It is not yet over for the Governor of Bayelsa State, Senator Douye Diri as the Federal High Court sitting in Owerri has fixed Tuesday, 10th March, 2020 as the day to deliver its judgment in the case instituted by Timi Alaibe challenging his emergence as the candidate of the People’s Democratic Party (PDP) for the November 16 2019 Governorship election in Bayelsa State. NAIJA LIVE TV reported earlier that Alaibe had approached the court to challenge the inclusion of elected Local Government officials as delegates for the PDP Primaries, which he believes led to the victory of Diri. Two things will likely happen but there's an 80% chance that the pdp primaries will be nullified.one,illegal delegates were allowed to vote against the pdp constitution.secondly,a court gave an order on how voting will be done yet it was flouted and this will not be taken lightly by any court. The court can alternatively deduct the illegal votes from the illegal delegates and count the remaining to see who wins |

Facts of the Case: Ndutimi Alaibe made three prayers:- 1. That the PDP guber primary be nullified on the premise that the Ward congresses of the PDP was not well-conducted and did not follow the constitutional guidelines of the party. 2. That the inclusion of the local government elected officials as members of the delegates was illegal. 3. That the inclusion of the ad-hoc delegates was suspect and not in tandem with the statutes as labelled in the PDP guidelines, the Electoral Act and the Nigerian Constitution. He furthermore stated that the PDP constitution , Section 50(1): "The NEC shall, subject to the provisions of the Constitution of the Federal Republic of Nigeria 1999 (as amended), Electoral Act (as amended) and the PDP guidelines, formulate guidelines and regulations for the nomination of candidates for elections into public offices at all levels and shall be the final authority for resolving all disputes relating to the choice of candidates for the party for any election." |

senatordave1:Even if he gets the victory the PDP and indeed Alaibe cannot get the seat. The Supreme Court settled in the case of Modibbo v Mustapha & 2 Ors on the 30th of July last year, that you must participate in all stages of the election. So the PDP will lose the seat. |

senatordave1:No court gave this order, unless I am wrong. Justice Eberiyin Omukoro (co-incidentally from Sagbama) of the Bayelsa State High Court struck out the case because he opined he lacked the jurisdiction and cannot rule on a pre-primary suit especially when he doesn't know the candidate(s) or seen the delegates list that was the subject of contention. As for illegal delegates list....the Court hasn't determined yet. |

The removal of Lyon was actually a plot for Alaibe becoming the governor of bayelsa state.(Buhari is aware of this one) Goodluck as a former president needs a son in Bayelsa. Should this case made it's way to the Supreme, Tanko may be heading this one himself. If really you understand my point. |

ZAWs:He can't be Gov.....the Supreme Court has ruled earlier that you must participate in all segments of the elections before you can be said to be the winner. Case: SC.90/2019..... Even if the primaries are nullified, the PDP has no candidate. Don't forget Diri is praying the primaries be nullified. It will go to the next party after the PDP. |
