Hi Cutefinger,

Sure you can PM my hotmail handle - but nairalanders appreciate an open forum of discussion, at least that way we can get everyone's input.

Hi cutefinger, the body of mail to be sent to the secretary of state (HER MAJESTY) should sufficiently explain your predicament, as members of the parliament would have to categorise the degree of your immigration gaffe. I am unable to adivce extensively, as i cannot do that in isolation of the scope of your previous application and the standard of evidence obtained to decide your removal order conclusively. A professional lawyer may be able to present your case logically, which MAY earn you the Secretary of States overriding discretional consideration outside the deportation/removal rules.

Secretary of State's E-mail: info@dcsf.gsi.gov.uk

Hi Cutefinger,

It is correct that applications are treated on their individual merit, but be mindful of a contradicting clause, stating that an ECO may refuse an entry base on previous applications or immigration history - to a large extent, you have erred in that. Unfortunately, the immigration officers that removed you from the Uk were steps ahead of you, keeping in mind the guiding principle of removal. One of the bullet points in refusal direction states that, "It is not necessary to delay the serving of removal directions, even if the passenger states his intention of exercising his right of appeal before removal. Once he has appealed, however, any removal directions must be deferred pending the appeal.

Let me set a case before you, that demonstrates the strenght the brits have placed so much on policies. A guy was refused a visa extension and later removed from the UK because he failed to show the financial requirement of 1600 pounds by 20 pounds less.

I hate to break your heart, UK is governed by rules that are required to be kept to the last letter; as it were, the only person that can remove a deportation or removal notice is the Secretary of state. I will advice you write the secretary of state directly, explaining your ordeal and seek for leniency before making further applications. O le fi owo ba won sere (you fit use money play with them), by putting in a fresh application, and be as truthful regards your removal from UK, lets see how far that will go - I have read worst cases that later merited the ECO visa stamp. Just give it a try, we dey kampe with you - if you require further info, do not hesitate to ask and please publish the outcome of your next application on Nairaland. Cheers

Considering your reason for refusal, give or take your previous application WILL NEVER have any adverse effects on subsequent applications. You havent violated any section of the immigration law by seeking admission from a school that is not listed on PBS licensed sponsor register.

