The counting Starts from may, is very simple from April to may makes it one month and then if you continue counting like that it will take march to April to make it the 12 months. For instance it takes January 1st 2 December 31st to make a year so in this case your rent is supposed to expire a day before the date u paid

I see a lot of peeps here do not know much about tenancy/lease agreements. In such tenancy agreements, a calendar year equates 11months, and not 12months.

Chai, this thread is embarrassing, some people don't know how to calculate simple date mathematics. The rent expires the day before his date of payment. That is 1 full year/ 365 days

Some rental agreements are based on the start of the month. The OP's agreement might have been backdated to April 1st. That's the only way the landlord is right. However, if the agreement explicitly stated 14 April, then the rent doesn't expire until 13 April and even so, a 6 month's notice has to be given (during which the tenant MUST pay rent) followed by a one week notice, after which forceful eviction is possible

Then the landlord is still cheating the OP, if the landlord wants to be using months then he should start to calculate his rent from the following month from when the house was rented. For example house was rented 14th April, then the landlord can write May 2019 to April 2019. But even doing so is wrong.

The Lagos tenancy law stipulates that the date payment was received should be written on the receipt.

Each country/state has her laws. But, in Nigeria, January to December is regarded as a calendar year..so, it's April to March..as a calendar year.
Well, I won't regard it as cheating...But, ignorance isn't an excuse either.

Wrong.  April 18 to May 17 is 1 month, so use this format to calculate it. His 12 months  rent expires on 17 April 2020.

April 18 - June 17 = 2month

April 18 - July 17 = 3month

April 18 - August 17 = 4month

April 18 - September 17 = 5month

April 18 - October 17 = 6month

April 18 - November 17 = 7month

April 18 - December 17 = 8month

April 18 - January 17 = 9month

April 18 - March 17 = 11month

Christmas is on the 25th of December and it's a yearly event.


By your logic, this year's Christmas should be on November 25th and next year should be on October 25th and so on.

I just want to correct the person who said "January to december is 12 months and so as the Landlord being correct" If I rented an apartment on the 31st of december,, it would mean that the january ist that I would pack in tthrough december 31st makes exactly one full year.

As a batch C 2014 youth corp member, we started our orientation camp on the 4th of November 2014 and we rounded up our service on the 3rd of October 2015, which is exactly 1 year. A year is January to December and not December to December.
So your landlord is correct.

You tenants are really a problem. You posted your own side of the story just to get sentiment from people.

Now listen very good, NO LANDLORD will chase out a very good tenent out of his house even when the tenents owes rent.

Most tenants really misbehave a lot all because they think they have paid rent. Paying rent is not the major thing, being loyal and respectful to your landlord or other people around your neighborhood is very important.

No matter what you try to preach here, trust me there is something bad about you that your neighbours or your landlord sees and don't like which is why they want you out with or without your rent.

I know a lot of people that in difficult times, their landlords even cater for them like a family member because of how well behaved they are and how they maintain the property they were given on rent.

Please leave sentiment and check yourself first, whatever you are doing wrong that might seem right to you because you are paying rent might just be the reason you are wanted out.

Your landlord is actually right. The 18th of April you moved in is actually counted as a whole month in the eyes of the law, and that is how the receipt issued to you should read ; April to March following year. However, he has no legal right to lock you out. That would be resorting to self-help. He needs a court order with the help of a court sherif to do that, which is not automatic. He is required to serve you statutory notices then summon you to court, because you have a right of audience to say your part. It's left to the court to determine if u should be ejected or not. Not the landlord.

No one has the right to self help. Even if you are in arrears or owes rent of 10 years, your Landlord do not have the right to lock you apartment. Doing so makes him liable in damages.
If truly, your rent was paid on the 18th of April 2019, then your rent will fall due on the 17th of April 2020.
Unless their is an agreement between you and your Landlord, he cannot successfully evict you without giving you the statutory 6 months notice.
Rest assured, your Landlord cannot evict you but only reacting to the frustration ocassioned by the lockdown.
