There is nothing to argue about. Maintaining status quo in this context means nnpc can never issue APL to any applicant to commence the job even if they are already done with all processes. They have to wait till courts determination on the case is concluded. The fact is the recruitment is active and this may even be one of the delay for the issuance of APL all along. There is no case in the matter, because all age grades has their own cadre in the recruitment,moreover almost all other government agencies use age limits as criteria as well...To me, its a good news, because APL drops immediately after this case...cheers!

No one had file an injunction, as a matter of fact, i was looking for the word "injunction" but i couldn't see.
Status Quo implies let thing's remain the same, should the werey lawyer got the wind, that, NNPC wann start dispatching APL, then he can seek succor in the court by filing an injunction.

Remain status quo doesn’t mean hold of activities or prevention of further actions, it means let things remain the way they are until we are able to hear the matter. It basically means NNPC can continue to carry on with whatever they are doing until the court rules otherwise.

Do you understand clearly enough or you still need more clarification?

2. Shame on all those slamming 'sources', claiming that no one hinted on the court case, as it was mentioned here last week even with a link. I followed the link and had a very good laugh after reading the original thread and seeing guys who couldn't apply due to the age barrier, backing the lawyers ignorance.

3. Lol first, nawa ooh. Maintaining the 'status quo' has absolutely nothing to do with a possible release of APL or not. It simply means the age limit for GT's in the current or any future NNPC recruitment that will happen before 29 october 2019 remains 28yrs. If the current recruitment is concluded before 29th october and the NNPC board can provide evidence in court that it was not fastracked to beat the set date for the hearing, but has been planned all the while to be concluded before october 29, then the outcome of october 29th hearing has absolutely nothing to do with the concluded 2019 recruitment exercise. Simple protocol in law.

4. If you fault my ascertations above and can't express that constructively and/or display maturity in relaying your thoughts/findings, then with all due respect, I would give you a historical overview of exactly how/why you and that lawyer above are both not feeling fine.

In your case study, you should remember that an appointment has already been made, and a faction take the other to court, and the court then grant a status quo. Its a lot different from an ongoing recruitment where no appointment has been made by any authority. Remember a public office can't be vacant until decisions are taken,but a company as an entity can even be shut down until decisions are taken to avoid further damages

If you follow political litigation, you will understand these things.

During political party primaries during the just concluded general election. There were a lot of issue as regard some state having 2 state chairman from different faction in the party. One will obviously be recognized by the National body while he second one won’t be recognized. Both of them will hold primary election and candidate will emerge from both faction. Then they go to court to determine which candidate should Inec record as the party candidate.

Once they get to court, the first thing they fight for is for the court to order status quo to remain. With that order, the one recognized by the national party will go ahead performing his duty as the state chairman of the party, even send the name of the winner of their primary to Inec.

Once the court hear the matter and rule otherwise, every action that the chairman has taken becomes null n void. They either call for fresh election or proclaim the other faction as the rightful chairman.

This thread no go kill person ooo..... one day, APL is ready waiting go ahead order, another day apl is cancelled, yet another day, local men no need APL again as a result of recent developments in career and Mobil offer....and today APL is in court... perhaps by tomorrow APL will be outside Nigeria.....

Court halts NNPC ongoing job recruitment

The Federal High Court sitting in Abuja has ordered the suspension of Nigeria National Petroleum Corporation (NNPC) ongoing job recruitment pending the determination of a suit filed by one Mr Pelumi Olajengbesi.

The News Agency of Nigeria (NAN) reports that Olajengbesi, a public interest lawyer, had commenced the enforcement of the Fundamental Rights of all potential applicants to set aside the recruitment by the NNPC on the ground that it was discriminatory.

The recruitment had disqualified Nigerians above the age of 28 from applying for the vacant positions.


Olajengbesi had faulted the age criterion placed on the ongoing recruitment of the NNPC noting that it violated section 3(e)(iv) of the Fundamental Rights (Enforcement Procedure), 2009 which protected the public interest of Nigerians.

He had written to the then Group Managing Director of NNPC, Dr Maikanti Baru, on March 26, threatening to drag the organisation to court for placing discriminatory age requirement on qualified Nigerians who would have applied for the jobs advertised by the corporation.


The NNPC had invited applications from candidates for a number of positions including trainees who must not be more than 28 years as of Dec. 31, 2018, and had graduated from a university or polytechnic not earlier than 2014.

At the hearing on Oct. 18, 2019, the applicant prayed the court to ensure that justice was served on the unemployed Nigerians who needed to know their stand in the matter.

“The matter has long been before the court and the rest of the matter is at a stake and under Order 8 Rule 4 of the Article II of the African Charter of Human and People’s Right (Ratification and Enforcement) Act.
“I pray that the matter is heard together with the preliminary objection filed by the respondents in the interest of justice,” the applicant said.
When the matter was called up, the applicant’s counsel informed the court that the respondent filed his counter on Oct. 15, 2019.

In reply, the respondent informed the court that he was sick and had surgery.


The presiding judge, Justice Muhammed Tsoho (Acting Chief Justice of The Federal High Court) informed the respondent’s counsel that his counter was not properly before the court and had not been regularised.

The court in considering the urgent nature of the matter granted an adjournment for the respondents to regularise their counter.

Tsoho however, ordered that parties must maintain status quo pending the hearing of the substantive suit.

He adjourned the matter until Oct. 29, 2019, for hearing.

There's what we call contextual usage... In law, when the judge or magistrate asks the parties involved to maintain status quo, it means that any activity that was on going should stop... No further activities should take place on the existing state of affairs. So that when the case is finally decided, the object in question would still have value to the winner, because the usage or the progressive activities on that subject or object can be detrimental.

