I gave my house documents to my cousin to take a bank loan of 3 million naira but I like to retrieve my documents back because of the way he and his wife have been doing things since October, 2019.

He is involved in sales of agrochemicals. He discussed with me on how profitable the business is but that he didn't really have money to put into it.

The wife lost her job in the bank and had to join him in the business. Being a close cousin and friend of mine, I gave out my house documents to him as collateral and the bank actually came to do some inspection in my house and I signed some documents.

The big issue now is that my cousin have not paid a dime back since August last year when he got the loan and between then and now he has done 3 parties that I'm sure gulped lots of money. The wedding of his younger sister in October, wedding of his brother in law in December and 40th birthday of his wife in January. These were serious lavish parties which I think could be done modestly.

I asked him on Monday about the loan and he said his moratorium will expire in February and there's no cause for alarm. This is different from what he told me before I released my documents, he said he will have gone far in repayment even before the expiration of moratorium. I reminded him about this but he said there is no problem about his ability to pay back since the business is lucrative.

I also discovered that one of our uncles actually borrowed him 2 million naira in 2017 which he hasn't paid back till now, he hasn't paid a dime back, I didn't do due diligence before releasing my documents to him.

Uncle told me yesterday that he would have discouraged me from giving out my documents if I had informed him before the loan was granted. Uncle also told me that he disagreed with him about his clubbing and partying lifestyles as a struggling businessman but that instead of appreciating his concern, he and his wife fought him and boasted his 2 million naira will be paid back before mid 2018 but till today he hasn't paid a dime. Hope I haven't shot myself in the leg with this help which I think I rendered to a friend and family?

The worst part of it is that my wife was not fully in support of my intention to help him then.

Where do I start from good people?

I feel for you. I hope your cousin fulfills his financial obligation to the bank so that you don't lose your house.
By signing as a guarantor, you are telling the bank that if your cousin does not pay, you will either pay or forfeit your house.
I am not a lawyer, but common sense tells me that you cannot "break the bond" to retrieve your documents from the bank without paying back the loan.
If he doesn't pay, if he has enough products in the warehouse, you should sell them to recover some money to pay the bank.

The things I'm reading here terrifies me. I just called his elder brother who knows about the loan and how I assisted him. He said I should calm down, that he will first ask him if he has started paying and then tactically advise him to start paying as from January ending as he promised. He also advised that I shouldn't fight him.

If they need 2million and I have 50k to let go, I will dash but say na borrow dem or loan dem; never! I still have a lot of money in their hands that I have left to God... humans are just wicked....

Oga, you have used your hand to do yourself, the house you laboured for with your own sweat you gave the document to a cousin to get a bank loan, who does that?

So you know, even with moratorium, interest is accruing and I'm sure by now the loan is getting defective and the bank is just waiting for the end of the moratorium to classify the loan then loan recovery sharks will come after you the almighty guarantor.

To avoid the embarrassment of unending police station visits or eventually losing your house, start saving up to repay the 3M loan plus accrued interest.

Next time, you will use your head and not be carried away by sentiments. Only borrow people amounts you are willing to forgo if not repaid and never guarantee anyone for a loan or job unless you have done your thorough due diligence.

I put down my brother's name as guarantor for a 2 million naira loan from Sterling Bank in 2016. When the loan was approved and I was told that he has to submit his properties documents plus bank accounts (for a soft loan which was originally from the CBN at 9% interest rate for the unemployed graduates, we were to submit our school and nysc certificates), I didn't bother to go back to my brother to inform him. This was because I knew that he wouldn't even use the documents to collect loans for himself, why would I expect him to do it for me? That was the end of the approved loan.
I attached the personal guarantee form that was sent to me to this post

I wouldn't even ask someone to do that for me. Not because "they won't", but because I don't want that kind of pressure.
Whatever it is I wanted to do with the money, there must be another way.

Very easy cake, arrest him and his wife, let them sign an agreement that should u lose ur house,they automatically forfeit where they are living to u so u won't be homeless,las las ba them go dey homeless and u go still dey ok small sha

There is nothing you can do than just keep mounting pressure on him to pay his loan at the bank, you've gone too far...the lesson I've learnt so far, never in any form have a business deal in whatever way with a family or relatives, they won't mind seeing you fail even when they see you sink, nothing concern them anymore...baba just pray u get out of this mess and try such again..who has such debt to pay and still lives a lavish lifestyles and throw party as if his or her life depends on the party..na because of the house the bank give am the loan and there is no how u can back out now.

He may surprise you and pay on time otherwise, take your time and meet the bank. I advice you meet the bank now to pre-inform them of your suspicions and your cousin's life style. They will pay special attention to him very early and mitigate whatever he may be planning

If he defaults, Always make yourself available to the bank, if you do they may delay confiscation till a better solution is found.

I believe you wouldn't lose your house but whatever happens, don't fight the bank. Meet the manager one on one. If you aid their recovery process, your house might be saved, they are humans too.

