Good Day
I was hoping I could get advice on a peculiar issue for a friend.
He has been asked to go for medicals with his 2 unaccompanying children from a previous relationship.
Children are however with their mother in another country and he is not on talking term with her.
Is there any way around it without withdrawing his application as there is no way children would be available for medical?
It shouldn't affect his application. He may just be told that he will not have an opportunity to serve as their sponsor in the future

I need more insight on this my peoplešŸ‘‡

Hi fellow Canadians šŸ˜Š, please help me out.

Iā€™m a married man but I have been separated from my wife for a few years now (not fully divorced yet). I just initiated divorce proceedings few days ago because I want to create EE profile and start my Canada PR journey.

I have another lady who I am exclusively dating & willing to take her with me to Canada. This is where the confusion sets in;

- Thereā€™s ā€˜legally separatedā€™ in the EE marital status but Iā€™m not sure whether I will be asked to provide some legal documents to prove that. Though I could get a letter from the lawyer handling the divorce and from the registry where the marriage was held

-Should I create my EE profile & apply for PR as ā€˜married with spouse unaccompanying ā€™ pending the divorce process is completed? Mind you divorce could take up to 6 months to a year to be completed.

-If I chose ā€˜common law relationshipā€™ with my current gf, is there any placeholder or box to explain that Iā€™m in the process of divorce with the one I earlier applied for PR with ?

Please note: I canā€™t apply as single because my ex and I have applied for PR before with our marriage certificate before things went sour between us.

Please bail me out my senior colleagues or someone that has been in this kind of situation so I donā€™t go astray šŸ™.

Thank you

I think you'll need the affidavit from the court that you've initiated the divorce process if you apply as separated. Checkout Reddit, once stumbled on someone in a similar situation.

Thanks got it.Well explained.

GraciousWords:

It's explained in detail here: https://www.nairaland.com/6081746/canadian-express-entry-federal-skilled/588#102548277 but to put it another way:

The aim is to get your PR application approved, which starts with getting as high a CRS as possible, in order to get ITA.

Typically, one's CRS will likely be lower with spouse accompanying than spouse unaccompanying, in the same vein, the CRS will likely be lower when married than when single....it's just the maths behind the CRS calculator. There might be instances where this doesn't hold, I guess.

If married, one way to increase CRS in desperate times is to make spouse unaccompanying (people with struggling CRS scores do this routinely). If single, one way to increase CRS is to remain single grin

IRCC already told us that the only scenario in which your CRS will not be recalculated as a single applicant is when you marry and add spouse after you already submitted your app (no be say you don already marry before, com lie say na after AOR you marry o). So if you plan to get married, getting married post AOR and adding spouse post AOR is the optimal choice (Canada immigration wise). Pre and post ITA marriages are sub-optimal (CRS will be recalculated).....unless of course the person has a PNP nomination in which case CRS is through the roof and they can do anyhow.

If one is already married, then obviously you must always indicate that you are married (pre, post ITA etc) and you must add your spouse (either as accompanying (affects CRS) or not accompanying (does not affect CRS, CRS calculation is done as if you were single)) to your profile and application pre, post and in-between all stages.

We should take this to EE thread though and leave Living in Canada for mild winter convo grin meanwhile you no need this info again nau.....

I thought it was always better for one to add spouse into the pool pre-ITA? What's the logic behind adding after AOR being better? Do the dynamics change if the said person is *already* married and previously stated that the spouse is non-accompanying when they created the EE profile?

Hello House, my profile was SPOUSE UNNACCOMPANIED due to our pursuit of points, but I got ITA yesterday for the Agric food program, and the CRS was at 354 which means I can add my wife without being ineligible due to points..I hope there is a way I can include her post-ITA (pre-AOR)..

Page 1 FAQ 34 also study this link carefully: https://www.nairaland.com/6081746/canadian-express-entry-federal-skilled/588#102548277

IF your personal CRS after changing to spouse accompanying is still above the draw CRS of 354, then you can change to spouse accompanying pre AOR, nothing do you.

However, if your personal CRS drops below the draw CRS of 354 when you change to spouse accompanying, then obviously don't.

AFAIK if you were already married (but spouse unaccompanying) pre ITA, then whether you add spouse post ITA, pre AOR or post AOR, the change will affect your CRS.

Some people say they added unaccompanying spouse post PPR - search NL for them.

How old is your daughter? Less than 4? Why would you even want to keep your daughter behind for the sake of relocation.

