Court Stops Obaseki From Arresting, Prosecuting Oshiomhole

It was a sigh of relief for the National Chairman of the All Progressives Congress, APC, Comrade Adams Oshiomhole on Monday as a Federal High Court in Abuja stopped Edo State Government and Governor Godwin Obaseki from arresting and prosecuting the former Governor.
The court granted an interim injunction restraining Governor Obaseki from arresting and prosecuting Oshiomhole over indictment in a white paper submitted to the State government.

The presiding judge, Justice Ahmed Mohammed, in a ruling, said the restraining order should subsist, pending the determination of whether or not the Federal High Court has jurisdiction to hear the suit filed by Oshiomhole seeking to stop his prosecution.

In a white paper, Oshiomhole was indicted for corruption by a panel of inquiry set up by Governor Obaseki and headed by Justice Oyomire.

The APC National Chairman ran to the court after the panel recommended his arrest and prosecution in the white paper.

Lawyer to the former Labour leader, West Idahosa, prayed the court, via an ex-parte for an order restraining the respondents.

Inspector-General of Police, the Attorney-General and Commissioner of Justice of Edo State, Justice J. Oyomire, and the Department of State Services (DSS) were also listed as respondents in the case.

Lawyer to the Edo Government Alex Ejeiseme (SAN) had challenged the court jurisdiction and sought to stop the ex-parte order from being granted in a motion of preliminary objection he brought before the court.

Justice Mohammed, after listening to arguments by lawyers to parties in the case, ordered the respondents to stay action, as it relates to the subject of the case, pending the determination of whether or not the court has jurisdiction.

The judge said:

‘’An interim order is hereby made restraining the prosecution of the applicant pursuant to the report submitted to the 1st to 3rd respondents or any white paper, pending the determination of the issue of jurisdiction raised in the 1st to 4th respondents notice preliminary objection.’’

Mohammed further directed the APC Chairman’s lawyer to serve court documents on the case on all the respondents within 48 hours.

The matter was adjourned for further hearing till June 17, 2020.

In January this year, Vice President Yemi Osinbajo visited the National War Museum in Umuahia, to commemorate 50 years since the end of the Nigerian Civil War.
He left some advice to some elders who witnessed the war.

He advised them that as elders, they must make sure that they do not poison the mind of the young.

Lille striker Victor Osimhen has been thrown into mourning after announcing the sudden death of his father.
The Super Eagles star took to social media on Sunday morning to disclose the sad news backed with a broken heart emoji.

Andara Daniel, a National Youth Service Corps (NYSC) member from Bogoro Local Government Area of Bauchi State, has donated his April allowance to Bauchi State Palliative Committee on COVID-19.

Former Edo state governor Adams Oshiomhole might be having some tough time real soon.
As the report of the Justice James Oyomire (rtd)-led judicial commission of inquiry into the Edo State Special Hospital awarded by former Governor Adams Oshiomhole keeps generating mixed reactions, a group, Alliance for Collective Progress, yesterday called on the Economic and Financial Crime Commission (EFCC) to probe the alleged breach of the state’s Public Procurement Law in respect of the project.

The panel, raised in January this year by Governor Godwin Obaseki, had indicted the incumbent National Chairman of the All Progressives Congress (APC) of supposed violation of an extant regulation.

During a protest to the office of anti-graft agency in Benin City, leader of the assembly, Nehemiah Omogiate, said the call had become necessary “following the indictment of the former governor by a judicial commission of Inquiry.”

He added:

“We are here to register our grievances concerning the multi-billion naira Edo Specialist Hospital, a project that President Muhammadu Buhari was ‘deceived’ to inaugurate four years ago.

“We are aware that the panel of inquiry set up by Governor Godwin Obaseki has submitted its report and in the report, the former governor of Edo State, Adams Oshiomhole administration, was indicted.

“Up till now, EFCC has not done anything about it. So, we are here to ask EFCC to act now because no one individual should be bigger than the law.

“That hospital was commissioned four years ago without equipment. We learnt that the report indicted the former governor for mobilizing the contractor with 75 per cent of the contract sum which exceeded the 25 per cent mobilisation fees for contractors.”

The protesters therefore implored the commission to investigate the alleged infraction as it relates to the construction and procurement of equipment for the medical institution in the interest of justice and accountability.



Head of Public Affairs, EFCC Benin Zonal Office, Williams Oseghale, advised the group to submit a written petition for further action. His words:

“I have heard you, and I am going to take your message back to the management. But I advise that you also send us a written petition.

However, the Coalition of Civil Society Organisations for Good Governance and Internal Democracy has labelled the report as “blackmail and lacking merit.”

