Bayelsa Governorship Election Tribunal Reserves Judgment by garfield1: 11:28am On Jul 22, 2020
The Bayelsa state governorship election petition tribunal sitting in Abuja has reserved judgement in all the five election petitions filled before it in respect of the November 16, 2019 election in the state.

The chairman of the tribunal, Justice Muhammed Sirajo had earlier dismissed five other petitions in respect of the election for lacking in merit.

The remaining petitioners are Ebiziomo Diriyai, Vijah Opuama, the Advanced Nigeria Democratic Party ANDP, Ibieme Stephen and Owei Woniwei.

Some of the petitioners are challenging the election on the grounds that Governor Douye Diri and his deputy, Lawrence Ewhrudjakpo were not qualified to contest the election, having submitted forged certificates and false information to the Independent National Electoral Commission (INEC).

Justice Sirajo announced at the end of proceedings on Monday that the day for the judgment will be communicated to the parties.

The issue at stake here is that of forgery and claiming of certificate(s)that the petitioners aledged does not belong to Lawrence Ewrudjakpo.
The case of Opuama and co will come to nought and of no consequences on the ground that the issuing authority of Rivers State University and NYSC have come out in support of the Deputy Governor case.
Secondly, the issue of time is also of importance here am of the opinion that the tribunal has exceeded it's TIME LIMIT therefore it's decision is of no effect.

Lol.....statute barred case already. It has exceeded more than 180 days already, hence the case shall be thrown away on the ground of statue barred. Diri's mandate is divine grin cheesy

For everyone, that have missed, or do not have details of all that have transpired so far, in the matter between Vijah Opuama vs INEC & 3 others at the Bayelsa State Governorship Election Petition Tribunal, all you need to know, are highlighted here.




At the last sitting, where all written addresses were adopted, Chukwuma-machukwu Ume, SAN (Counsel to the Deputy Governor of Bayelsa State) said:

''Lawrence Ewhrudjakpo is a spare part who did not have any vote at the election; and, by virtue of Section 31 of the Electoral Act, 2010, no petition can be filed against a Deputy Governor''.

My opinion here is: This petition, is similar to the Case that led to the sack of Chief David Lyon (the then, Governor-elect of Bayelsa State), where, his deputy was alleged to have multiple and conflicting names on his credentials. So, LAWRENCE EWRUDJAKPO, is a spare part, as alleged by his SAN, who is then, Sen. Biobarakumo Degi-eremieyo, that was alleged to have multiple and conflicting names on his credentials?

However, P. D. Pius, Esq., (The lead counsel to the Petitioner, Vijah Inowei Eldred Opuama) counters:

''My Lord, I commend Section 285(2) of the Constitution, to this Honourable Tribunal, which provides that, the Tribunal is established to hear petition; whether the office of the Governor or Deputy Governor has been validly occupied''.

TRIBUNAL TO Chukwuma-Machukwu Ume, SAN (Counsel to the Deputy Governor):

"Stop playing to the gallery. You are taking this court for political arena. We are concerned with Certificate Forgery here''.

Furthermore, the DSS, confirms that, the name of the person who owns the certificate is, (EwhruOjakpA Lawrence O. E.), who is a different person from (EwhruDjakpO Lawrence O.)

And that, EwhruOjakpA Lawrence O. E., whose name is in the Rivers State Masters List for Prospective Corp Members, is from Rivers state; while, EwhruDjakpO Lawrence O., is from Bayelsa state.

It was also confirmed by the DSS that, the NYSC certificate with the name Ewhrudjakpo Lawrence O., who hails from Bayelsa state, does not have NSPM at the bottom of the Certificate; while, the one issued to EwhruOjakpA Lawrence E. O., who is from Rivers State, has NSPM written at the bottom of the certificate.

On the Witness' statement on oath of the Registrar, from Rivers State University of Science and Technology: he tried to smuggle, before the court struck out; as counsel to Vijah Opuama vehemently opposed the statement of the Registrar.



Meanwhile, NYSC says they are not in court with the documents, Ewhurdjakpo Lawrence O. is asking for; as, Ewhrudjakpo Lawrence's lawyer dispensed with the witness.

In addition, Ewhrudjakpo Lawrence, sought to tender documents with fresh correction fluid on it, through the Registrar of the Rivers State University; as, counsel to Vijah Opuama draws the Court's attention to it, so that, it will not be blamed on the court.

The SC held in Degi case that inconsistency in name is a serious matter even if it is supported by affividavits..The view of the SC is that deliberate irregularity in names can be backed up by fraudulent affidavit.This is a strong precedence against anybody in this shoes.The embattled deputy governor may have to answer for his irregularity and as it is argued before the tribunal ,and in view of the precedence of the SC ,he may be another Degi in Nigeria.

So, in order not to repeat the same thing over and over again..now is the time to sit and wait until it gets to the SC.

You are right,as much as the Lyon case was painful,the apex court made sense. With just 500 naira,one can purchase or procure affidavits at will and at any time.this is very dangerous.they seek to therefore tighten or remedy that loophole
