You better listen to majority advise given to you up there already and allow your siblings do whatever they like with the property.

The issue of property or land dispute in Nigeria is always a delicate one and oftentimes leaves a trail of blood, tears and sorrow.

Now that your siblings are asking nicely, you better cooperate and allow them sell the house. Work hard, build your own house and avoid the mistake your father made by not leaving a Will.

Just thread cautiously to avoid story that touches the heart.

And believe me that in some culture, as the children of the last wife, you have little or no say regarding your father's inheritance.
yeah I know, we have little say, but in this case, we have a big say, believe me... For the whole fam, na we be the starboys I swear... Dem self dey foh

no will, and I believe my imediate elder bro have in possesion any relevant paperworks for the house...

And it' not a now thingy, even if it will be sold eventually, not in the next 5 years at least... I just want to know if majority win works in this kinda situation or dosent...

I mean it's an inheritance right, we all have equal rights and all, 8 want to sell, 3 don't want to sell, majority rules say 8 win, but everything I have been reading online says no sale without my "consent"... So I'm thinking like since my "consent" is NO, they can't sell...

Maybe I should add, nobody will cheat anybody in the aftermath of a sale, everyone would get theirs...

My issue is isn't there some clause in the law that covers for a scenario where the property in contention is my home, grew up in it, knew everyone, live and still living with evidence, also I know for a fact that pop will never sell, out of the blue about to be up for sale by people who needed an address and later description when they were coming cuz they needed money....

They just trying to use my house for cash out, why should they? The day they came, they all left except 1, not my fault they like visitors, cuz they never come..

There is nothing to debate here since your father died intestate and you acknowledge that each sibling has an equal right.

If you and the other two siblings on your side insist on holding on to the property then buy out the other 8 siblings who are the majority in favour of a sale. You and the other 2 can then keep the property for as long as ya’ll desire. It is as simple and as straightforward as that!

Your reasons for not wanting to have the property sold now may not be entirely altruistic afterall. You might probably feel you’re well off and doing better than your siblings forgetting that for some of them their share of the proceeds from the sale will give them a huge lift in life.

I get it, you hit the nail, I'm not against people selling, I don't blame them, they are not attached here.. they just need Cash...

And I have watched and seen a lot of movies where things turn crazy, like village people shit, I'm not cut out for that...

To be honest, I don't really give 5 fu.vks about it, but my brother is different, he is the last born, born here, knew everyone here, schooled here, friends here, it's hard for him... Also he puts in a lotta work here also,

I will tell him like I have told him earlier that we really can't do shiiit, we never gave a fucc in the beginning, so we shouldn't catch feelings now... We we be G, and don't have the time for family crap...

Now we siddon look... Thanks
Make una rent house around the neighborhood na, he hard. Your sense of entitlement stinks. They are even giving you respect now and you are doing like this. It will be clearer very soon.

That word "My" in your comment is even my concern. Even a woman married to a man with 2 wives cannot not call the man "my husband" without issues, the right thing to say is "our husband ".
But thank God in your comment you noted and agreed that the inheritance is not yours alone, you even agreed that if the property is to be sold it should not be now (maybe in the next 5yrs) which I believe is a period you selfishly believe you and your younger brother will be able to survive without the house.
Bro, you are simply being selfish. My answer to your question is yes, the inheritance can be sold without your consent, because the inheritance is not yours alone but the family. And it is not mandatory for every single member of a family to agree before a family can take a decision, unless you want to go against the family and make the simple issue messy.
you got it all wrong bro, everything, and the selfish part... In the whole family only me and my brother don't need the money...

I dont need to sell our house before I could survive, and the 5 years is another thing entirely that I'd not like to share, infact I could make it 10 years if I wanted...

The truth is they are trying to lobby me, to be honest for sale, while I'm against, but now I'm thinking maybe it's the best actually for everyone...

In the game of thrones right now, we are the lanisters, I'd like to think... we have something all the siblings dont have

My brother has something valuable to everyone, so we are being treated like eggs... Like I said na we be the starboys of the family...

No selfish anything, I have my own house before I moved here, October last year made it a year I moved here fully...

I still believe it's a wrong thing to sell, but if that's what they want, we'd do a deal...

What are you even saying! Are you trying to make us believe that house is yours or what! Remember you and your bros are last children from even the last wife, (bitter truth) so you don't have much say self and even when is sold your share of money will be smaller though. Remember the house is not will to you or your bros either and you said others are not residing in Lagos where the house is and you want them to allow you continue staying there, no no no.the house has to be sold because the 11people can't be maintaining a single house it will diapulate, beside it might start causing problems in future through lent collection and economy is bad.
maybe the way I painted it was somehow, this is not some pity shit, if it's sold my share will not be smaller I can assure you, and we don't lesser say in this shit, equal rights everybody... You feel , it's not a matter of underdog or anything...

We had a Family meeting/reunion mid last year and the house was thrown in a debate, while majority of my siblings choose to sell the house, me, my brother and our eldest brother(2nd born) were against selling...

However, my elder bros and i spoke on new year day and i got to know his stance had changed concerning no selling, he cited heavy pressure from other siblings and he is very tired. And maybe he needs money too.

Can we be forced to sell? despite having no intentions to do so, and how does the legal system cover for us...

Simple.....
1 house with four wives equal sale.
Stop insulting your elder brother that perhaps he needs money.

No need for discord to discard you.
Be wise your mother fourth wive to a man with 3 wives and 9 children .................. save yourself and bro.

