An Ekiti State High Court sitting in Ado-Ekiti, the state capital, has sentenced an Assistant Commissioner of Police, Okubo Aboye, to life imprisonment for buying stolen vehicle from kidnappers in the state.

The court on Monday also sentenced seven other persons, Solomon Ayodele Obamoyegun (39), Femi Omiawe (40), Damilola Obamoyegun (20), Bose Sade Ajayi (30), George Lucky (35), Chukwuma Nnamani (22) and Sunday Ogunleye (45) to five years imprisonment each without an option of fine for kidnapping.

In their testimony, the investigating police officers said the car was tracked down to the compound of ACP Okubo who on interrogation confessed that he bought the vehicle from his mechanic who received it from the kidnappers.

The Prosecutor, Felix Awoniyi, revealed that “the offence runs contrary to sections 346(2), 1(2)a, and Section 5 of the Criminal Code Cap C16 laws of Ekiti State, 2012 and Robbery and Firearms Special Provisions Act, Cap R11, Laws of the Federation of Nigeria, 2004.”

In his judgement, Justice John Adeyeye found the ACP guilty and sentenced him to life imprisonment accordingly.

“I found you guilty of receiving stolen vehicle. All evidence pointed to the fact that you were aware that the car was stolen. You are hereby sentenced to life imprisonment for the offence,” he said.

To prove the kidnapping case, the prosecutor called seven witnesses while exhibits tendered included statements of the accused persons and bond to release the vehicle to the owner.

The punishment is too harsh! Compare it with the actual kidnappers' punishment.. the law never stipulated a different punishment for senior police officers. Even if the judge wants to punish him harshly a sentence of 10 - 15 years is enough. The actual kidnappers are the ones deserving of life Imprisonment or even death!
p.s. the law presumes you know it's a stolen vehicle if it is too cheap. In some cases buyer's of stolen property may actually not have known but will be presumed to have known

are you surprised? based on experience they have Intel about most of the committed crimes, even when and how they would happen, some even participate in them.

They know most of the criminal groups and kingpins but for some reason they decided not to apprehend them all, they usually give them a long rope to see if they'll change, make a grievous mistake or cross the line!

He did not aid and abet kidnapping. His mechanic sold the stolen car to him after the kidnapping. To aid and abet he must have had a hand, contributed or assisted in the actual kidnapping itself.

I agree. The kidnappers should have gotten heavier sentences. But the other guy was a police officer.

The law ought to be heavier on the errant custodian of the law and it has rightly so been served. A deterrent is always welcome.

The Police man deserves a heavy punishment because as an enforcer of the law, he should not be seen or heard to be aiding and abetting criminals; but life imprisonment is unfair. I think 20 years imprisonment would have been okay.
However, the kidnappers should have received more heavy sentences too, like 15 to 20 years imprisonment, to act as a deterrent to other criminally minded people.

I don’t know about other states but Lagos states punishment for kidnappers is death, as it should be in every other state.

Yes the law should be very strict on those who enforce the law. Many actual criminals are apply for police jobs because it’s a legal license to commit crime. I applaud the sentence so much.

The judge is crazy. He needs to have his head examined. You sentence a reciever of stolen goods to life imprisonment while kidnappers get no more than 5years in jail. It calls to question the process of admitting persons to the Bench not only in Ekiti but in Nigeria

He was aware the car was stolen.The car wasnt just stolen, it was stolen during a kidnapping operation.By buying the car ,he was encouraging (aiding ) kidnapping.I know of somebody who connived with armed robbers to rob the filing station where he was working.He too hot death penalty alongside the armed robbers.The judge said that for him to know how to contract armed robbers ,he too was a robber as well.Its the same thing in this case.

Nah I think this is a good precedent and it definitely should be law. If we can’t keep our law enforcers grounded and humble, we will never have a good country. I commend this judge for his decision.
