Prof. Itse Sagay (SAN), chairman of the Presidential Advisory Committee Against Corruption (PACAC), has said it will amount to a wasted attempt on the PDP and Emeka Ihedioha’s part to go to the Supreme Court for a review of the Imo judgment.

“No, he has absolutely no chance. I don’t think the Supreme Court will even agree to a review. Even if they agree, it is totally unlikely that they will accede to his request to return him as governor.

“The judgment was a very measured one and the case of the votes that was not considered and there was no power whatsoever to cancel such votes except by a tribunal. So, the argument is water-tight and I don’t see what they can do.

“I don’t know why they should be so desperate. The APC lost much more in Zamfara where they won by landslide and the power was handed over to the losing PDP. They did not die. So, I don’t know why the PDP is so desperate. I think it is a totally wasted attempt”.

Also speaking, Chief Mike Ozekhome (SAN) said those saying the Imo judgment can be set aside are ignorant of legal provisions.

“No! Generally, under the Supreme Court rules, except when they commit what we called clerical error, the Supreme Court rules forbid the Supreme Court reviewing its own case because it is the final court.

“Otherwise, there will be no end to litigation. People who are saying the Imo judgment can be set aside maybe really do not know the legal position,” he said.

The reason for being desperate is clear. The southeast is assumed to be a PDP controlled region and the worst they can accept is APGA -being founded by Ojukwu.

They had hoped for Okorocha's loss and Ihedioha was the only hope. That hope has been dashed by Hope grin

Their fear is the extinction or relegation of PDP and the Igbos to be under a hausa dominated or owned APC. This could however be likened to the defunct NPC's dominance in the 60s

How can someone who is not a party candidate become a governor ...shegay systematically avoided that part

Ihedioha should have hired competent lawyers in the first place.. He would have probably got re-election judgments.

He shouldn't waste his money on court cases like Atiku most especially when loyalists have deserted him

, the Supreme Court rules forbid the Supreme Court reviewing its own case because it is the final court.

Atleast it would be on record, the supreme court was asked for a review on that judgement with neccessary points layed out..

You know you people in the other side of the divide hate to hear the truth. That's how you people hailed Atiku until he started thinking that INEC results were in a blog being managed by one blogger from Kenya which also partners with INEC server.

People who say the Supreme Court cannot review its own judgement if it finds very fatal errors therein, make me laugh.

So a simple question: if the Supreme Court sentences a man to death for murder based on evidence before it; and then developments later proves that the evidence upon which the SC relied on was false, will the SC allow that man to die just cos it cannot review its judgement?
