Starboytwo: There is nothing to debate here since your father died intestate and you acknowledge that each sibling has an equal right. If you and the other two siblings on your side insist on holding on to the property then buy out the other 8 siblings who are the majority in favour of a sale. You and the other 2 can then keep the property for as long as ya’ll desire. It is as simple and as straightforward as that! Your reasons for not wanting to have the property sold now may not be entirely altruistic afterall. You might probably feel you’re well off and doing better than your siblings forgetting that for some of them their share of the proceeds from the sale will give them a huge lift in life. 2 Likes |

I dont need to sell our house before I could survive, and the 5 years is another thing entirely that I'd not like to share, infact I could make it 10 years if I wanted... The truth is they are trying to lobby me, to be honest for sale, while I'm against, but now I'm thinking maybe it's the best actually for everyone... In the game of thrones right now, we are the lanisters, I'd like to think... we have something all the siblings dont have My brother has something valuable to everyone, so we are being treated like eggs... Like I said na we be the starboys of the family... No selfish anything, I have my own house before I moved here, October last year made it a year I moved here fully... We had a Family meeting/reunion mid last year and the house was thrown in a debate, while majority of my siblings choose to sell the house, me, my brother and our eldest brother(2nd born) were against selling... However, my elder bros and i spoke on new year day and i got to know his stance had changed concerning no selling, he cited heavy pressure from other siblings and he is very tired. And maybe he needs money too. Can we be forced to sell? despite having no intentions to do so, and how does the legal system cover for us... Since you and your sibling are minorities, in the vote to sell I guess there is nothing you can do except you have the funds to buy the house,if the hous could be shared equally amongst you that would be an option also but I guess that's not the case,but note before agreeing to sale modalities should be made on how to share the proceeds and agreed upon and signed by all parties involved . |

Starboytwo:Have you been paying rent for using the house? Your siblings can't own a share of the property and only you and your brother will have use of it. What benefit are they currently receiving from owning part of the property? You could reach an agreement with them to value the rental income from the property and then pay this amount after which you will receive your share of the rent (1/11th) or you could buy the property from your father's estate and then receive a share of the proceeds since it is sentimental to you. You should not deprive your siblings of the enjoyment of the property or proceeds because it is sentimental to you. 2 Likes |

Thank you all for the inputs, I have learned a lot by bringing it to the open... I personally see it as a bad deal to sell, but my people need the cash... And my people out numbered me 9 to 2 so there's only little I could do... Also I feel for my younger brother who can't help but feel a little entitled about everything, he was the closest to pop when he was alive and lived with him till his death, and I will cut him a little slack here for being entitled he had genuine reason for that, but majority is for sale, and from the comments here, we will do a deal... We recently moved here permanently over a year ago, so we are not enjoying rent free for 10 years like some people think... I pray we do the right thing and hopefully everyone is satisfied... Like I said it's not a now thingy, maybe a little over 5 years time Sha, Thank you all for you inputs, to those who have sense nio, some people are clearly frustrated.. |

When wives are many and children are in large numbers, it is advisable to follow the trend, or use the wise word “we are okay with the family decision”. I know many who have been killed because they want to proof stubborn against sales of family property and many have been turned chronic mad. My advise for you and your siblings is to start planning what you can do with your share of the property sale. Else you will squander the money. So start planning now on what to do with your share. |

Starboytwo: I am not a lawyer but with my experience fighting for my own share of my late father's inheritance and winning, this is a tip I can give you so that your late Pop can rest in Peace. The Constitution of the Federal Republic of Nigeria is very clear on how inheritance should be treated. If anyone died intestate, the laws of his religion will be used to share his properties. If the late person is a Christian, then it's civil law, which may require sharing the property equally amongst the heirs or disposing the property and sharing the proceeds. But in the case of a Muslim, it's a different ball game. It's Sharia law, the set of laws derived from the Holy Quran. Whichever way it is shared the males get the higher share. In Sharia law, the wife of the deceased gets one-eight, whichever way it is shared. Where there is only a female child, she gets one-third while the male child gets two thirds, where there are more female children, they get half while the male Children gets half. Where there is debt on the deceased, it is announced on the third or eight day prayers so that the family can offset it. If they cannot, an equivalent of the amount of debt will be removed from the Estate and auctioned or sold to offset the debts. In some cases, the family can agree on the time to pay those debts to the debtors. Understand one thing, the laws of FRN are not against Wills. In fact Wills are a faster way if sharing any Estate. Where I come from the first some towns everything especially when he has done the second burial. There's a tradition in Abuja that says share the house amongst all even if it's a room each. Starboytwo: Dont sell anything. If u are to sell your house they too must sell there own houses too, let all the house of all the wives be sold and the money shared amongst all the children. The other wives can't have roofs over there heads while they expect u to be homeless. Highest u would find out that ur family share from the house might be just 1m or 2. That's a year or 2years rent in Lagos, would those same family members allow your family move into there house when u now become homeless. They just want to intimidate your family since your family is the youngest. |