I honestly dont believe in court representation when it comes to visa appeal procedures. If you have a genuine case and can show by documented evidence that their has been a miscarriage of justice in the handling of your visa application, why battling with a physical representation in court. Nigerians should understand that visa refusal is not a murder case and at such should not be given an unworthy spectacle. You have turned in a paper application alongside credentials at BHC, and a decision was reached without a need to interview you, I would then sensibly assume the Judge at AIT should act accordingly in the same manner. 90% of appeal cases have been favourably treated without a resort to any formal court appearances. Thats my two cent, but under the circumstance that it becomes imperative that your sister appears in court, then you may also want to start considering the inevitable family tie with your sister based in the UK, which ofcourse may demonstrate an intent to stay back at the completion of your course in the UK.
Career / Re: After Your Msc Abroad: Stay Or Go? by royalboy(m): 2:13pm On Jan 02, 2009
As a matter of fact, in the past the world's greatest employers were biased in recruiting; laying so much emphasis on credentials rather than experience and performance. Acquiring a degree abroad may be the peak of a person's career, the downside is lack of experience in your core career progression. You definitely will be a good hire if you can commensurate your certificates with a minimum of 2 years work experience and proper knowledge of job aptitude tests. Your past and present work experience are significantly responsible in a job recruitment for a singular reason of some companies not having any or enough budgets on staff trainings, learning and development. A company running a tight budget may not even entertain the spectacle of a foreign degree holder with no work experience. Etisalat was fast in making some juicy offers to industry based employees, which attracted some of the best brains in Glo, MTNN and other multinational companies; Staff training budget was diverted to salary budget. This is my breakdown; a logical career progression + work experience abroad=good job in Nigeria.(Higher level staff)
a logical career path - work experience abroad=a job in Nigeria. (Entry level staff).
Employers should be able to distinguish academic excellence and job skills between a foreign degree holder and a national degree holder.
Family / Re: Her Husband Wants Her Back Home! by royalboy(m): 12:01pm On Nov 20, 2008
Dear Poster,
All comments on this issue have shown a balance of ideas except the poster who sees marriage as a little celebration of a collection of people, rather than an event where marriage vows and creeds are established; and I find it so hard to know where the pendulum swings right now.
I read this post with thorougness and sorrowful emotion, and immediately put myself on the stance of a father, mother and child who are the direct recipients of the repercussion of a hasty decision taken today.
My advice is this; Your friend's husband is not selfish and blind to the reality of a challenging Nigeria's economy, he has only solicited for a simple permanent family reuinion, which of course demonstrates his loyalty in the marriage vows he took years ago. The citizenship status is not a ticket to a happy married life, what i'd acknowledge as a blissful marriage is a bonded entity of father, mother and children who grimace at every life's slingshot of possible seperation. A lot of folks in my company SACRIFICED their jobs to attend to family issues or turned down a better job relocation placement. Your friend's family tie is presently strained and may suffer an irremediable breakage soon. I assume your friend is a professional who can be hired as a mid-level or high-level staff; I therefore advice she seeks for an employment by attending any of the recruitment exhibitions in the UK/Ireland for jobs in Nigeria (if I can correctly remember there was one held in hackney), where her certificates can be verified and an interview conducted.
My dear Ayomifull, you have posted this thread with the wrong tone, which explains the counter reactions by nairalanders who honestly would have given their reasonable advice not as vengeful jury but logical panel. You want to ask me why? good" a major fraction of posters want the head of your friend's husband in a plate for the singular reason of joblessness, whatever happens to holiness, faithfulness, truthfulness as some of the qualities of this gentleman.
I remember my brother's C.E.O once said and I quote "I have danced Awilo in the UK for 16 yrs with no pounds in my pockets" only to return home and find a rythmic blues leaving plenty of nairas in my pocket" by and large, I am in no doubt of United Kingdom's leadership as a global education provider because of an increasing recognition of her degrees internationally; but I will be quick to summarily say UK's economy is not the most buoyant in the world with the rates in taxes; I stand to be corrected though. My questions are; why are Americans asking for a tax cut? and why do they need as much as 700 billion dollars as an emergency bail out package to ease a financial crisis. Uk itself is not a goldmine, it only prepares you for opportunities, look inward and discover the windows of opportunities in Nigeria.
Tell your friend to dust her passport and hit the next plane back to Nigeria because the roof is leaking. HUSBAND NEEDS HER, CHILD NEEDS HER.
Jobs/Vacancies / Re: My Embarrassing Interview Situations You Need To Learn From by royalboy(m): 9:45am On Nov 18, 2008
Just so we dont stay out of track on this thread, i'd like to reiterate the poster's submission on lessons to be learnt from his embarassing job interviews.
Rule number 1; during a job interview, learn to be engrossed with the thought of past work experiences or academic qualifications as the case may be; all these propel or demonstrate your drive and spirit of your technical skills and ability to fit in your prospective employment, rather than focus your thought on salary or benefits, since the employer would bring this up at the end of the interviewing process when they are making an offer.
Rule number 2; To address your misguided dress sense; dress for the occupation; wear to the interview what you would wear on the job. You may even want to dress one step above that depending on the position. If you are still unsure, visit the organization and observe what others in similar positions are wearing, but be careful not to overdress and especially not to out dress the person interviewing you. Do you remember that saying of first impression counts.
I guess I have dealt with specific areas of concern of the poster, and may of course feel obligated to address other job interview issues when I find time. I am not an H&R expert, but God help my recollection I am going to be analyzing my past job interviews and those of my colleagues.

@busy body
When you say your grievance is with the acquisition of forged tax certificate, are you displeased with Mr Viv who acquired it by conjuring up some hocus-pocus and mumbo-jumbo or is your displeasure geared at the lady who mistakenly and innocently ended up at Mr Viv's house because she honestly thought the tax office was located in his backyard

Why stop at the acquisition of a forged tax certificate only, why not go the whole hog and finger the fraudulent tax people who issued it and the people who failed to obey the law and pay tax in the first place, Mr Fair-is-fair.

