Travel / Re: Giving Birth In Canada by kmos1(f): 8:43pm On Aug 21
[quote author=leksite120 post=131444737]I don't know there was a thread like this.

Well, I would like to share my little story. However, I am not sure it will apply to most people here since you will be coming from Nigeria to just solely give birth, but you can gain one or two from my experience.

My wife and I entered Canada this year as a student while my wife is on spousal open work permit.
She was 8months pregnant when we entered. You might be surprised. Firstly, the bump was not big, it looked like a 5-6months bump and we were able to maneuver the airport wahala.
Though, our intention initially was not to give birth in canada but in Nigeria. However, there was a twist.

The twist was that I was supposed to resume school by September but there was a PGWP policy which will affect me after study cos my school is listed among those the policy would affect. So, I reached out to the school and they gave me an option of resuming earlier which was May intake.

Naturally, birthing and anything medical is free for canadian residents that are working and paying taxes but we were not working then hence, we were not eligible and was treated like a visitor who is not entitled to OHIP which is the ontario health card.

When we arrived, we were on the race and pressure of birthing. We reached out to midwives, but they were all booked. People always book midwives in Canada like 5months before due date.

Note: Midwives services are free for anybody whether citizen or non-citizen or even temporary residents. Midwives are free for anyone of any status in Canada ( that shows how intentional canada is in giving free healthcare) and their services are excellent too. The only problem is that you can't access them immediately, you have to inform them like months before the due date. Infact people normally book them immediately after conception.

Initially, we planned on using my student health insurance for my wife to give birth but it didn't work out cos the conception was from outside canada.

We tried to contact several doctors to at least get a manageable fee to pay, we couldn't. We tried almost all Midwives and Doulas in Toronto.
After all search, we got hold of an organisation, they are more like charity organisation that works with some midwives and they assisted us by getting us a doctor for our antenatal and they also took care of like 90% of our hospital bills and even 2 weeks post natal. We paid just $650 for all these, it was honestly a huge relief as against the almost $10,000 we would have paid.

Our baby now has her own health card for free with no stress right from the day she was born.
But remember, this is something we would have normally been entitled to for free if we have been working and paying taxes.
And I must confess, canadian healthcare is just top notch and they treated us like a human being compared to how Nigeria healthcare treats one, its just horrible.

The only problem they have is their waiting time which doesn't really matter to me cos if there's any emergency (emergency is not until you break your leg or have accident o), you'll be attended to. To me, apart from emergency, I don't think there's any serious reason why one should be bothered about the waiting time.

Please I want to know more about the charity organisation. Also, can I get your contact please for further enquiry?🙏

Toluvina:

Hello everyone,

I'm reaching out for guidance and support regarding my pending applications with Immigration, Refugees and Citizenship Canada (IRCC). Despite submitting my applications on December 18, 2023, and completing biometrics and medical exams in January 2024, I've yet to receive an update. It's been over 8months now.

- My application: spousal Open work permit
- My daughter's application: Visitor Visa

I've submitted multiple web forms, but unfortunately, I haven't received a response. Has anyone experienced a similar delay? Any advice or assistance would be greatly appreciated.

Thank you for your time

Please let the person who is schooling involve the MP representing their riding/location, The MP can reach IRCC on your behalf to know the status of the application.

Travel / Re: Canada Visit/tourist Visa Discussion. by Jeboy(m): 10:09pm On Aug 08
This advise is gotten from a seasoned immigration consultant. The IRCC keep changing the marking score just to reduce people they will give the visa.

The reason is why would you a spouse be in a rush to go and visit a spouse student that will just be away for 1 year study? Have they not factored out the challenge before one of them agreed to embark on the study journey? They are beginning to detect that the emphasis of missing my spouse we put up as reason to apply for visa is just an emotional blackmail.

On the other hand, everyone loves to do a 2 year course but you also know that it has to do with funds. The cheapest 2 year course will cost nothing less than 25k CAD tuition which is about 30m Naira plus 2 years living expense that should cost another N30m to N40m thats a total of N60m to N70m approx.....thats no be beans oh. New Brunswick and some province still offer PR pathways for a year course via Fed Express Entry + Student Connection.

