LASG to commence issuance of license, permit for borehole drilling in 2020.

Lagos State Water Regulatory Commission is to commence issuance of licenses and permits for water abstraction in the state by first quarter of 2020.

Addressing stakeholders in the water sector, the Executive Secretary of the Commission, Mrs. Funke Femi Adepoju revealed that the exercise which is to be launched by Governor Babajide Sanwo-Olu is to regulate the process of water abstraction in the State.

“What is paramount to government is how abstraction affects us as a people not just today but the future with emphases on pollution, contamination of water bodies, saline filtration into the system, over-abstraction and unregulated abstraction”, she stated.

Adepoju affirmed that licensing is a significant process in the regulation of any industry as the Commission is determined to ensure its availability and sustainability to prevent the effect on unregulated water abstraction.

While assuring that only registered companies captured in data will be issued a 2-year renewable license with unique and personalized number, the Executive Secretary explained that the Commission was not established for a punitive purpose, but rather to establish standard in the water extraction industry in order to ensure that the health and safety of citizens are not compromised.

According to her, the essence of the engagement is to improve the relationship between stakeholders and Government by developing ways to sanitize the industry, stressing that the Commission has acquired mobile water test kits which are to be used in testing samples during operation and that approval for the acquisition of a standard laboratory for water testing is on the way.

The meeting was attended by members of the Manufacturers Association of Nigeria (MAN), Nigeria Employers Consultative Association (NECA), Financial Institutions, Association of Table Water Producers (ATWAP) and Association of Water Well Drilling Rig Owners Operators among others.

Though Sanwo-olu is saying only commercial users will pay but it isn't the truth, because they will have an inventory of all boreholes in Lagos State. It is just the Land Use levy 2.0.

You will have to pay before drilling a borehole even IN YOUR COMPOUND. A Lagos State HoA member lives opposite my house, so he immediately informed us then, my full community, even those in uncompleted buildings dug theirs.

Worse still, the law states that the company handling it should be financed from State IGR and where money cannot be sourced to pay regularly, the Federal allocations can be used to pay off.

THE LAGOS LAW SIGNED BY AMBODE.

A section (7.2.a) in the draft Bill secured the “payment of contracted services and concessions for long term infrastructure investments with an irrevocable Service Payment Order as the first line charge on the State’s Internally Generated Revenue.

In section 7.2.b., it states that, “In the event that the state’s IGR is insufficient or unavailable to discharge its obligations, the state should apply monies due to it from the federal monthly allocation or any other source to secure its payment obligation to contractors and concessionaires under the law.”

“These clauses will make government, through taxpayers money, to pay corporate entities without fail even when there are other pressing issues requiring funding.

“Literally, it is saying if passed, the Lagos State government must pay these corporate entities before spending on salaries, healthcare, roads and so on.

Section 137(1)(a) stipulates that, “No person or group of persons shall sink or cause to be sunk boreholes, hydraulic and other structures connected with the supply of surface ground water or treated water without obtaining the necessary permit from the Office of Drainage Services.”

Section 141(1)(a) says no person or group of persons shall “Abstract water from any lake, river, stream or other natural resources forming part of state water except with the approval of department of water resources of the Office of Drainage Services.

In 141(1)(c), it states that no person or group of persons shall “Make, sell, distribute or cause to be made, sold, or distributed water by container, tanker or any other method whatsoever without a valid licence being issued by the Department of Water Resources of the Office of Drainage Services.”

Even though the government can't provide water for you ,Incase you have money to do it for your self,you must have extra to pay to government to allow you to do that
