You guys should consider the consequences of what you say here. If you want MBA to survive, don't encourage anyone to file a suit against MBA. Don't try it or all of you would suffer it. The court would grant an injunction which would direct that all MBA's bank accounts be frozen. All funds would then be unaccessible and that would affect everyone. 8 Likes 1 Share |

Whatever happens, no injunction should come near MBA accounts. Even if it would be lifted, it can take 6months. Can MBA survive with its accounts frozen for 6 months? Wickedfact: No genuine investor either here or off-line who eats from MBA will file a suit against MBA for the court to freeze the company's accounts. MBA as far as am concerned has not declared bankruptcy and will never go down as long as the forex market still remains. But whatever the case may be, I believe MBA has the capacity and well qualified lawyers to crush any disgruntled miscreant either on this thread or off-line. Wickedfact: Doesn't even need personal journey through the courts. Complaints to the SEC will trigger the necessary regulatory moves against this unregulated entity, yes, including bank account freezes. As an 'investor', this is how to kill the goose if you're getting jittery and your ROI held up but at least any money in the accounts will be preserved. DrAkpa: If an account is to be frozen, it is done through Exparte Court orders. Before MBA has an opportunity to respond, it would take at least a week. Once response has been filed, the court fixes a date to hear it. That is another 3 weeks. Plus at least 2 adjournments, that is minimum of an extra 1 month. Which financial organisation can survive with its accounts frozen for 2 months? That is why litigation against MBA should be prevented at all costs. It would destroy things. 3 Likes 1 Share |

jabolo:I believe MBA has persons in SEC. If not, SEC would have done this a long time ago. Besides, if SEC wants to do this, MBA can know beforehand. Unlike SEC, an ordinary Magistrate Court in Birnin Kebbi or Nkalagu can freeze MBA's accounts and it would be done. It is very valid and MBA won't see it coming. Wickedfact: Well, litigants have to have adequate facts and points on ground before any court can agree to freeze mba account. If this is how easy it is to freeze a company account, then most Nigerian companies would have been shut down because most are debtors. A lot of this people here threatening court case haven't even read their contracts properly. Arguing with them is just like arguing with primary school pupils. These same miscreants threatening a court case against mba probably didn't comprehend or understand the clause in their contract which states that conflicts between them and the company would have to go through an arbitration process first and if not resolved, the courts will have the final say. DrAkpa: The Contract is a civil one and the Arbitration clause only applies to civil matters. If a criminal matter arises, that clause is very useless and doesn't mean anything. That is the difference between Breach of contract, Fraud and OBT. Once you report a case of fraud or financial crime to the Police, the police can approach a Magistrate court for an order freezing all bank accounts belonging to that company. Once the order is granted, the banks are compelled to comply. The Police and the courts don't even give the company an opportunity to reply because the complaint is a criminal matter of fraud and informing the company would prejudice their investigations. So, the company doesn't know until they go to the bank and they can't collect 1 kobo. Even the bank won't know until they get the court order and they must comply immediately. After bringing your facts and information, the Court may eventually lift the order, but after how many months? Can you wait for 5 or 8 or 13 months for the account to be unfrozen before collecting your money? Sensible investors avoid litigation. Only ignorant ones see litigation and jump into it. You guys should take a chill pill on all this talk of lawyer, court, sec etc. If old investors who have recovered their capital are talking like this, what do u want new investors like myself who invested heavily to do? The mgt of the company has addressed investors and taken time to explain things. Please lets give them benefit of doubt for atleast the 1 month window they said (or 7 to 14 days from due date). Dont plan with November ROI so as to avoid unnecessary apprehension/panic. Baba has said they will extend the contract just in case the ROI does not come in this month. Abeg make una chill...
