A six months notice is issued only to non owing tenants. Take note though that any period used must be paid for. It is not a free six months so you don't get dragged for skipping payment. Also, if your previous rent is due within that period, you either move out or pay the balance for the six months. If you end up actually owing even if you were not dragged for it, you won't be there to defend 39 lies out of a complaint of 40.

I find it funny to see some giving you the advice to drag house or court issue with the landlady that followed legal procedures to evict you. She gave you a notice covering good time as required for one year tenancy (confirm with the lagos state tenancy law), why the trouble making. I have been on both sides of the divide in court and can tell you that you could even be asked to pay extra for the services of landlady's legal team. I believe this last period will determine a lot of you in that house as well as area. Do be careful not to smear your name.

She doesn't want to drag issues with you and if you were to look at things from her own angle, most likely the pumping machine broke down in the past and thus led to the levy as a sort of insurance and some extra as profits. Where she faulted was restricting access after collecting pump insurance money. I believe apart from that you don't have issues with the house. You can still talk it over and start paying your 1k or leave if your mind is already set to. In organised nations, past infractions by tenants and landlords can be obtained before rent is given or taken and the background check would help decision making.

It is quite interesting to see that everyone that gave their opinion so far suggested you leave. Most even attributed it to God either directing the op or that God will handle it.

I think we have become a nation of sheep, our leaders have succeeded in breaking our spirits to the extent we can't even ask for clarification on why our rights are being trampled upon. Or demand to know why we were been kicked out of place where we live legally and has been paying for.

Just imagine we couldn't even dare ask a landlord or landlady to explain the reason for their actions. And with this state of mind how are we ever going to stand up to our oppressors?

For those who care to reason asking why you are being thrown out is not something that must be done out of spite or out of anger. You can still do it in a calm and mature way and get answers.

When you start asking questions as regards your rights you start getting answers as you start getting answers you become well informed. Information is one of the essential tools of breaking out from oppression.

For instance, I have seen on this forum how some people asked questions and was able to get the "almighty" NPHC people to sit up and do their job.

I faced similar issues but today God has blessed me with my house, am not done working on the house but nothing beats the peace of mind I now enjoy

The easiest way to defeat a landlord is to take him to court, he will surely beg you, you can stay up to 1year for in that house why the matter is still in court.
And you can decide not to give him your house rent during this period. You cannot just quit like that.
When you do this thank me later.
This only happens if the landlady uses thugs to evict him or did not give him the max 6 months notice for a year. So the only thing that can happen now is should he fail to move out after 6 months and she takes the man to court they might extend 3 months to him which he must pay for before they move him out.

She must have told you before you entered her property that N1000 is paid every month for water and you must have agreed.

If ab inito you said you would not be paying N1000 for pumping water do you think she would have allowed you to stay in her property?
If he was buying water from Mai Ruwa daily he will pay far more than that #1000

I was born and grew up in Lagos State and I moved from my parent house to stay on my own then I married with a kid now.
I moved into new apartment in the year 2018 and to my surprise this morning, 27th of October 2019, the landlady knocked my door and what I saw when I opened the door was white envelop, she handed it to me and left. I opened it and read through, my eyes opened widely as I saw Notice To Quit. I have done nothing and no reason is stated in the letter.
I became weak and didnt even know what to do for a while then i think i should share my shocking experience with my amiable family on nairaland.
When I packed in, I noticed many unreasonable things like ; 1000 naira for pumping of water every month and this doesn't include PHCN bill cos we use prepaid.
The box that contained the pumping machine switch would be locked and we still pay every month. I protested against that peacefully till I was given a key to have access to pump the water.
I later heard from different people who have left the house that that is how they do till they will frustrate the tenant out of the house.
I dont really know what to do, I need your reasonable advice please.

Use your 6 months notice and it starts counting from when ur rent expires.

If you are a yearly Tenant, u should get 6 'clear' months notice period...so start looking for a house..if the notice isn't appropriate, then u can protest to them..oral protest o

You still have 6 months to live there, don't let dem deprive you of your privilege, I was given a quit notice too, but they wanted us to pack as fast as possible but we went to the court and tht added 6 months for us.
Just leave as soon as you have the money to rent a new one, study the new house before you pack in check their bills, ask them how they pump water some use only light, it's not always good to live in same house with the landlord, thanks.

Dear Op, you don't need to feel bad about a Quit Notice. There is nothing special about it.

If you are still interested in the property, give your Landlord your rent at the expiration of the current rental. If she accepts, then you have nothing to worry about, if she rejects it, then keep it in an account and allow her take you to court.

I assure you that the Landlady wont go to court with you because she has much more to loose if she does.

Do you force a willing tenant on an unwilling landlord? He should contact you so u can provide him free legal representation? Stop making issues complex for the man.

The man should go plead with the landlady, if she is adamant, look for money and move out quietly. Except you have a lawyer relative to help u, be ready to spend money on a lawyer with their exploitative charges. Pay to file a case, pay for appearance fee, pay this pay that, at the end you would still spend money to move out. No Judge would force a willing tenant on an unwilling landlord. The worse the judge would do is to give u more time to enable u get a new place, and u must pay for all the months u stay. It is not free.

Landlady house? Hmm. Flee biko with your family. My friend been having issues with his landlord and his wife have lost babies due to stillbirth.

Some houses and landlords and landlady no be am o! I prefer to rent a house where the landlord/landlady doesn't even live within,best ever.

My contribution is this, FLEE AS FAST AS POSSIBLE FROM THAT HOUSE.
Don't even wait till the 6months elapse. Some wahala isn't worth it at all.

If you have the money consult with a lawyer to sue her, quit notice normally elapse after six months, she's using the lapses in her justice system to deal with her tenants, by the time someone takes the bull by the horn to sue her, then she will know khaki no be leather.

A landlord owe you no reason for eviction since s/he gives you adequate notice as required by law, the man need not plead with her

I want to ask of the legality of a situation :

A situation where the expiration of a yearly rental expires in six months and the tenant is being given a quit notice. For example , I paid for a year rent around April ,2019 and October, 2019 I was given a Six months notice to quit. Is this reasonable or acceptable according to the Lagos Tenancy Law ?

I don't really know how good you are in defense grin but I suggest you leave after your first rent expires for the sake of your family... Trust me you don't want them caught up in the middle of that ruckus.... You guys are even just starting out. Start looking for a better place.

rent another house but make sure u waste the six months giving to you

after parking u keep some irrelevant things in the house lock it up then visit once in a while until the six months expire u come and take all if needed and still lock up the place na she go suffer break it open
