NEWSFIRS: Court set to rule on suit asking Tunde Fowler to vacate office The Federal High Court sitting in Kano State on Monday heard the originating summons of Lawyer, Stanley Okwara seeking to sack Dr. Babatunde Fowler, as the Executive Chairman of the Federal Inland Revenue Service (FIRS). After hearing all the parties including the preliminary objections and counter affidavits of the Defendants, the presiding Judge, Hon. Justice Lewis-Allagoa, adjourned the matter to Friday, the 11th of October for Rulings and final judgment. The FIRS boss was represented by Chief Paul Erokoro, SAN while the Plaintiff was represented by Johnmary C Jideobi. The Court had last week ordered Fowler to appear before it today show cause why he should not be sacked for overstaying his tenure, which expired on August 18, 2019. In the originating summons obtained by PRNigeria with Suit No FHC/KN/CS/141/2019, the FIRS Boss was dragged to Court over his continued stay in office after the expiration of tenure. The Plaintiff, Mr. Stanley Okwara, in a suit filed on September 18, 2019 also joined the Attorney General of the Federation as the second defendant. The two defendants were given 30 days to explain why Fowler who was appointed on the 20th of August, 2015, has not ceased to hold office as the Chairman of FIRS after the 20th August, 2019 in accordance with the “decision of the Supreme Court…and having regard to the combined provisions of Sections 3(2) (a), Section 4(a) and Section 11 (a)” of the agency. The Plaintiffs also sought to know whether the continuous stay of Fowler in the office “is not illegal in view of the decision of the Supreme Court in Ogbuinyinya & Ors. vs. Obi Okudo & Ors. (1979) All N.L.R. 105 and having regard to the combined provisions of Sections of the FIRS [Establishment] Act, 2007. In the same vein, Okwara in the suit filed through Johnmary C. Jideobi & Co, sought other reliefs including: “A declaration that the 1st Defendant has ceased to hold office as the Chairman of the Federal Inland Revenue Service after the 20th of August, 2019”; and that his continuous stay in the office is illegal. He further sought “an order barring the 1st Defendant from further holding himself out as, laying claim to or exercising the powers and functions of, the Executive Chairman of Federal Inland Revenue Service unless he is re-appointed by the President of the Federal Republic of Nigeria. “An order directing the 1st Defendant to return forthwith to the Treasury Single Account of the Federation all the salaries, emoluments and such other kindred monetary benefits he has been drawing on the purse of the Federal Inland Revenue Service and file an affidavit of compliance within 14 days after the delivery of judgment in this suit.” Source: https://dailypost.ng/2019/10/07/firs-court-set-rule-suit-asking-tunde-fowler-vacate-office/ 1 Like

The person who is supposed to either appoint or re-appoint him is very aware of the court case. But if all the ministers could resign while hoping to be re-appointed, why is Fowler's different since his position has a tenure tag of 4 years. 6 Likes |

Though it's the perogative of Mr.President to reappoint Fowler or not but he is not the only fella to have overstayed his time in office without anyone raising eyebrow. Ibrahim Magu, Formers NHIS sec, Abba Kyari etc all did but because they belong to the cabal clique nothing happened.The cabal are still fighting hard. 15 Likes 1 Share |

Racoon: Ibrahim Magu has been bribing the PSC for him not to proceed to NIPSS, Kuru, for promotion so he can continue to remain as EFCC Chair. All those who were appointed with Magu as Assistant Commissioner of Police have since been promoted Commissioners only Magu remain as Asst Commissioner of Police because if he's promoted as Commissioner, he can't be EFCC Chair again. He has overstayed as Ag. EFCC Chair. Is that not the highest form of corruption? You won't see any southern media say anything about it. Assuming Ibrahim Magu was from the South, the media for no let us hear word. MrFourSHIRTS:Due process my foot. Where were you in September when some mallams said they were eyeing that juicy seat? When the sector was making meagre revenue for the govt, the same body-smelling mallams didn't say a word. If they should be allowed to occupy the seat,that's the end of FIRS because they would run it down like they do other sectors. After all, they've reiterated that the power belongs to them and the foolish leaders who merged us with them from the south west couldn't say anything because of their selfish gains. This is politics. Buhari and his handlers do not want to renew Fowler's tenure. They also do not want to 'seen' as upsetting the current power structure in the southwest. So they get an outsider to perform the hatchet job for him, guess who; a southerner. In the absence of a reappointment by the President, the court will have no option but to remove Fowler from office. He would have no qualms in immediately obeying this particular court order. Esseite:Is Fowler a Minister? When the ministers resigned, did their principal officers resign along with them? NO. Fowler is a principal officer under the Minister of Finance. Esseite:In Nigeria, only ministers resign automatically at end of tenure, to be re-appointed or not. Special appointees resign on direct instruction from the president.
