While the Abuja high court gave him an exparte order to act as chairman (through Salihu the plaintiff who now denies knowledge of such order) the Rivers State suit instituted against Gaidom stripped him of every right and privileges of a Member of the NWC which included him acting as Chairman.

Leave them to wallow in ignorance.osun never thought him any lesson

The legitimacy or otherwise of the waiver can only be argued in court. The opinion of people like you is no longer relevant since there is a valid court judgement on the matter. For now, the court has ruled that Giadom is no longer a member of APC NWC and should stop parading himself as such. It is only a superior court that can reverse that decision.

These APC minions never cease to amaze me with their dullness. I remember when oshiomole was first suspended. Some of them claimed the court lacked jurisdiction will others claimed the APC constitution does not allow a national officer to be suspended by his ward.
Fast forward today, they are brandishing a rivers state high court judgement to stop Gaidom from acting as NWC member in Abuja without asking the jurisdiction question while the same APC constitution was read from by the CoA in affirming oshiomole's suspension.
Never seen a more confused and willingly ignorant bunch!! undecided undecided

And regarding Edo election, the party’s primary will hold as scheduled and the name of the winner will be submitted to INEC by Ajimobi.

Btw, when is Giadom conducting his own screening? I remember the clown saying he has canceled the screening done by the NWC, when is he conducting his own now? Where and when is he conducting his primary election or is his one man faction not interested in presenting candidate for the election?

Unfortunately for Giadom, the said waiver has no legs to stand in APC's Constitution. He can't take it to court to enforce it and succeed. APC's Constitution only makes provision for a waiver for a person who was not a member but who came shortly before a general election to be the Party's flagbearer. It is also for an Executive Officer of the Party to be permitted not to resign from his office 30 days prior to the date of his nomination or to the date of Party primary to contest for an elective Office in a general election.

Article 31(1)(iii) of APC's Constitution makes it mandatory that any Party Officer seeking to contest an election " SHALL RESIGN and LEAVE OFFICE 30 days prior to the date of nomination or Party Primary for the Office he or she is seeking to contest."

Article 30(2) empowers the NWC to grant him waiver for the Provision. By implication, it only means that the requirement to resign 30 days to his nomination can be waived. It means the Party Constitution only permits him to remain in office without resigning until the day of his nomination or getting the ticket to contest at the Party Primary, after which he SHALL LEAVE or vacate the Office, according to Article 31(1)(iii).

The Officer is deemed automatically to have leaved or vacated that Office from the day he secures Party's ticket or nomination to contest in a general election.

That's the reason, in the case of Victor Giadom, for his seeking for a waiver "requesting to resume office following the conclusion of the 2019 General Election". You don't resume to where you didn't vacate from in the first place. But unfortunately for him, there is no provision for such resumption or return in APC's Constitution.

No mention is made of waiver for an executive member who had become the Party's flagbearer to contest for an elective office seeking to return back to the executive position, like the case of Giadom.

The waiver granted to him was just a gentleman political arrangement initially aimed at reconciling him and Amaechi, his godfather, with the Party. It can be reneged upon or reversed. And that's what the NWC had done by ratifying his resignation, immediately he started laying claim to the Party's highest Office again. And Giadom can't successfully seek to enforce the waiver because it has no foundation in their Constitution.

No part of the Party's Constitution empowers the NWC to grant waiver for return of Exco members back to Office, after contesting an election. If there is, it would have been an unconstitutional act on the part of the NWC to repost him to another position, as they have done for Giadom, giving him the post of an Acting National Secretary instead of the Office of the Deputy National Secretary from which he left to contest.

All it means is that it is just a gentleman's arrangement accepting him back into the Executive position in the first place having vacated the position to seek an elective office.

The court order is invalid by reason of the applicant denying ever going to court to get a renewal...again,a high court in rivers has stripped him of his membership of the nwc therefore he is legally unclad.

In times past,pdp exhibited a high level of lawlessness.a lot of pdp minions are confused on this matter

He will conduct his own primary at Ogbuefi square near Ariaria market in Abba. Supleme Dilector Nnamdi Cownu will be the returning officer

You can actually agree or disagree without throwing manner to the wind, friend!

According to Article 31(1)(iii) of APC's Constitution, "All nominations into elective offices shall be supported by a specified number of nominations from the RELEVANT CONSTITUENCIES, as may be prescribed or provided for in the Party's Electoral Guidelines".

The foundation of all anyone wants to become within any political party starts from local constituency. He or she must first be nominated by their constituents before they can stand any chance of being elected into any office within the Party or in a general election. That's why the process for the suspension of Adams Oshiomole as Party Chairman could be started from his constituency.

In fact, Giadom did not only represent Rivers State in the NWC, his being there had a lot to do with the interest of his Zone, South South, within the party hierachy.

What do you think is the reason why Ekiti State chapter of the APC went to court to contest the position of Ajimobi as the Deputy National Chairman (South) in the NWC? It's because the man that vacated the position to become a Minister, Mr Adeniyi Adebayo, is from Ekiti State. And so, they felt it is unfair not to have been allowed to nominate another person from the State.

A critical look at the oluwole court paper, exparte is 7days in law, the first one was in 16th of march by extension of two weeks it will be 30th of march meaning it is has expired already.
