Time to move on .. But the fact remains you still owing me. And also you still owe from previous weeks that you were balancing 5k naira extra weekly on top your weekly payment ..

I am not calling you a thief, but a thief is a thief regardless if he or she steals 1kobo or 1million .. Plus do you expect me to bare all the cost of the windscreen and damage hood of the car ..

The 15k naira that was given to you for damages do u think it will cover the cost of my car? And u know that I don't joke with repairs .. Anytime an issues arises with the car I fix it right away.. So you can't deny it at all, go and write it down you will not see a better partner than me..

Like I said time to move on, and all is forgiven......

Sir I will like you to be specific on your word please I would like you to sit down one calculate your money very well sir and Discover that I did not owe you any extra 5000 the last money I paid to you was 35000 naira to balance of my outstanding

As you may know during this covid-19 period, things would move very slowly
On a weekly most drivers here return about 25k-20k (it's actually negotiable as you two would become 'partners' )
On the "modalities" your preferred driver should have 2 secured and strong guarantors and also if you would be leaving the car for the driver you'd have to see where he is going to be parking your car and if it is going to be secured and safe to avoid stories that touch
Also for repairs and the likes you should negotiate the conditions thoroughly with your partner to avoid story for the gods, if possible involve a lawyer or get to a signed agreement between you both.
Lest i forget I'm a registered driver on bolt and I'm looking for a partner. So what do you say we team up?
I've people to vouch for my proficiency and also you could read my posts just to have a take on my personality i'm not a marlian or a roughian
I await your assessment and response.

Dru, this has nothing to do with your case as I dont know if the driver was at fault or not. So, please no name calling.

First and foremost, when a partner gives you a car in good condition, you're expected to take care of it, and drop it in good condition too grin

But life is unpredictable. In a case where the driver is involved in an accident that is clearly not his fault, I expect the driver to hold the "cause" responsible. Either they pay for the damage on the car, or you activate their third party cover(we talked about that sometime last year or two years)

But in all, if a car is comprehensively insured,it takes care of everything. There's peace of mind, and also, the partner can still discipline the driver with ease grin

In all, the driver is responsible for the car. So that's why as a driver

-Dont overspeed
-Stop dragging lanes with cars
-Keep adequate distance between you and the car in front
-Learn to drive defensively
-Use your senses when overtaking.
-Still pray for God's protection

You guys have successfully turned this thread to a place for throwing childish tantrums. Thats why I decided to "dey my dey" of recent before somebody provokes my anger and I decide to fix accident for him or her successfully.

Not to type too much or be too over bearing, I will just state my opinions on some issues that came up here of recent.

The Mugu that claimed he dropped people off on 3rd mainland bridge is a mad man. Even though I know that the story was made up just to get attention, please be guided on actions you fantasise to take and bring on public forums. I want to assume that the story happened even though its a lie.

Those who claim I will support him too are being economical with the truth. I only challenge evil when its obvious my life is being threatened.

The only time I remember abandoning a girl in a lonely path was when I saw a huge flood in front of me getting close to her house. I wanted to end the trip there for her to continue on legs. She refused. I offered to drive her back to pickup point she refused. I only acted rashly when I noticed that this lady only wanted to fulfil her own selfish interest by having me drive through a flood that may sink my car. I had to dish her and run away.

But if truely people were kissing in your car and you dropped them on 3MB, you are nothing but a raving Lunatic.

N.B
I find nauseating the way you quote people up and down too. You have to stop behaving like an overgrown baby girl that lacked love while growing up. Just an honest advice though.

Regarding the issue of Insurance that has been raising dust, I must tell you guys that it seems that you people don't know that this is Nigeria where everything is useless. People are very sweet at the beginning of transactions when they have not gotten your money. When they have gotten your so called insurance money, wait till the time you need it.

The way most of you see this insurance thing, you make it look like its a walk through the park when laying claims. Most of you make it look like you have accident and walk into there company and they repair your car like that abi? You don't know there will be investigations and protocols which may take weeks or months to finish?

There is no insurance that works magic like "Careful Driving". Yes I know that even if you are careful, bad things may still happen. But thats why its an accident in the first place remember?

Why am saying this is that the way you people jumped on the issue of insurance without putting to cognizance the very stuppid driver that damaged someones car is very annoying.

Having an insurance is not a one way ticket to become a vin diesel or fast and furious driver. Most times, when I see what this Coro boys do with peoples car on 3rd Mainland bridge, I can't but shudder. You will see a morron that will literally go from 1 to 120 km/hr in seconds! Who drives like that?

During my driving days in Lagos, I know so many hopeless drivers that take joy in damaging peoples cars. And believe you me, there is nothing you can do about it! Even if you take the matter to the police, you will find out that you are spending way more money than you will recover. Yes! Nigeria is a hopeless zoo. Even to open a case file against a driver will cost you 2k-10k depending on the station. Then starts the long process of investigations that will cost you a whole lot and at the end of the day, you will spend more than you are trying to recover.

So many Nigerians are ontologically wicked and evil. Even their mama breast they suck at birth is evil. Otherwise, what would make you damage someone's car and within a day of damaging it, you are already looking for another partner to damage his investment?

I know 3 particular Lagos drivers that have damaged more than 50 cars between the 3 of them! Till today, I know that they are not making it in life.

Smellos.

I saw this coming, that was why I opt for drivers to get by whichever way they can as long as they don't hurt anyone or their self and family. The previous winter is child's play, imagine a family with 4 kids after the first half, when the real one is about to start. This too shall come to pass

Dru, this has nothing to do with your case as I dont know if the driver was at fault or not. So, please no name calling.

From litigation view... Who is liable in any given contract is been address by the agreement/MOU binding both parties, not just signed and sealed, but stamped and accepted by court of law.

Too many times we neglect or by ignorance forget to register under CAC before embarking on any sought of business, which I am guilty off as well. Another part is not emphatically stating the role of a guarantor in agreement clauses, if they will b liable or not in case of certain occurrences, all we just do is get two people to stand for business partner... These r part of the reasons guarantors go free when its said and done, cos they r no clause(s) indemnifying them.

A straight answer to the question

On HP: Driver is liable for any repair, accident or not, even during the period of repair, he must not stave me of my deserved dues, if he wants to use accident as an excuse... Its within my jurisdiction to get the car back and he must fix it before return. I once signed an agreement with a driver, that upon termination due to driver's inability to meet up with agreement then the car must b certified OK by blackbishop before return.

Rental: Drivers are not meant to b liable for any repair above 5k, that means the owner of the said valuable is liable to repair the car. Unless it is crystal clearly stated otherwise in the agreement that driver will b liable in case of foreseen and unforeseen event or a share factor will occur in such instances.
