the 3rd Defendant/Respondent for
screening and confirmation will spark up agitation/crisis amongst the
oil-bearing communities/areas in Delta State.

"That I also know as a fact that the 5th defendant/respondent not
being an indigene of an oil-bearing community/area, if screened and
confirmed by the 3rd defendant, may not be able to perform/ carry out
the functions of the 4th defendant/respondent equitably."

Odeli argued further: "That the purported announcement of the name of
the 5th defendant/respondent on the 27th day of August 2019 by the 1st
defendant and its agents is targeted at putting the oil-bearing
communities/area into untold crisis.

"That I also know as a fact that the decision taken by the 1st
defendant/respondent, if not reversed and fresh nomination made, the
oil-bearing communities in Delta State will be thrown into a state of
anarchy and confusion including the plaintiffs/applicants community.

"That unless this honourable court invoke its equitable jurisdiction
to intervene, the defendants/respondents will continue in their
illegal act of the appointment of the 5th defendant as the managing
director of the 4th defendant/respondent.

"That the act of the defendants/respondents will undermine the right
of the plaintiffs/applicants and that that of their community, an
oil-bearing community, if not checked by the intervention of this
honourable court.

"That there is a serious issue to be tried to the substantive/main suit.

"That the injunction sought will not prejudice any of the parties but
will preserve the res pending the hearing and determination of this
suit already filed in this Honourable court.

"That the balance of convenience is in favour of the plaintiffs/applicants.

"That I undertake to salvage any damage that could result in the
unlikely event that this order ought not to be granted in the first
place.

"That I do solemnly and sincerely declare that Act. , I make this
solemn declaration conscientiously believing the same to be true and
correct by virtue of the provision of the oath."

There have been numerous litigation and protests across Niger Delta
states since Buhari announced the NDDC board appointments in August
with calls to him not to violate the existing laws that established
the commission.

This appointment will trully confirm to us APC members in Delta whether Buhari is the one ruling or a set of tiny cabal. This is a disaster in waiting. If this appointment sail through Buhari should forget about APC in Delta State.

*Lori-Ogbebor, Omasanjuwa, others sue FG over NDDC appointment*

Human rights activist, Chief Rita Lori-Ogbebor, and two other Itsekiri leaders, Rev Jackson Omasanjuwa and Edward Omagbemi have dragged the Federal Government before a Federal High Court sitting in Abuja over the appointment of Olorogun Okumagba as the Managing Director, Niger Delta Development Commission, NDDC.

The three prominent community leaders are suing the Federal Government on behalf of themselves and Ugbodede, Bateren and Omadino communities in Warri South Local Government Area of Delta State.

Other defendants in the suit are NDDC; National Assembly; Chairman, NDDC board, Dr. Pius Odubu, and Attorney-General of the Federation. In the suit, the community leaders are asking the court to determine whether by virtue of Section 12 of the NDCC Act, it was proper for the Federal Government to have appointed Okumagba as Managing Director of NDCC. The plaintiffs are also asking the court to determine whether it was proper for the Federal Government to have appointed Odubu, who hails from Edo State as Chairman, NDCC Governing Board.

Considering the fact that Delta State is next in line to produce the chairman of NDDC board based on rotational system amongst member states, the plaintiffs are asking the court for a declaration that the Federal Government was under obligation to appoint an indigene of Delta State as Chairman of NDDC governing board. Other reliefs sought by the plaintiffs include: A declaration that by virtue of  section 12 of Niger Delta Development Commission (Establishment) Act, 2000, Act No 6 of the Federation of Nigeria, the appointment of the 5th defendant who is not from an oil-producing community of Delta State as the Managing Director of the 2nd defendant by the 5th defendant is not proper, null and void. “An order of perpetual injunction restraining the 3rd defendant, either by itself, officers, privies, agents or through any person or body however from accepting, screening and/or continuing the 4th and 5th defendants who were appointed by the 1st defendant as the Chairman of the Governing Board and Managing Director respectively of the 2nd defendant. “An order directing the 1st defendant to appoint an indigene of an Oil Producing Area of Delta State as the Chairman of the Governing Board of the 2nd defendant in compliance with the clear provision of Section 4 of the Niger Delta Development Commission (Establishment) Act, 2000 Act No 6 Laws of the Federation of Nigeria.” “An Order directing the 1st Defendant to appoint an Itsekiri Indigene from an oil-producing area in Delta State as the Managing Director of the 2”d Defendant in compliance with section 12 of the Niger Delta Development Commission (Establishment) Act, 2000 Act No 6, Laws of the Federation of Nigeria. “

The increase in the number of court cases against the appointment is an indication that the people of Niger Delta have totally rejected the appointment

As controversy continue to trail the composition of the new board of the Niger Delta Development Commission (NDDC) by President Muhammadu Buhari, the Itsekiri Oil Mineral Producing Communities (IOMPC) has faulted the composition of the new board, saying the appointment breached the act establishing the commission.

