The next phase of the Bayelsa case is going to be a fresh case whether INEC was right to return the PDP candidate based on the earlier SC judgement which ordered Inec to issue certificate of Return to the candidate with next highest votes and REQUIRED SPREAD. The point here is whether The PDP candidate got the required spread by law. The SC have settled the case of forgery, so the battle is still on Whether INEC acted based on the SC ruling.

That will have to be a fresh case showing he does not have the spread as calculated by INEC. It can't be a case for review. In the case of Imo though, the issue of spread is left in the air as INEC did not even update their election records after the judgement.

Neither PDP nor Emeka was a party to that particular suit, therefore was not a beneficiary of that judgment. Recall it was APC intra-party affairs. Citing Ishaku vs Aisha (mamaTaraba) 2015 and Ortom Vs Tersor 2015, PDP and Ihedioha are gone for good.

Even at that, with that judgement, it means APC had no candidate since they never presented Hope as a replacement for Nwosu. If it had no candidate, then it should not have participated in that election which makes all the votes casted for it null and wasted

Itsme01. Since you didn't mention me I assume you've read this news? Now you understand that there will be no end to litigation if this scales through. Sorry those lawyers had your hope's up but that's what they do in order to pocket some cash. Thank God the SC penalized them accordingly.

The Supreme Court today spoke loud and clear, we cannot review our judgments. It also imposed heavy cost on all the Senior Advocates who filed the application for review. That is why I love the judiciary, it is the only arm of government that has internal cleanings mechanism. If your lawyer allows you to file frivolous action in court, the court can impose heavy sanctions on him to checkmate lawyers abusing the judicial process for private gains. No hope for Ihedioha

Let me thank the SC for maintaining its stand and its supremacy.

I thank all here on NL who participated in this discourse whilst it was on. Let me also thank all the NL legal gurus who participated in this process...for or against

vicdom dansuqi kahal29 ejimatic ChristianNorth agborojietiye Lostz, and many others too numerous to mention.

Let me officially congratulate the miracle Gov Diri and the people of Bayelsa, and in other words stretch out to Govs Uzodinma, Matawalle, President Buhari likewise for officially retaining their seats for the upcoming reviews which will be pooh-poohed and thrown out the window.

She said, “There must be an end to litigation, the decision of the Supreme Court is final for ages in a matter.”

She said that with tears in her eyes she regretted that “very senior” lawyers were responsible for filing the applications.

The apex court awarded the costs of N10m to be personally paid by Lyon’s lawyer, Chief Afe Babalola (SAN), and APC’s lawyer, Chief Wole Olanipekun (SAN).

It ruled that each of the lawyers must pay the N10m to each of the three respondents – the Peoples Democratic Party, Governor Duoye Diri, and the Deputy Governor of Bayelsa State, Lawrence Ewhruojakpo. Punch

https://leadership.ng/2020/02/26/bayelsa-governorship-poll-supreme-court-dismisses-apcs-application-for-review/

NB: Olanipekun 10million, Afe Babalola will pay 20million naira each from their pockets.
while I congratulate the governor again,my concern is,let Diri get to work, let him prove people wrong that he won't deliver.BY is far behind in terms of development, the governor needs a cabinet of technocrats who are willing to wholeheartedly work with him to deliver.

APC presented Hope who contested the election, APC NEVER presented Uche Nwosu as their candidate. How can you say APC had no candidate in that election?

I like the emphasis ''no court ON EARTH'. At least the Augie lady knows and admits that planet earth is their only area of jurisdictions. Anything beyond that is God's own area of jurisdictions where ALL are to face judgements.

I agree with you

gidgiddy:

As much as I think that Ihedioha was robbed, this Bayelsa case has shown that the supreme court does not reverse its self, they cant afford to. If the supreme starts reversing its judgment, everyone whoever lost at the supreme will come for judgment review.

The Supreme court never reverses its self, the only thing they can do is correct a clerical error in the judgment

Ihedioha and Lyon never stood a chance

Obviously, the SC is not in any position to review or admit that they screw up, it's like asking them to admit that they are useless and incompetent even though the judgements was obviously flawed and unconstitutional.

...but I do agree with them that the SC is the last stop in all legalities in Nigeria and the culture of running back to the SC for ridiculous reviews must stop.

The SC's decision is and must remain the last say regardless of the decisions they render.

What our lawmakers must do right now is to amend the constitution and electoral laws to prevent the SC from installing or removing people from office or picking governors instead of the people by via the ballot box.

Questionable elections must be sent back to the ballot for a re-run for the people to vote and select their own leaders instead of the SC truncating democracy by deciding and dictating for the people.

We have a lot of work to do in this country.

Sadly for Ihedioha with this ruling, it's the end of the road.
yes just like the US political system.
OH my gosh, I like American politics.