First of I’ll like to say you are very silly...with that out of the way let me advise u.

1. You are only a surety or guarantor...so you are only liable for the loan when the bank has tried all efforts to recover the loan from him...so expect he sells all stocks and disappears...u are still save but very stupid.

2. At the expirations of the date of repayment you are no longer liable..and u can go to the bank to withdraw your documents as u didn’t guarantee him forever.

3. Do not alert him to any steps you are making to retrieve your money...

The bonds of family is very fickle and almost worthless..place very little value on it

Please what is all these negativity, insults and doom sayings embarassedThe guy might have made a mistake and may probably lose his house but it's not the end of the world. Y'all are probably going to contribute to his high blood pressure and maybe attempted suicide with all these condemnations and negativity more than the house loss itself. People make mistakes for crying out loud!

@poster; I believe you have a very good heart which was probably why you tried helping your cousin this much. It's quite unfortunate that he took advantage of you. I may not have a piece of advice on how to recover your documents and property but just sieve through the comments IGNORING all the negativities and insults. There are some very good advice there; follow through with them not forgetting prayers. If peradventure nothing worked out; please do not lose hope. It is not the end of the world. Where there is life, there is hope.

At this point i think you need to get a lawyer involved, look for a way to make him sign papers that would make him give up the business ownership to you or the bank if he fails to pay back, be fast about it.


It is already late for this, because he may not want to sign any document since money have already exchanged hands. If it was before he gave out the loan no problem, but after. I doubt if debtor will be willing to append his signature.

Uncle is buoyant, he is a businessman/contractor and can afford to part with 2 million, this he told me himself yesterday since he wouldn't want to use force to get his money from him but can I afford to part with a house I laboured hard to build for close to 8 years as a government worker? No!

I don't borrow people money neither would I use any property as collateral for family or friends. I would also never co-sign a lending commitment that is not my wife. I can dash family money but not borrow. if I don't have enough to dash, then I don't have.

I have learnt the hard way. They will be all nice when borrowing or making the request, but once they get what they want. You would be the one begging them, and they will even laugh at you.

I gave my house documents to my cousin to take a bank loan of 3 million naira but I like to retrieve my documents back because of the way he and his wife have been doing things since October, 2019.

He is involved in sales of agrochemicals. He discussed with me on how profitable the business is but that he didn't really have money to put into it.

The wife lost her job in the bank and had to join him in the business. Being a close cousin and friend of mine, I gave out my house documents to him as collateral and the bank actually came to do some inspection in my house and I signed some documents.

The big issue now is that my cousin have not paid a dime back since August last year when he got the loan and between then and now he has done 3 parties that I'm sure gulped lots of money. The wedding of his younger sister in October, wedding of his brother in law in December and 40th birthday of his wife in January. These were serious lavish parties which I think could be done modestly.

I asked him on Monday about the loan and he said his moratorium will expire in February and there's no cause for alarm. This is different from what he told me before I released my documents, he said he will have gone far in repayment even before the expiration of moratorium. I reminded him about this but he said there is no problem about his ability to pay back since the business is lucrative.

I also discovered that one of our uncles actually borrowed him 2 million naira in 2017 which he hasn't paid back till now, he hasn't paid a dime back, I didn't do due diligence before releasing my documents to him.

Uncle told me yesterday that he would have discouraged me from giving out my documents if I had informed him before the loan was granted. Uncle also told me that he disagreed with him about his clubbing and partying lifestyles as a struggling businessman but that instead of appreciating his concern, he and his wife fought him and boasted his 2 million naira will be paid back before mid 2018 but till today he hasn't paid a dime. Hope I haven't shot myself in the leg with this help which I think I rendered to a friend and family?

The worst part of it is that my wife was not fully in support of my intention to help him then.

Where do I start from good people?

He promised to start paying by January ending, if he fail to do this, is it possible to break that bond and retrieve my documents from the bank? Can I tell him and the bank that I'm no longer interested in guaranteeing the loan? I'm afraid, kindly help.


U will have to either ensure he currently has the capacity to pay by finding a way to check his financial books or start to look for away to sort out the loan just Incase he defaults.

U don’t help people in such high risk ventures because they are family or frnds, u Help them because they are credible and capable of delivering which u must confirm and be sure from necessary investment perspectives.

The things I'm reading here terrifies me. I just called his elder brother who knows about the loan and how I assisted him. He said I should calm down, that he will first ask him if he has started paying and then tactically advise him to start paying as from January ending as he promised. He also advised that I shouldn't fight him.

I really clap for the person who formulates all these Zee World stories. Honestly, who would be so dumb as to release his home documents to a cousin, not even an immediate family member, for him or her to borrow loan? It seems the author of this piece is still dwelling in his dumbness of past years and will never recover. Maybe he thinks these kinds of stories are relevant.
