The bill is okay, except the aspect where it seeks to give the Attorney General the power to cancel an ongoing legal case being prosecuted by the EFCC.

Malami is part of the the problem.He wants it in his own way.Why on earth should you seek a bill to kill all matters in Court and yet Malami is a Bar member-a Member of Nigerian Judicial System! That is why average Nigerians don't want to go to Courts again.What they are seeking is that nobody can take to Court,but why?
Na Wao! As at now,even the Presidency had not asked-What was the problem between Magu's Office and Malami,because Magu was supposed to be reporting to Malami,then why all this self-created problem? Is is about superiority or about selfish personal interest or about Nigeria Interest? Nigerians should just know that whatever that is going on in Nigeria shall come and go with time!

People like you are always blind to see any positive in another person's efforts. So you are okay with the current arrangement of the EFCC where it is functioning without a Board? Or where the EFCC chairman functions without a check?

The only thing I see wrong with this proposal is the power it seeks to give the Attorney General to cancel an ongoing case being prosecuted by the EFCC. Because such power if granted, can make the Attorney general to cancel cases or allow cases to go on based on political interest.

Other members of the board shall include the director-general, a representative of the Federal Ministry of Justice, a representative of the Central Bank of Nigeria, the Director of Nigerian Financial Intelligence Unit, two other Nigerians with 15 years cognate experience in legal, finance, banking or forensic auditing and the Director of Administration who shall be the secretary of the board.

This part is the part where the crooks can now control and have knowledge of what the EFCC is doing.

They can stop its investigations or warn their friends on how investigations against them is going.

The EFCC would be answerable to the crooks they are investigating, no more answerable to Nigerians through the President.

It will just become like any other Nigerian institution with a Board: Inefficient and Crooked!

NNPC, NTA, NMA, NCAA etc.

MALAMI BARES HIS FANGS IN THE POLITICAL POWER PLAY

The intent of Malami to sponsor this bill is is to practically demonstration who is the top dog in the the battle of supremacy between him and Magu. He seeks to be the de facto head of the commission. The proposed Chairman/Director General would be mere pawns in his hands.
In his desperate attempt to teach Magu a bitter lesson, he now seeks to whittle down the powers of the commission in an administration that chants the mantra of anti-corruption.
The EFCC should rather be strengthened and made more independent. The damage caused with the ignoble manner of removal from office of Magu is monumental. It is a dent on the image of the commission. The Chairman/Director General should be made to report only to the President or His Vice. The office of the AGF is by appointment and not by election. For him to arrogate such powers to himself in the proposed bill must be resisted by all and sundry!

All these bills these people in top position are creating just because of positional vested interest,
Very soon there will be legal summersault on almost every matter that is supposed to be a straight forward resolution.
Even lawyers will be getting confused. Just ask INEC.
Elections which needs resolution is now a problem in itself.

However, let EFCC be one of the fair and objective lead agencies in the investigation of economic and financial crimes.

It should be seen as prosecutorial not persecuting law enforcement agent of government.

According to the proposed law, the director-general will be appointed by the President based on the recommendation of the AGF and subject to confirmation by the Senate.
The director-general, and not the chairman, will be in charge of the running of the daily affairs of the commission.


A person shall not be appointed as a director-general unless he is of proven integrity and has 15 years cognate experience in security, forensic or financial crimes investigation; forensic accounting or auditing; or law practice or enforcement relating to economic and financial crimes or anti-corruption.


The director-general, according to the proposed law, shall hold office for a period of four years subject to reappointment by the President for a further term of four years and no more.


Anything for the progress and development of our darling nation is all we are after.

It is always good to decentralise power, create checks and balances in every public office setting...watch the watcher, this is what the CIA, FBI etc...mainly does for America and countries getting it right. We must create independent watch dogs, that are incoporated in our constitution to help the public scrutinize politicians and public office holders. We all know that everything in this climes is political, hence we meet checkmate these politicians and their cronies otherwise na the people go suffer am.

We must shun mediocrity and prioritize meritocracy, otherwise this country will continue to deteriorate.

That would be terrible and a set back for anti corruption where the so much power is concentrated in the hands of the AFG who can single handedly manipulate the fight and undo corruption cases.

At best troublesome/faulty cases in the opinion of the AGF should be thrashed out in periodic special meetings (e.g. monthly) between technical teams from the two bodies (office of the AGF and EFCC) to review the merits or demerits of such cases; and on conclusion make final recommendation to the AGF to terminate or continue such cases upon approval of the president or VP (as may be delegated).

At the end of the day the EFCC must as much as possible be allowed to operate almost independently with only a few checks and balances including some of those mentioned above.

We are saying the same thing. The power it seeks for the attorney general will weaken the agency. They should have just seek for the board which would have strengthened the agency without the clause involving AGF. On carefully looking at the bill, it is the AGF that wants more power, he smartly added the board creation to cover up the real intent. What will the board achieve when the AGF can easily override every organ of the agency.
Be smart, look beyond the cover.

You talk as if you don't know this AGF will leave office in less than 3years from now. So I don't think it's all about him. I still maintain, if they remove only that clause, the bill is very okay.

The Board creation is actually what will make the EFCC more strong. Also the fact that the office of the Director general was not restricted to the police or ex-service men, but was expanded to include forensic Accountants, forensic Auditors and other experts.

The bill, it was learnt, is being put together by the Attorney General, Abubakar Malami (SAN), on behalf of the Federal Government for onward transmission to the National Assembly.

I totally support this. The chairmanship of the EFCC is just limited to the police and only the rank of assistant commissioner. Just imagine an assistant commissioner will now be rubbing shoulders with the IG of police.
People who have served and retired, and have proven integrity, who are not out to please anyone nor scared to step on any foot e.g Hameed Ali and this former Kano CP are those who should occupy such positions.

What's special about Hammed Ali that makes him most qualified for EFCCs top job?
