That word "Perceived" gave him out because it is completely open to interpretation in the field. Even raising your hands up to surrender in a situation like that can be "Perceived" to be threatening. The Nigerian security forces do not use body cams and they do not typically invite reporters to a raid. The security forces can simply write in their after action report(If they have one, I believe it could be mostly verbal in Nigeria), that the situation was "perceived" to be threatening which is why they opened fire and killed 30 people.

About the jail term, you’re right the DSS can not determine the jail term of an individual because that’s the job of the court and a lot of things come into play when the court is making a decision(judgement).
