The next time any official stop and arrest you please tell them you will sue them, and that you know your fundamental human right, they do not have the right to arrest you or take you to their station .

Please grab their name and let them know your lawyer will write them.

Police and vio deserve to be sued. Instantly call your lawyer any where they take you to..let your lawyer be aware should anything happen to you.
I tell you they will tell you to carry your wahala dey go. Some will even ask are you a lawyer.

I got flagged down this afternoon by VIO in the FCT. One of them asked me for my papers which I handed to him. After inspection, he asked if I had a valid driver's licence, I replied yes. I made attempt to pull it out from my wallet but noticed that the Officer had walked away from my car. He met his other colleagues who were seated and then signalled me to join them.

Got down from my car and realised that I was before a mobile court. My offence, as read out to me, was that I was not wearing a facemask inside my car. I explained that I have one in the car which I wear whenever I step out of my vehicle. They refused to listen to me and went ahead to fine me the sum of five hundred and fifty naira only. I was given a paper which did not carry the details of how much I paid. I insisted that I needed a receipt for the fine which I paid. After much reluctance, one of the VIO rudely scribbed the amount they collected from me on the paper.

The mobile court judge was rude to me and others whose case he heard while my Ordeal lasted.

I guess that the time has come for everyone to wear his/her facemask at all times irrespective of where one is.

Has anyone had a similar ordeal?
They had nothing on you so they tried their luck with the face mask tactics.
Some police officers tried that nonsense with me in Lagos, first I told the one that came forward to step back , then wore my mask and then I unleashed my Lagos crase for them.

The mistake you made is not wearing your face mask before talking to them at all. I don't use face mask when I am alone in the car. But anytime I am approaching any check point, I put on my face mask even before winding down my window. I can't talk with anyone without my face mask on,no matter how much they try to stampede me.

Heard u here, u said u valued your time, that's always the case with NIGERIANS,let him open his law books and show you where it's written that if someone alone is driving in his or her car without a facemask is an offense under the law of Nigeria
When you are before a mobile court, you are not expected to plead not guilty. They're not interested in the truth but the money. Go to the mobile court in lastma hgts and they will tell you that the case will be transferred to a regular court and your car will be impounded with demurrage counting till the court date. You will gladly pay and let them let you be.

You only wear a face mask when you step out of the car, yet you failed to do so when you went to meet them? What if these officers are carriers? With all due respect sir, you deserved to be fined.

Dr Sanje of CNN a similar question by an interviewer on CNN. The man specifically said no, it is not neccessary. That infact it is dangerous.

PLS THIS IS FRAUD. HOW CAN U WEAR FACEMASK WHILE DRIVING IN UR CAR ALONE.? NIGERIA AND UNINTELLIGENT LAW ENFORECEMENT TEAM SHOULD STOP EXHIBITING HIGH HANDEDNESS AND FOOLISHNESS TO D INNOCENT. THIS IS VERY WRONG AND COUNTER PRODUCTIVE IN D FIGHT AGAINST COVID-19 PLS.

You fell in their trap when you steeped out of your car without a facemask. It was all planned that is why the other Vio officers signaled you to come meet them. I strongly believe it was few seconds you met them that you were taken to the mobile court, so they court arraign you before the magistrates that you were caught in the act.
The magistrates wasn't wrong to have fined you because you were in public space WITHOUT facemask, it was of little importance that you had facemask, it was also of major importance that you were driving alone without facemask but this major importance ended and was of no importance the very moment you steeped out of your car without a facemask. That was the game changer

Pray that you do not get caught up in the same situation. The guys I met yesterday were out to extort money from motorists by all means. Did you read where I tried to make a defence that I didn't need the facemask inside my car as I was alone? Did you read where I described the mobile court Judge being too full of himself and not willing to reason with me? We are in a lawless country where anything goes. I valued my time more than to exchange words with government officials who should have known better but decided to look the other way for financial gains.


that is mistake we always make in Nigeria thinking we value time more than white people but bring corruption to our system, while driver always bribe govt official even with their complete document is they're trying to save time. but unfortunately this has corrupt our system in every sector. is only God can heal this nation because we as nation are not ready

What is the business of a VEHICLE INSPECTION OFFICER with the dressing of the occupants of the car. Before you know it, FRSC would follow suit as if not wearing a facemask compromises road safety in any way.

Since they are so concerned about the pandemic and "working beyond their mandated job description", why don't they post their staff to research facilities to work with vaccine development teams to get a viable cure for this disease? Rubbish.

They are not ready to work. Planning and problem solving is not their thing, heck that's not what they signed up for! They specialise in creating fake problems and offering a "solution " just like the Mafia.

If the procedure for obtaining/paying the fine followed rule of law then it is not an illegal act. If you had said the Vio officers were overzealous I would have agreed 100 percent. The moment op stepped out from his car like I said was the game changer

It is not within my jurisdiction to sound politically correct or socially accepted. This is a legal matter, all I have to do is to analyse it legally. I never and will never had the intension of making you like my views on a matter of legislation/law. Happy Sunday

If you are as intelligent as you insinuate, you should have learned that [b][b]whatever protection a driver driving alone in his car without a facemask, that such protection end the very moment such a driver step out (and in some extreme case driver suppose protection/defence ends the moment he/she drive without rolling up the car window whether he on AC or not). Such protection/defence that should have been available to such a driver do not extend the moment the driver step out from his car (why I used the word game changer)
a) whether or not he/she was actuated by other motives before steeping down from the car;

b) or whether an overzealous officer induced such a driver to step out from the car when such a driver even have 1000 pack of unused facemask for as long as the driver had the voluntary option of using a single unit of facemask but failed to use it such a driver would lose the protection save to the possible defence of duress and force to get the driver out of the car (involuntary) but in the instant case the driver came out willingly without the exertion of any force[/b].[/b]

cc: Uboma if you read all the bold I believe you will better understand the position of the magistrate. I sympathize with you no doubt and I admit the law enforcement officers were overzealous. There are some instances that judicial officers CANNOT exercise descretion, however this descretion are readily available to administrator of the law such as the officers you encountered, this has been emphased by the court over and over again even in the case of Shaw v DPP.

Once more the judgement of the court was fair and just, your defence in the instant case would have been "INTENT" (if it was specifically stated as the mens rea for the offence in the legislation) and NOT "MOTIVE" you tried to adopt as defence. The game changer was the moment you steeped out from your car WITHOUT a facemask, and in extreme case the moment you rolled down the car window WITHOUT prior wearing of facemask. Even the extremist will view that the law enforcement officers were not overzealous and if they should assert so then I must say they aren't wrong but can't say if they are totally right. (The beauty of law is everyone has to disagree to agree why Oliver Wendell Homes assert that the law is what the court say it to be).