The group specifically frowned at the appointment of Dr. Pius Odubu, Olorogun Bernard Okumagba and Prophet Jones Erue as the commission’s Chairman, Managing Director and Commissioner representing Delta State respectively on the board.

IOMPC, an umbrella body for Itsekiri oil bearing communities in Delta State, said it was the turn of Itsekiri ethnic nationality to produce either of the three positions – chairman, MD or the Delta Commissioner.

In a statement on Thursday signed by its Chairman, Mr. Edward Omagbemi; Secretary, Deacon Gabriel Meni and, Patron, Rev. Dr Jackson Ireyefoju posited that Urhobos haven produced the Managing Director of the commission twice it was the turn of Itsekiri Nation to head the it.

It claimed that Itsekiri being the ‘highest oil producing ethnic nationality’ in the state should be allowed to produce the next MD of the commission in the interest of fairness and justice.

A copy of the statement mailed to WARRI TODAY, the group called on President Buhari to reshuffle the nomination list and ensure that the law establishing the commission was rigidly followed in the interest of peace and justice in the region.

On the appointment of Dr Pius Odubu, IOMPC said, “After establishing the Governing Board of the Commission in section 2 of the Act, section 4 is categorical that the office of the Chairman shall rotate amongst the nine member states of the commission in the following Alphabetical order: Abia, Akwa-Ibom, Bayelsa, Cross River, Delta, Edo, Imo, Ondo and, Rivers States

“Following this arrangement, Chief OnyemaUgochukwu of Abia State became the first Chairman, followed by Chief Sam ldem from Akwa-Ibom. When he was removed in 2007, Mr. Dan Abia also from Akwa — Ibom was appointed chairman to complete the tenure of Akwa-lbom in 2009. Air Commodore Larry Koinyan(Rtd) of Bayelsa State was appointed Chairman.

“When he was removed after two years, Mr. TarilaTebepah, a Bayelsa State indigene was appointed as chairman to complete the tenure of Bayelsa State. In 2013, Mr. Bassey Henshaw an indigene of Cross River State was appointed Chairman of the Board and when he was removed in 2015, another indigene of Cross-River State, Senator NdomaEgba (SAN) was appointed in 2016 and he occupied the seat till 2019.

“It follows from the above, that it is the turn of Delta State to produce the next Chairman of the Board. The rotatory arrangement specified in the Act establishing the commission has never been breached. The appointment of Dr. Pius Odubu from Edo State is therefore a breach of the provisions of the Act and should be corrected now by the appointment of a Deltan from oil producing area.”

The group accused some chieftains of the ruling All Progressives Party (APC) from Delta and Edo States for allegedly spearheading what it terms “illegality, immorality and corruption” on the appointment.

While similarly faulting the appointment of Olorogun Bernard Okumagb and Prophet Jones Erue (current APC chairman in Delta State), the group warned that appointments into NDDC in Delta State should not be made exclusive right of the Urhobos and Isoko ethnic nationalities.

The statement said further, “We, the indigenes of Itsekiri oil and gas producing communities of Delta State reject, ccondemn and also find the recent announcement of the composition of the Board of Niger Delta Development Commission as it affects Delta State unacceptable and see it as a slap on our face.

“The nomination of Mr Bernard Okumagba from Delta State as the Managing Director is not only repoignant but also provocative. Although Mr Okumagba is from Warri, he is an Urhobo from Okere Urhobo area of Warri.

“He is not from an oil and gas producing or impacted community. Aside from that, Urhobo in Delta State have been Managing Director twice and an Executive Director once in the 17years history of NDDC. They cannot and should not be MD or ED soon again. There are other oil and gas producing ethnic nationalities with higher quantum in the State. Itsekiri the highest producer In Delta State have only been an ED for one and half years.

“By NDDC law, alphabetically it is the turn of the Delta State oil producing area to produce the Chairman. In terms of quantum production, Itsekiri should be the Managing Director of NDDC now.

“The recent announcement of the composition of the Board of the Niger Delta Development Commission is marginalization and oppression taken too far. For the avoidance of doubt, we vehemently condemn the appointments of Dr. Pius Odubu, Mr, Bernard Okumagba and Prophet Jones Erue as the next Chairman, Managing Director and Delta State Representative respectively of the interventionist agency.”

IOMPC , while decrying the appointments, lamented that Itsekiri people are angry that they had been once again been shortchanged despite their contribution to the revenues accruing from oil and gas production in the country.

“So far Itsekiri are angry, disappointed and feel short changed by the NDDC since it was set up. Itsekiri nationality is second highest producer of oil and gas in Nigeria and highest producer of oil and gas in Delta State. Itsekiri harbor the largest tank farm of the American giant Chevron in Ugborodo, an Itsekiri town and several oil facilities, yet they have been continuously neglected and overlooked.

“The oil and gas producing communities of Itsekiri do not have good motorable roads and are suffering from systematic marginalization, abject poverty, devasted environment and lack of meaningful development in spite of years of oil and gas exploration and exploitation in the area, because they have not had the opportunity of being at the helms of affairs of the intervention agency”, the statement added[code][/code]
