BREAKING NEWS... Its Now Official... The AA case at S'COURT that started on 26th/06/2020 has finally come to an end today 29th/06/2020, even though they're no longer interested in the suit. The Supreme court nullified Uche Nwosu nomination in AA on the account that he had contested for nomination under APC. The spirit of the law forbids anyone to contest for nomination under two or more parties in same election or even started the process of being nominated by procuring the nomination form. Obaseki has contested for nomination under APC and PDP in this same Edo 2020 Gubernatorial Election. He is technically on OFFSIDE! In line with Supreme court judgment and interpretation of contest of primary election in a political party according to electoral law: 1. When an aspirant obtain an expression of interest form and paid the fees as required by the party. 2. When an aspirant obtain the party nomination form and pay the required fees by the party. 3. When the aspirant submit himself or herself to the authority of the party for screening and other processes thereafter, the aspirant is deemed to have contested in that political party and therefore not eligible to contest same election in another political party. Governor Obaseki has contested Edo State Governorship election in APC and was disqualified. In the eyes of the law he is no longer eligible to contest the same election in any political platform. garfield1:APC conducted a primary election, Nwosu participated and won. The National leadership over-ruled and said Uzodinma won. Just like what is happening to Cross-River North bye-elections. Nwosu went on to get an ex-parte from FCT High Court under the late Justice Valentine Ashi that he is the duly-nominated candidate of the APC and the National leadership should not send any other name. When his name wasn't submitted, he defected to AA and got their nomination. The FHC in Abuja said: 1. He swore on oath that he was the candidate of the APC hence in the eyes of the law, Nwosu should be the candidate of the APC & the SC upheld it. 2. He never resigned before defection. In the case of Obaseki; He didn't participate in any Primary of the APC. He didn't take any oath that he was the candidate. He resigned before defection. 1 Like |

OP, please before you post something like this again, you should first of all know that an issue like this is a pre-election matter and there is a time frame within which to institute an action in court against Obaseki and his party, PDP based on that issue. The issue of nomination you are talking about took place about three (3) months ago, while the election in which Obaseki emerged a winner took place on 19th September, 2020. So, if no action is instituted against Obaseki and PDP based on that issue within the time frame allowed by law, the action will be statute barred forever. Given the above, now answer these questions: (1) What is the time frame within which to institute the action in court, bearing in mind that it is a pre-election matter? (2) Has there ever been any action instituted against Obaseki and PDP on that issue of nomination ever since after he was nominated? (3) If No. 2 above is yes, was the action instituted within the time frame allowed by law? Please answer the above questions before I know what next to say. I am waiting for your response. 1 Like |

slivertongue:That case is contestable because the APC National leadership stood with the EXCO that produced Uzodinma. Nwosu was desperate because his fear was that...if he takes it to Court, he might win but APC will have no candidate. |
