When Kogi state APC guber candidate Abubakar Audu died before he was declared elected, expectations was that his deputy based on the joint ticket was going to assume the position of governor elect. It never happened.

Now we have a situation where a deputy governor elect whose candidacy was removed and the governor himself removed with him based on joint ticket.

But we also have several deputy governors removed from office via impeachment, it will be logical that any deputy removed from office based on impeachment, the governor must also leave office based on joint ticket.

The only option here is to say when both candidates are sworn into office, their joint ticket seize to exist but before then, they have a joint ticket.

But? Why does the deputy governor takes an independent oat of office if the ticket is joint?

I think this is the most controversial supreme court verdict of all time.

Am not learned, just a confused Nigerian thinking aloud. What are you thinking?

By this judgement, James Faleke was supposed to be Governor of Kogi not Yaya Bello.

Also, if the Abubakar Audu votes went to the second runner up in APC, same should have been done here.

Your getting things mixed up. This is a pre-election matter. The ruling of the supreme court is that since the Governor elect is disqualified from running, the Governor elect was also disqualified. APC had no Governorship candidate in the elections by law

their ticket is joined by the constitution... anything that affects one affects the other during election but once duly elected, they can't be affected jointly by impeachment unless both were found wanting

You are getting it wrong.

For the umpteenth times, Audu's case had no precedent. It was a landmark judgement.

Audu was not Governor-Elect before his death. He was leading but his election was inconclusive at the time.

If INEC had pronounced him winner and he finally 'kicked the bucket', Faleke would be Governor.

In this case, Lyon had been pronounced Gov-Elect by the electoral body. The ticket is a joint one.
So one is infected by the other. Same goes for President-Elect/VP-elect.

You have confirmed my opinion with the bolded.

If Faleke can become governor on only one member of the joint ticket, then David Lyon should remain on the ticket while he shops for the replacement of the deputy governor. It is the same way if a deputy governor is impeached.

But set aside the Appeal court decision on the matter.

There is a difference between Governor-Elect and Governor.
Massive difference.

You can read this judgement by Justice Kekere-Ekun (JSC) on the case between Faleke v INEC & ANOR. It's a long read.

Yes.
The FCA dismissed the judgement of the High Court.

What does it make?
In the case of Imo, the FCA and tribunal averred Ihedioha won but the SC disproved. What about Adeleke?
It doesn't mean.

All.the courts can agree then the Supreme will say NO.
All the Courts can also disagree, then the SC will say YES.

We seem to be attacking the judges and Lyon...

The Deputy-Gov for APC should have been tied at the National Secretariat and flogged three times a day.

A high court disqualified APC before the election meaning not qualified. APC rushed to appeal it and now it has backfired. The disqualification was before the election
