İ will advice you to let go. They cant sell the property without every members of the family sign n seal for it to be transfered legally. But issues like this lives can be taken for them to have their ways. They might claim if we cant sell while they are alive when they are no more we can sell. Pls consent to it, get ur share, utilize well. Wisfom from above will be on u

Are you guys Muslims? if yes, consult the shari'a expert on inheritance in your neighborhood for the ruling in accordance with shari'a.

Why are you calling it your house? It belong to you all, only you can't be enjoying the house by living in it while others think better to sell it and share money. The norm is to even share the property since your dad is no more. So how do you share a house? Sell and share if course. Don't be too entitled

My Dad has so many land, but I don't care about the lands, I don't have time to be dragging land with some one. Any how they like they should do with them. My goal is to make money, buy my land and develop it.

Go and hustle and forget the family house,to avoid story . When you are established you can build as many as you want.

It's pretty simple, can I be forced to sell my inheritance?

My late pop passed away 4 years ago, he had 11 surviving children from 4 wives, me and my younger brother were the last kids from the last wife...

He left a house in Lagos which we presently reside in but in recent times it's been the topic of sale by other siblings.... our stance remain 'NO SELLING'

Additional info

1-Me and my bro are in our early and mid 20's,we live in one of the apartments

2-The remaining siblings all have families of their own outside Lagos

3- Money is obviously the Motive for selling, but its emotional and psychological for us, dunno if this count, but id also add that my younger brother is a 'son of the soil"here, schooled here and erythane before pop passed, 3 of the siblings have never been here before. Older folks call popman "Baba Shade" we only met at the burial...

We had a Family meeting/reunion mid last year and the house was thrown in a debate, while majority of my siblings choose to sell the house, me, my brother and our eldest brother(2nd born) were against selling...

However, my elder bros and i spoke on new year day and i got to know his stance had changed concerning no selling, he cited heavy pressure from other siblings and he is very tired. And maybe he needs money too...

Which prompted my creation of the thread and asking "can our house be sold without our consent" considering we are in the minority for team "no selling"

Can we be forced to sell? despite having no intentions to do so, and how does the legal system cover for us...

N/B- there is no discord or fight or anything among siblings, we all live in peace and contact mostly through phone calls sometimes.....
bro i think that since the're majority and also your elders you don't have choice than to let them have their wish and focus on establishing yourself coz you can buy similar property tomorrow if you work hard. .. but before you decides to sale make sure that the sharing formula have been agreed upon..

Well, why not share it and let everyone do as they please with theirs? But I will suggest that you sell and move on with your lives. Otherwise, the house will keep bringing you guys together unnecessarily. Good luck.

You're acting entitled because you were around most times before your late Dad died. Listen my brother, if you don't like it, they surely will sell it. You can't be living there and enjoying rent free on a house that belonged to 11 people. If you and your son of the soil brother aren't living there, you'll understand why they need to sell the house and share proceed.

Don't be greedy.

If you don't want them to sale, then look for money and pay them off. As much as you want to protect your rights, they want the same thing too.
I assume you don't pay rent and have taken 'landlord' status over the property, hence your hesitation to sell.
Put yourself in their shoes, would you let them take advantage as you are doing.
Also from the legal point, they can sell the property without your consent. You and your siblings are from the last wife, there are three wives and children ahead of you.

You are not a landlord yet, you will if you work hard.

in my fathers house, when he died i am entitled to some rooms as a male child, but first wife and daughters occupied everythig, my mum told me i was too precious to her that i have no business in that house and for the past 10 years i havent stepped foot in that house, thank God i am not sleeping under the bridge either..now first wife and her son cant rent the rooms out and make money off it cos nobody wants to live with them, because of how they treat tenants, so those rooms are useless to them

I've experienced what you're going through. It really helps that you guys are civil. FOR NOW! But in the absence of a will, the default in any probate court is a "democracy". One beneficiary, one vote. Thus sell carries the day. Trust me I understand the sentiment to childhood homes, but justice especially fair justice and equity has to be dispassionate.

It may be with your consent though, because the majority voted for selling of the house. Since they didn't say they are not going to give you guys what belong to you.

Did your father have a will. How your father want his property to be distributed will be contained in the will.

When it comes to issues like this, my only advice to u is just let them go ahead with their decisions over that property, like I always say "mi o le mi wahala" , you still have a long way to go than getting yourself into a mess with ur siblings, and to think u are from a polygamous home, it's better u let them sell, get your share and move on with your life or you ignore the share and plan your own life. I found myself in situation like this(not from a polygamous home) and what I told my other siblings is even when father lives this earth,I'm not interested in his property, they can do anything with it, na me know wetin I dey talk property brouhaha in Nigeria my brother e get as e be o. Just be careful and let God lead u

Once the head of the house votes for and is accompanied by a majority of the members of the house, the sale will be valid, ND u be given ur Share.

What does ur custom say about inheritance? It is your custom that determines what happens. In some customs, it is d eldest son that inherits the Father's property (if it is one). Are there no elders in your family that you can relate to for advice?

Not like that in Yoruba custom, all the children including females are entitled to the inheritance

If you don't sell, then you move out and give the place up for rent so that everyone can be sharing from the proceeds.
The others feel they're not benefitting anything from father's inheritance.
You and your brother continue to live rent free, and would probably marry and raise family there if not careful. Does that mean the others won't benefit from their inheritance?

Are there any other properties belonging to your dad?
I also feel that your supposed "half brothers" shouldn't pressure you to sell your "inheritance".
You & your brother have been living there so I don't see any reason why the should insist.
Moreover y'all have the house documents with you so stand your ground.
Selling the property is at your own disposal.

You do not have many choices. First, your and your siblings are among the last from the last wife. Obviously you do not want it sold because you are benefitting by residing there while others do not see any benefit from the property because they are not residing there and possibly not getting any proceeds from the rent. My brother, the only way you could have been able to stop it is by buying it over but unfortunately, I don't think you can afford it.

My advice will be that you look for a buyer so that you can also get a commission to add to your share of the proceeds of the sale!

But I strongly doubt things would go messy.. my siblings are all decent folks, I'd like to presume... I'm not gonna say No to any money but same time I'm not gonna sell my home cuz I'm strapped for cash...
oga it's not your house according to customary laws, the house can be sold after final decision from your Elder brothers... Pls don't let them hear you laying claim to the house.. It is fair enough that your share will be given to you.. Move on.. After all no be you build the house. What if your father didn't build any house. Move on you are a young man

They can definitely do that without your consent. This is nigeria, as long as there is no will by your dad specifying ''who gets what''.
the property will be shared the traditional way and the eldest son gets to pick first and you can not stand in the way of the majority, especially in nigeria.

Omo if u were not stipulated as the executor of the estate in ur late pop's will, u my friend are not in any position to stop the older siblings from selling should they decide to do so.

However, u can make things difficult for them by displaying a Caveat Emptor on the property. Buyer beware!! Sit back and let them run around trying to get a buyer. But have a plan B ooo.
