The law does not work that way bro even though you feel he is guilty. You must establish beyond reasonable doubts that the person you are going to punish actually committed the offence.
Example, if you search my home and see a gun, does that mean am an armed robber?? You must establish those connections else I will only be charged for possession of firearms illegally.
In his own case, he claim that the said system does not belong to him, so EFCC have to go an extra mile to prove it belongs to him. EFCC might as well trace some transactions back to his account and other evidence but until then, what is on ground is not enough. Just seeing text files and history is not enough to pronouncesomeone guilty. Highest the chap will get the usual 6 months with an option of fine as you have not yet proven if he actually defrauded someone.

You're technically incorrect! You can be convicted of driving without a license, some crimes are misdemeanors while some are felonies. Each one has its own consequences and severity. The case at hand, the guy has not been convicted yet and there's a strong possibility he might walk away without anything because this is Nigeria! Even in the USA with the case against Dammy Krane, these things can be wiped aeway on technicalities.