If you don't care what my opinions are, why are you worrying your silly head by replying me? FYI, I don't give two figs about your opinion either

Another thing, Mr I-am-a-Social-Worker-whose-comprehension-of-English-Language-is-not-deficit, as a Social Worker, shouldn't your duty be towards campaigning and safeguarding the welfare of those vulnerable children in African whom are being accused of being witches and wizards, and are being matcheted and burnt alive. . . perhaps you intended to say you were a Law Enforcement Officer but your keyboard jammed and. . .

somebody really needs to do a proper background check on you; suffice (it) to say you have a fundamental problem, unfortunately this is not a good place to seek help by whipping up people's anger with your incoherent outburst. You have said nothing and I see nothing in your disjointed posts and such apparent lack of manner and respect  demonstrate a low self-esteem woman whose location reads and I quote 'FIVE MINUTES FROM YABA LEFT, which ofcourse sums up your erratic behaviour. I'd rather direct the resource meant for the welfare of  abused and battered vulnerable african children to a blithering idiot whose posts show how much quality help she needs.

Where are you going with your investigation? It is clearly obvious you have a vendetta against Vivikoko, so why don't you hook up with Royalboy and carry yourself over to the grievance and rants section to sort it out, in your bid to clear Nigeria of corrupt tax officers at FIRS and the Lagos State tax office, who issue falsified documents for a fee, and the likes of Vivikoko, and the OP's parent who are clearly getting away with not paying tax, and the OP for patronising outside third-party to secure genuine document and whomever else you might take a fancy to

Whilst you are at it, here are some hypothetical mullings for you and your crew to chew over, whilst you gather the necessary paperwork needed for EFCC to apprehend him.

Hi Busy body,
I empathise with your comprehension deficit, just how much of my comments you dont understand. I chose my words with care and precision on Yetti's case, and obviously made it clear to all and sundry my grievance in the acquisition of a forged tax clearance and the urgent need to overhaul OUR prestigious website; unfortunately your rebound on this has not only shown an endorsement of illegality but also an unnecessary sloppiness. As a matter of fact, what moral justification has anyone to support such an unlawful issuance of tax certificate. I still pledge my allegiance as a social worker to help backtrack the missing principles and ethics of a true federalism and I care less of what your opinions are. Go fix your attitude and stop over-shooting the run way. 'Fair is fair".

Not minding the punnitive damage done to your first application, A re-application may be a good approach. I assume a deferment of your course till the end of october means 31st of october. This undisputedly will afford BHC to do a proper vetting of your docs by their document verification department. I will strongly advice you write a letter of redress with your application since a file has been opened for you that contains your document verification report, otherwise you may be hit with another hammer of the UK immigration law on your desperation to migrate under surreptitious motives.

OMG,
I dedicated part of my time at work on thursday morning praying for Yetti after a pre-knowledge of her intention to storm V.I for her visa package that has generated series of questions on every page of this visa appeal thread, unfortunately I wasnt forewarned of her purport to acquire a tax clearance. Suffice (it) to say that I am grieved at the outcome of her visa application, but my grieviance is not aimed at Yetti's unsolicited ignorance, but the endorsement this singular criminal act attracts from supposed Nairalnders of honour, who shower praises on vikiviki or is it faka fiki. Dear fellow Nairalanders its time we did some serious house cleaning, to accomplish that we may have to dirty our hands a bit by helping Yetti out of this mess. First, so much time and resource have been invested in hoisting this indigenous website with the intent of portraying Nigeria as a global community striving to catch up with the technological and economical pace of the world; while creating rich avenue to fertilize ideas and explore prime opportunities available in the country. Let us do away with outright exhibitions of illegality already displayed by some posts, and deny minors visiting this web activities of MR TAX CLEARANCE.
Secondly, I empathize with Yetti and strongly suggest she seeks a deferral letter from her institution till January, and do a proper re-package with much credence to her tax clearance. I have seen and heard worst cases that were later correctly re-presented and earned the visa entry clearance stamp of the E.C.O.
Vikiviki has done a great disservice to this site and ofcourse those whose posts suggest any justification. I am prepared to join the crusaders whose primary aim is to improve the public image of this prestigious web site. I stand up in recognition of londoncool, for his wealth of knowledge and I will never forgive myself without saying "Funkybaby is intelligent".
I drop my key-board to pick my broom, the cleaning starts NOOOOOOOOOW.