Since you and your sibling are minorities, in the vote to sell I guess there is nothing you can do except you have the funds to buy the house,if the hous could be shared equally amongst you that would be an option also but I guess that's not the case, but note before agreeing to sale modalities should be made on how to share the proceeds and agreed upon and signed by all parties involved .

Have you been paying rent for using the house? Your siblings can't own a share of the property and only you and your brother will have use of it. What benefit are they currently receiving from owning part of the property?
You could reach an agreement with them to value the rental income from the property and then pay this amount after which you will receive your share of the rent (1/11th) or you could buy the property from your father's estate and then receive a share of the proceeds since it is sentimental to you.
You should not deprive your siblings of the enjoyment of the property or proceeds because it is sentimental to you.

Thank you all for the inputs, I have learned a lot by bringing it to the open...

I personally see it as a bad deal to sell, but my people need the cash... And my people out numbered me 9 to 2 so there's only little I could do...

Also I feel for my younger brother who can't help but feel a little entitled about everything, he was the closest to pop when he was alive and lived with him till his death, and I will cut him a little slack here for being entitled he had genuine reason for that, but majority is for sale, and from the comments here, we will do a deal...

We recently moved here permanently over a year ago, so we are not enjoying rent free for 10 years like some people think...

I pray we do the right thing and hopefully everyone is satisfied... Like I said it's not a now thingy, maybe a little over 5 years time Sha,

Thank you all for you inputs, to those who have sense nio, some people are clearly frustrated..

When wives are many and children are in large numbers, it is advisable to follow the trend, or use the wise word “we are okay with the family decision”. I know many who have been killed because they want to proof stubborn against sales of family property and many have been turned chronic mad.

My advise for you and your siblings is to start planning what you can do with your share of the property sale. Else you will squander the money. So start planning now on what to do with your share.

all sons have the right to use a part or all part of his father's house... I saw that online yesterday, just wanted to point that out...

Nobody is asking nobody not to have some proceeds in thier father's house...

Good day all,

It's pretty simple, can I be forced to sell my inheritance?

My late pop passed away 4 years ago, he had 11 surviving children from 4 wives, me and my younger brother were the last kids from the last wife...

He left a house in Lagos which we presently reside in but in recent times it's been the topic of sale by other siblings.... our stance remain 'NO SELLING'

Additional info

1-Me and my bro are in our early and mid 20's,we live in one of the apartments

2-The remaining siblings all have families of their own outside Lagos

3- Money is obviously the Motive for selling, but its emotional and psychological for us, dunno if this count, but id also add that my younger brother is a 'son of the soil"here, schooled here and erythane before pop passed, 3 of the siblings have never been here before. Older folks call popman "Baba Shade" we only met at the burial...

And maybe he needs money too...

I am not a lawyer but with my experience fighting for my own share of my late father's inheritance and winning, this is a tip I can give you so that your late Pop can rest in Peace.

The Constitution of the Federal Republic of Nigeria is very clear on how inheritance should be treated.

If anyone died intestate, the laws of his religion will be used to share his properties. If the late person is a Christian, then it's civil law, which may require sharing the property equally amongst the heirs or disposing the property and sharing the proceeds.

But in the case of a Muslim, it's a different ball game. It's Sharia law, the set of laws derived from the Holy Quran. Whichever way it is shared the males get the higher share.

In Sharia law, the wife of the deceased gets one-eight, whichever way it is shared. Where there is only a female child, she gets one-third while the male child gets two thirds, where there are more female children, they get half while the male Children gets half. Where there is debt on the deceased, it is announced on the third or eight day prayers so that the family can offset it. If they cannot, an equivalent of the amount of debt will be removed from the Estate and auctioned or sold to offset the debts. In some cases, the family can agree on the time to pay those debts to the debtors.

Understand one thing, the laws of FRN are not against Wills. In fact Wills are a faster way if sharing any Estate.

It's a tough task that only MEN can succeeded.

Good luck.

What does your tradition says about it? Because even if you go to court everything will be judged based on your traditional law. Where I come from the first some towns everything especially when he has done the second burial. There's a tradition in Abuja that says share the house amongst all even if it's a room each. You are the selfish one here, you are already laying claim to your Father's house like other children are not the son of your father. The best thing to do in this case is sell the property and share the proceed but I see you don't want to sell because you want to continue staying there and completely claim the property after many years

Whatever the case make sure they understand you and your sibling are not just saying no for the sake of it but the fact that you still live there and have connections work/study/network in the area.

Please if you notice any of them acting desperate. Tell them you are ready to sell now now

Firstly it's not your home more than it's theirs .. there is no will indicating your as primary custodian of the estate (the house)

So whether you where born and raised there is totally irrelevant.

Yes the house can be sold without your consent and all children are deemed beneficiaries of the estate and you are not stated in any document as executor of the estate hence you have no power above the other children.

The house will be sold.whether you approve or not and it doesn't belong to you it belongs to all biological children of your late father . Whether you live there and get married there is irrelevant the home is not yours

Move out , it is not your inheritance it's all of biological children's inheritance

Dont sell anything. If u are to sell your house they too must sell there own houses too, let all the house of all the wives be sold and the money shared amongst all the children.

The other wives can't have roofs over there heads while they expect u to be homeless.

Highest u would find out that ur family share from the house might be just 1m or 2. That's a year or 2years rent in Lagos, would those same family members allow your family move into there house when u now become homeless.

They just want to intimidate your family since your family is the youngest.

You don't know law , this is not a Nollywood movie !

The law is very clear, he only has superceeding rights where he is stated as sole beneficiary of the estate ! He is not !

I was involve in something similar recently ..

He has no rights above any of the other children!

His late father should have named him sole beneficiary unfortunately he didn't !

Fact!