Briefing journalists yesterday in Benin City, the spokesperson, Solomon Idiogbe, contended that the composition of the investigative committee reflected from the outset “an underhand motive geared towards indicting and demeaning Oshiomhole.”

He added that the constitution of the panel “is not in all intent and purpose in the best interest of the people of Edo State.”

When starting a business, there are hundreds of potential potholes to navigate. I’ve highlighted my top four – not my favourites but the ones I have seen happen most often. Each is easy to avoid.
Don’t accidentally give away control – understand this key thing about how UK companies work
If you only understand one thing about how UK companies operate, it should be this. Very simply speaking, control of a UK company sits first with the board (the directors) and then with the shareholders (the people who own the shares). The shareholders trust that the board will act in their best interests to build a company that hopefully delivers a return. If the board wants the company to take an action, either they have the power to do that thing right away, or it requires a vote to be put to the shareholders (known as a resolution).

Understanding that control of a company usually sits at board level, means you’ll understand any decision around the structure of the board can have a big impact. If you are sole director and an incoming investor asks for a board seat, in a standard set-up, she would have to agree with you on all board decisions for you to be able to progress many key matters, giving her equal control, which may or may not be your intention.
Also look out for sneaky provisions that allow the company’s chairman to have the casting vote in the event of a tie in the votes of the directors. Should one of the directors also be the chairman with a casting vote, this effectively gives them a second vote and with a 2 person board, control.

Don’t accidentally create leverage

Think about who owns your company’s intellectual property (IP) – the brand name, domains, designs and technology. Ensure vital IP is owned by the company. In the event of a dispute arising, if one partner had registered the domain names personally and not assigned the rights to any IP she created (e.g. your website code), she has gained some leverage in any negotiation, probably accidentally.
Registering domain names and other assets in the name of the company is straightforward but when it comes to IP creation, there is an important point to understand. Take design of a logo as a simple example. Where the logo is created by an employee (someone on payroll), the IP will automatically be assigned and owned by the company that employs him. Where the logo is created by anyone not officially employed by the company (e.g. a freelancer or contractor), the IP actually needs to be assigned in writing. There are plenty of standard IP assignment documents online to do this without needing to engage a lawyer.


Don’t delay writing things down

A common mistake is hand-shake agreements over fundamentals, usually around the promise of equity or options. This is fine when everything works out but you can be on shaky ground when it doesn’t, as verbal agreements are much harder to enforce. Although preferable to use a lawyer, this is not always needed, you can even agree these details over email. Set out what has been agreed and request a confirmatory reply. This takes just minutes and can avoid months of pain further down the line.

Don’t neglect yourself

Founders often invest large sums of cash into their business but do so under the radar. This could be through paying for business and set up costs personally, as well as covering living expenses in the early pre-salary days. Consider whether it would be better to put this money into the company as a loan and spend via the company, even if you do not want or expect repayment. It can be written off later.
The benefits are two-fold. Firstly, if you plan to raise external investment, it is hugely beneficial to be able to clearly show investors what you have invested into the company personally. When you’re asking them to write a fat cheque, it is helpful to show that you also have some skin in the game. Secondly, when you reach the stage that your company can pay you, those first payments can be used to pay down the loan, meaning there’s no income tax due. Every penny counts!

The German economy plunged into a recession after suffering its steepest quarterly contraction since the 2009 financial crisis as shops and factories were shut down in mid-March to fight the spread of the coronavirus, preliminary data showed on Friday.
The 2.2 per cent first-quarter contraction was a foretaste of worse to come. Economists expect a deeper slump in the second quarter as the lockdown extended well into April and early May and sectors like tourism and in-door gastronomy, remain shut.
Germany still appears to be fairing better than neighbouring France and Italy, whose economies contracted by 5.8 per cent and 4.7 per cent respectively in the first quarter.
This is partly due to a decision by Germany’s 16 states to allow factories and construction sites to stay open, and an unprecedented rescue package by Chancellor Angela Merkel’s government.
The package however includes state aid that allows employers to switch employees to shorter working hours to avoid mass layoffs. “Output data for the fourth quarter was revised to a contraction of 0.1 per cent from a previously reported stagnation, which meant Germany was technically in a recession after two successive quarterly output slumps,’’ the data showed.
According to Carsten Brzeski of ING, things will get worse before they get better. “To be more precise, incoming data will be worse, even though the worst might already be behind us. “If today’s data are the result of two weeks of lockdown, three more weeks of lockdown and a very gradual lifting of some measures do not bode well for the second quarter,” Brzeski added.
Seasonally adjusted figures from the Federal Statistics Office showed that gross domestic product in Europe’s largest economy fell by 2.3 per cent from January to March after a 0.4 per cent expansion in the previous three months. Analysts polled by Reuters had expected national output to shrink by 2.2 per cent quarter-on-quarter and a 2 per cent contraction year-on-year in seasonally adjusted terms.