Agreed. Tell me please, if my spouse has not taken the ielts or done his WES, could it cause a significant points reduction for my pnp application? In such a case should i apply and indicate unaccompanying spouse? Or how do i go about it?
PNP programs differ by province. The essence of province is to give you additional 600 points. So u shouldn't worry about point reduction or whatever. Just find a province u like, read their guidelines on their website and u go!

Thank you. Indeed I am already in the pool. Brushing up my French for TEF exam. Even then I will only make it to the mid 400s at most (after redoing IELTS assuming I get an 8 in listening this time around, making spouse unaccompanying and passing TEF). Which is why I am looking at other alternatives. Mid 400s is still not quite there yet. šŸ¤¦ā€ā™€ļø

you can try the visit visa, it's already stated that you can convert visit visa to PR, if you get a job.
Children of international students can access same benefit with a PR, but you must have resided for atleast 9 months, I am not sure of the exact number of months.
It's better you start this Express Entry process.
No fast route to japa.
It needs patient.
Or you move to UK.

We are Family of 3, we are on 488. I changed the profile to unaccompanied spouse and CRS is now 493. Hopefully we will get ITA today.

My wife is the Principal Applicant.

Can i go ahead and accept the ITA and afterwards, Can my son go with my Wife to Canada using this mode?.
We have stayed long in this Process, we cannot take any chance anymore.

What do you guys advices please?
Should i just go on with the unaccompanying profile or wait for CRS score to drop further?
I hope you were patient enough to leave your profile as it is and get todayā€™s invite. A surprise draw of 484, all programs draw, 7000 invites was done today.

This is a tough one. While no one can predict the future cutoffs for EE draws, 488 is a decent score.

Regardless of whether you are an accompanying/non-accompanying spouse, you would need proof of funds for 3. Assuming that you intend to eventually join your family in Canada, your wife will need to submit a sponsorship application for you - added time, costs, and a separate process.
Also, if your wife and son did end up in Canada without you, it might be more difficult for them to assimilate as a family of 2.
In theory, you could get a visitor's visa and spend time with them while figuring out spousal sponsorship, but even that isn't guaranteed.

This is a decision your family needs to make based on your situation, but if it were me, the 5 additional points wouldn't be worth it.

Are there other things you can do to improve your score while staying in the pool at 488? Maybe retaking IELTS? Completing an additional certificate?

Tough, but Iā€™ll say accept the ITA.

Of course your wife can go with your son, and then you begin the process for you to join them.

If you think you can afford to wait a bit longer for another draw, you can decline. Bear in mind the next draw (FSW) may not come for another month, or even later. Or never, if they switch to the occupations in demand draws in Spring like they announced earlier.

I think she should update her profile to spouse unaccompanying. Ednut1 pls confirm if I am right
if you add him after ITA your scores will be recalculated and your application will be rejected due to the scores falling . You are to add him right now , so go and sort the eca and ielts.

Another option is add him as unaccompanied, file for him when you land in Canada

Iā€™d advise you let things be the way theyā€™re now. Thereā€™s not much of a difference between 488 and 493. Youā€™d get ITA very soon. The reward isnā€™t worth the risk in this case.

Although few persons have done this and it worked does not mean it will be the same in your case. So be advised there is a bit of skeptism at the end result because you don't know which VO your case will be assigned to.

A hypothetical case scenario; A merticulous VO who does everything by the book may want to check your score as at when you got your ITA bacause making your spouse unaccompanyiming improved your scores and placed your CRS morethan hundreds of candidates who would have clynched that ITA as opposed to if you had made your spouse accompanying. Since it's not stated officially anywhere by ircc that an unaccompanying pre AOR can be made accompanying post AOR compared with change in family size, I would suggest you proceed with caution.
So weigh your pros and cons and go in fully with your informed choice.
Yes once many people begin to see it as a shortcut and act on the loophole, some will definitely pay for it. It can be like MMM, first few folks chop....

Hi everyone,

So I got ITA in the last draw (made spouse unaccompanying). This is by far the toughest decision we have had to make as a family.

We are weighing our options as to how to add spouse later. This journey is really not for the faint hearted. Wishing everyone waiting at one point or the other the very best. It would end in praise.

Please how will that be possible?. My CRS is 488. But if i make myself unaccompanied as spouse, CRS will jump to 494. How do i add the spouse later?. At what point?

Congratulations, it is not an easy decision like you said, I insisted that my husband must be included,it brought down my point, but I am still hopeful, I cannot handle it alone over there. The option is to file for him when you land, which I believe you will succeed by God's grace.