Let's say we are contesting ownership over a car, and the land is in your custody, the court would order that you maintain status quo, and that means you should stop any further activity on that land, if you were building and the house is at lintel level, you are not to add one more block to that house, so that when the matter is decided and I win the matter, I won't have a full house to bring down or I won't be given a Herculean task by how you built the said house.

The only overt and visible factor that will indicate that the court's direction on status quo has been flouted is the release of APL, because neither the court nor the Plaintiff is privy to the other internal processes attending the recruitment, so those will likely continue unabated.

So this recruitment that have been going so smoothly like this, my former SUG president decided to put sand in my garri. What age limit is he fighting for.... If he is fighting for age 30 maybe for his selfish interest what happens to those who are 31 or 32 years.....He should allow them to fix the age they want haba..

We grow at our own pace. Not everybody graduates at 24-25 years. Poverty, strike actions and other factors can be responsible for this. For the GT applicants that are against Lawyer Olajengbesi, don't be selfish. Someone above 30 years is still strong and young. They can also work. That energy they are preventing them to use profitably due to ageism may be diverted into crimes. And everyone will be a victim of ageism in the long run.

So what age should nnpc set?

30yrs? 40yrs? 50yrs?

Or it should be open to everyone..even graduates of 110yrs..

Do you consider that Compulsory retirement in service is at 65yrs?
Or nnpc will spend huge amount to train "graduates"? Which must be armotized..?

Should they employ graduates of 64yrs?
....

There are cadres in this same recruitment. GT and EH. 28yrs and 40yrs I guess? Entry level into federal service has an age limit, have you checked?

Why is the lawyer not challenging EH?

I'm just pointing out some weakness in the case smiley

Law and Logic goes together. A firm will do what is best for its interests.

PS: Do you realize that 28yrs is not an arbitrary number? There was a statistical survey/research done by the FG/NNPC.

Do you consider that 90% of all Nigerian Graduates over the last 20yrs fall within 28yrs and below? Fact.

So how is majority stopped from applying? smiley

What controversy did you see in the DPR recruitment? Did they not follow the laid down procedures just like this recruitment? Or was it the purported merit list that was flying around that you call controversy? How dumb of you!
When I write anything, please never quote me again. If you believe it, it’s fine. If you don’t it’s fine. But NEVER you insult me in your entire life again . I never said the recruitment was cancelled but we should pray against it being cancelled because some people want the recruitment cancelled which is a fact.

Same way I wrote here in July that the recruitment was suspended and some of you were rejecting it and two months down the line you all realized it was true and started echoing the same thing.

From your words here,I can see you think like a child , please we are not mates. I did not even apply for supervisor cadre so that should tell you we are not mates. That we joke here sometimes does not mean we should throw caution to the wind when addressing ourselves. I advice you keep yourself busy. There's what we call contextual usage... In law, when the judge or magistrate asks the parties involved to maintain status quo, it means that any activity that was on going should stop... No further activities should take place on the existing state of affairs. So that when the case is finally decided, the object in question would still have value to the winner, because the usage or the progressive activities on that subject or object can be detrimental.

Let's say we are contesting ownership over a car, and the land is in your custody, the court would order that you maintain status quo, and that means you should stop any further activity on that land, if you were building and the house is at lintel level, you are not to add one more block to that house, so that when the matter is decided and I win the matter, I won't have a full house to bring down or I won't be given a Herculean task by how you built the said house.

Bros, if you are a lawyer, I’m sure you know that property law defer most times. The analogy you gave is for “Property law”. Car or house can be damaged or whatever. It doesn’t go along with this context.

The word you are looking for is “INTERIM INJUCTION”.

The case before the court is that the age limit is discriminatory. The judge order that status quo be maintained.

What is the status quo of the recruitment before the court case? What status were they maintaining? It simple means let things be the way they are. Don’t change the age limit, leave it the way they are until we hear the case.

It could have been a different case entirely if the judge had said; I hereby grant an interim junction to halt the recruitment process till an official decision is made.

There are several cases that support this but I don’t have the strength to start digging for cases.

When I write anything, please never quote me again. If you believe it, it’s fine. If you don’t it’s fine. But NEVER you insult me in your entire life again . I never said the recruitment was cancelled but we should pray against it being cancelled because some people want the recruitment cancelled which is a fact.

Same way I wrote here in July that the recruitment was suspended and some of you were rejecting it and two months down the line you all realized it was true and started echoing the same thing.

From your words here,I can see you think like a child , please we are not mates. I did not even apply for supervisor cadre so that should tell you we are not mates. That we joke here sometimes does not mean we should throw caution to the wind when addressing ourselves. I advice you keep yourself busy. May that lawyer succeed. He's fighting a right cause - justice and peace. Ageism is a crime against humanity. If a 75 year old man is not too old to become a Nigeria's president then a 30 year old and above should not be considered overaged for a job.

We grow at our own pace. Not everybody graduates at 24-25 years. Poverty, strike actions and other factors can be responsible for this. For the GT applicants that are against Lawyer Olajengbesi, don't be selfish. Someone above 30 years is still strong and young. They can also work. That energy they are preventing them to use profitably due to ageism may be diverted into crimes. And everyone will be a victim of ageism in the long run.

So the recruitment should be cancelled? Answer this one first.

Do you know that inasmuch as the age limit for GT is 28, some people above the age still applied for the job by falsifying their age? They are so many today in public and private companies even with falsified certificates. Many are unable to falsify theirs because it will be so obvious, others after falsification are still not qualified and cannot falsify again and again.
What we need at this time is not unnecessary litigation but our APL.
I just hope and pray this recruitment be the best ever that will make NNPC better, stronger, productive and more profitable.