House34:

It's a common misconception that you need to be separated for a year before IRCC considers spousal or family visit applications. In reality, IRCC does not require spouses to be apart for a specific period before reuniting. It's a visitor visa, and you need to prove that you will return to your home country after your visit since you're not entitled to a spousal Open work permit (SOWP). However, I am more concerned about spouses coming for a 1-year program without a solid plan for a PR (Permanent Residence) route. A 1-year course will only get you a 1-year Post-Graduation work permit (PGWP), and if you get a job offer, your spouse can also get an open work permit for 1 year. But 1 year goes by fast, and what’s next for the couples? Many are getting stranded now or looking for an LMIA, which is extremely expensive. To get PR, you will still need to return to the Express Entry pool, where factors like your age, provincial nomination, work experience, and IELTS scores will matter.
Education in canada is not cheap, and for a couple to spend over 20,000 CAD in tution with cost of living and still struggle to get PR after the program or face enrolling in another 1-year program just to complete 1 + 1 to get a 3-year PGWP is daunting. The path to PR is becoming increasingly challenging these days

Jeboy:
My spouse enrolled in a 2 year Diploma course and end of this month will be a year since our separation.

From what I hear now, you must be have been separated from your College spouse at least a year before IRCC can positively consider your spousal or family visit.

I will advise those whose spouse are running a year course to only apply to attend graduation as this one year requirements has badly affected spouse looking to join students with one year course except special cases where children are involved.

Now I get u bro. I'm a PR in Canada and this application is actually a TRV for a relative applied with invitation.

uchennay:

I did not argue with you or doubt you but rather aimed to educate each other and prevent unnecessary confusion or panic. Could you please clarify which visa category your brother applied for? Was it a student visa, a spousal Open work permit (SOWP), or a visitor visa while his spouse's Permanent Residency (PR) application is in progress or with usa visa?
Please enlighten us, so those using your experience as a reference will have accurate information. Attached are the applications for a student visa and an SOWP that were recently approved within 3 weeks . It would be dishonest for me to claim it as a visitor visa, especially since the IRCC tracking system omitted the medical test part.

Good day everybody, please permit me to give my opinion on the recent changes in the Canadian student immigration process, and its implications on the future spousal open work permit.

I am not a lawyer but I am a bit familiar with the Canada immigration events. One of the major red flags the visa officer relies on to refuse temporary resident applications is the presence of family member in Canada. Although there are mixed jurisprudence on this subject matter. Some judges like Justice Joseph Shore had ruled in Bteich v The Minister of Citizenship and Immigration that it is unreasonable for the office to conclude that applicant will illegally live in Canada simply because of the family ties in Canada, some Judges like Justice Diner in Hajiyeva v. The Minister of Citizenship and Immigration ruled that the presence of an immediate family member in Canada such as applicant's spouse was a reasonable factor to refuse an application. Justice Diner ruled as follows:

"while the Applicant’s parents and brother would remain in Azerbaijan, her immediate family (husband and children) would join her in Canada; she indicated her husband would obtain a work permit and gain international work experience, and her children would attend school and be exposed to Canadian values. The Officer’s finding regarding her incentives to remain in Canada were reasonable. Here, the finding that her evidence and supporting documentation fell short of demonstrating that she would leave Canada at the end of her study period was open to the Officer"
This concern was mostly overcome in the past by the spouses of international students applying for the spousal open work permit by the dual intent doctrine. The dual intent favoured the spouses of international students because the international students would gain a Post Graduate work permit and apply for PR. Now that Canada is planning to change their law in relation to the postgraduate work permit, the issuance of postgraduate work permit will no more be automatic. Issuance will not be based on the Canada labour needs. The implication of this is that there is no more automatic pathway to PR for the international students. Therefore, dual intent wont be helpful to the spouses of the international students who will be applying for spousal open work permit.