The Federation Accounts Allocation Committee has shared N 606. 196 billion to the three tiers of government for the month of April .
Director of Information in the Ministry of Finance , Budget and National Planning , Mr Hassan Dodo, made this known in a statement in Abuja on Friday.
Dodo said the meeting , which held by virtual , was chaired by the Permanent Secretary in the ministry, Dr Mahmoud Isa - Dutse.
He said the amount shared included Value Added Tax , Exchange Gain, Solid Mineral Revenue, Excess Bank Charges, and Excess Oil Revenue .
He explained that the Federal Government received N 169. 831 billion, the states got N86 .140 billion while the local government councils had N 66.411 billion and the oil - producing states received N 32. 895 billion as 13 per cent derivation.
The director , however, disclosed that the cost of collection of Federal Inland Revenue Service Refund and Allocation to North East Development Commission and Transfer to Excess Oil Revenue was N 15.134 billion .
“ The Gross Revenue available from the VAT for April 2020 was N 94. 495 billion as against the N 120. 268 billion distributed in the preceding month of March, resulting in a decrease of N 25. 772 billion.
“ The distribution is as follows; Federal Government got N13. 182 billion, the States received N 43. 941 billion, Local Government Councils took N 30.758 billon .
“ The distributed Statutory Revenue of N 370. 411billion received for the month was lower than the N597 .676 billion received for the previous month by N 227. 265 billion ,” he stated .
He said that Petroleum Profit Tax, Companies Income Tax, Import and Export Duties, Oil and VAT, all recorded a decrease.

A nurse has been declared wanted by the Ghana Registered Nurses and Midwives’ Association after she was captured in a video twerking in uniform while on duty.

In the viral video, the nurse can be seen twerking while her butt was tapped by someone. The person who tapped her butt, later straddled her as she continued twerking.



The video sparked outrage online as many people condemned her for disrespecting the uniform and profession.

The video later got the attention of the Ghana Registered Nurses and Midwives Association (GRNMA) and they directed all District and Regional Executives to assist in identifying the nurse so that she can be disciplined.

They warned other nurses to desist from such “unacceptable behaviour especially when in uniform in order to protect the dignity of the profession.”

Following up on conversations to extend the easing of the lockdown to religious bodies, the General Overseer of the
Guiding Light Assembly, Pastor Wale Adefarasin, has revealed that his church will not open even if government allows it.

Responding to a question about what's his stand regarding the clamour for reopening of churches

he replied thus:
while indeed physical worship trumps worshipping through electronic devices, he is personally responsible for his congregation.

“Even if the government says churches should start opening, we won’t open.
We will wait and observe how this pandemic pans out first.

The Lord didn’t put his children in our care for us to put them in the line of danger.
It is common sense, and that is a gift from God that He no doubt will question in the hereafter how much of a good use we made of it, if at all,”

The Judicial Commission of Inquiry set up by Governor Godwin Obaseki to investigate the construction of the Edo Specialist Hospital and supply of equipment has indicted former governor, Adams Oshiomhole.
Oshiomhole, the national chairman of the ruling All Progressives Congress (APC), was found culpable of alleged breach of the state’s Public Procurement Law.

Chairman of the commission, Justice James Oyomire (rtd), presented the report of the findings to Obaseki at the Government House in Benin, the state capital, on Thursday.

He stated that the award of contract for the construction of the facility was marred with irregularities.

Oyomire pointed out that the procurement law states that any contractor working on a government project should not receive more than 25 per cent upfront payment.

“The immediate past administration paid 75 per cent of the contract sum upfront for the project to Vamed Engineering”,

He stated.



Oyomire revealed that the commission’s eight-point recommendations empowers the Ministry of Justice to institute civil and criminal actions against those found culpable in the breach of the law.

The recommendations include the strengthening of Edo State Public Procurement Agency and ensuring strict adherence to the provision of the agency’s law on award of contract.

In his remarks, Obaseki vowed that anyone found culpable, no matter how highly-placed, will be asked to account for their action.

“We have been putting the right measures in place and if there are resources of government that need to be returned back, we will not hesitate to ask for it.

“Since I came into office, you cannot find this type of breach you have mentioned. If people have to face prosecution, whether civil or criminal, they will have to be prosecuted”,

Obaseki declared.