Now my problem is what to do next having found out that I truly submitted a fake document without me knowing it is fake. The results are the same on both certificates and if I wanted to forge a certificate, I would have improved on my results. I even have my GCE results from nov/dec 1997 but I do not use it because I am of the belief that May/ June looks more presentable.
Please advice me as soon as possible.

Hi TheBest,
The only weapon you have left with you is to prove motives, unfortunately that weapon seems to be distorted as a result of the 10yr ban clause.
UK immigration law says that it is up to you to satisfy the visa officer that you qualify for a visa, so BHC aim to make a decision on your application without interviewing you based on a completed application form and supporting documents. Write a letter of reconciliation addressed to the Deputy Consular General, copy the Director and Manager Entry Clearance Office British High Commission, stating clearly in your letter a high profile admittance of the said committed offence. Avoid putting through a fresh application for now, as you are currently been banned, and no entry clearnce officer would dedicate any time in handling a visa application with a banned status. Remember to include contact details in your letter as you might be called for an interview on compassionate ground.

Hello all,
Please I applied for UK student visa but I was refused stating that my waec certificate is fake. that is the only reason given. i got the result from waec office and the result is the same as my result online but the problem now is that i went bck to my school to find out what was wrong but i was told that my certificate was there which was then released to me. it now means that the one collected from waec office is fake and the new one from my school is original and i have 2 weeks to resume. my finances are ok but i have been banned because i submitted a false document. what is the way out now all please? can i go in for a review and tell them the truth
or i should just appeal or forget about this whole matter? my results are the same on the 2 certificates and online and i also have my gce result/ certificate. pleaease advice me.

Hi TheBest,
I am appalled at the intent of your question and do not find any merit in its outlay, I am mindful that you have presented your certificate from waec office, but would appreciate further clarifications as to HOW, WHERE and WHO issued you the certificate. Their is a telegraphic print or a magnetic strip on the waec certificate that could easily show any falsifications or alterations when swiped on BHC's device. Critrically considering your conclusion on the certificate presumably issued from waec office, I am very positive that you have presented a cloned waec certificate.
To address your ordeal, the onus of validation of your waec certificate now rest on you squarely. You might want to consider writing a letter to waec head office Yaba, requesting that a confirmation of your waec result be sent directly to BHC. I think that may cost 3,500 through DHL. Re-package your visa bundle with a letter of reconsideration and remember to include with your application the waec certificate issued to you from the school, also stating in the student questionaire that you have been refused student entry visa and possibly stating why and when.
If indeed you have presented a forged certificate to BHC and thereafter sought the help of nairalanders on this thread, What it does mean is that you come back and apologise to us all.

Hi Mr Lekki, I really did not find it appropriate to reply ur post, unfortunately I am compelled to do so. There are just two things you have to work on to earn people's friendship. You wouldnt mind considering lowering your aggressiveness, would you?, secondly, your bad manner has to go. Nairalanders are Nigeria's young professionals, ofcourse i doubt if you fit in. I've had the priviledge and honour of speaking with Nairalanders in diaspora and I bet they will feel so insulted reading your mannerless posts. Upon fixing your bad manners, Nairalanders would appreciate it if you could come back and apologise to MTN Nigeria on this thread. I want to believe this thread has a moderator, I would suggest we cyber warn him by putting on hold his handle for 3 months.
Travel / Re: Uk Visa - Visa Appeal Process by royalboy(m): 3:04am On Sep 14, 2008
Yellow Nairalanders,
I have a friend whose student visa was placed on an appeal for the singular reason of not including his original waec certificate with his visa application. I find it hard to believe that WAEC has instructed BHC to disregard statement of results, especially when the applicant has included an online verification scratch card. WAEC's policy of not preparing certificates of a three year examination history is infact not in line with the option of verifying such results at the council's portal website. A visa application that was demerited based on that ground as absolutely shown the inefficiency of an Entry Clearance Officer, who find enough time preparing an epistle copy and paste decision rather than redirect such time and effort in logging on to WAEC's portal website to verify an applicant's result.
I have read virtually all comments on this visa appeal thread, professionally moderated by Mr Pataki, Akolawole and the most intelligent woman(funkybaby), and as a matter of fact, I confer on you OFR (Order of Federal Republic).
I would appreciate your suggestions as to how my friend should proceed on this unfair decision.