All our emotional explanation of "I want to be with my husband because of bla bla bla" in the context of spousal open work permit may simply be no way to overcome the pure mathematics of the family members by our emotional explanation and our country of origin where evrrybody wants tp japa. These Oyinbos are aware of these facts. One might need to be a bit cautious in seemingly explaining the family’s plans to ‘settle’ in Canada (as workers and students) and how that may detract from both the study plan but also create the reasonableness of an intention to immigrate or stay permanently especially if dual intention is otherwise not established.

Thank you.

Passport Requests are few and far between these days, but it's to the glory of God that I am coming back to say I got a surprise PPR for spousal work permit today. I'm a spouse of a college student who is already schooling in canada, I applied in November 2023.

It's a surprise to me because I wasn't expecting a PPR. I already had a travel visa, and had visited once, so, all I was praying for was a Port of entry Letter of Introduction, not PPR since i already have a visa. Now I am not sure of what to do with this PPR. This goodnews comes with a dose of confusion.

Gurus in the house, please advise me. Am I supposed to submit my passport again for Visa, despite already having a valid visa? Is this normal? Or should I send IRCC a webform/mail about this? If I submit my passport again, hope they won't cancel my existing travel visa....?

Congratulations, the question should be, did you apply for SOWP? if you did then you need to send your passport for stamping, this will allow you work in Canada if you wish. It does not invalidate your existing VV. Congratulations once again
Travel / Re: Canadian Student Visa Thread Part 23 by JMG12: 4:20pm On May 10
If your husband has been approved for a spouse open work permit, he should indeed proceed to submit his passport for stamping. Once stamped, the passport will serve as proof of his authorization to work in Canada under the open work permit. This step is essential before any further documentation, such as an introduction letter or eTA (Electronic Travel Authorization), is processed.

Good afternoon Everyone!

Please, I applied for a spousal open work permit for my husband and I just received a passport request with a correspondences letter. However, he already has a visitor's visa which is still valid, so we didn't apply for a visa. We re surprised to get a PPR instead of an introduction letter to present at immigration in Canada. Please. Has anyone experienced this? What can we do?
Travel / Re: Canada Spouse Open Work Permit (sowp)timeline by folla: 4:03pm On May 10
Congratulations!

Why the confusion? Isn't a visit visa different from a work visa?

A SOWP is a work visa that entitles you to a work permit when you arrive at the POE.

A visit visa merely allows you to enter Canada, but can't work.

Properties / Re: Basic Information You Need To Upscale Your Chance Of Study Visa Approval. by Primej3: 12:42pm On May 08
sternakin:
BASIC INFORMATION YOU NEED TO UPSCALE YOUR CHANCE OF STUDY VISA APPROVAL.

Relocating to Canada, U.S.A or United Kingdom through study is one of the best route to moving with one's family and eventually securing a Permanent Residence. Getting admission to Canada, US or UK for study is a great achievement, however, that's just the first hurdle, before you can pack your bags and move to Canada, US or UK for your study, you must get a visa.

Therefore, let's take a look at how an applicant can avoid getting a rejection on his/her study visa application. If you’re about applying for a Canadian study visa, kindly take very careful note of some common factors to watch out for when making your study visa application.

Although, most International students are eligible to apply to come to study in Canada with family members (spouses & children). These are few things to note to do this successfully. Let it be known that when you applied for admission, you did that for yourself alone, but when applying for visa, you can include your family (spouse and children) for your study visa

On that note, your visa application shall then be determined by three things:

* Purpose of study
* Proof of funds
* Home ties

These three things are the expectations for single applicants as well, but if applying as a family, you have a stronger justification to make. You will need to show additional funds to cater for the family, justify the importance of having family members with you, and have other ties to your country.

Purpose of study:

In your study plan/letter of explanation, you will need to convincingly explain the reasons you chose to study in Canada and why your spouse & children should accompany you to Canada.

Your children and wife can apply for a visitor/study permit (depending on your program of study), and spouse, a visitor/work permit (depending on what they intend to do in Canada)

NB: If you are a student going to a school/program that is not eligible for a post-graduation work permit (PGWP), your spouse is not eligible for the spousal open work permit (SOWP).

This is one of the important reasons to ensure the program you apply for is eligible for PGWP. The study plan helps you to justify the purpose of your study & the importance of having your family with you so that your spouse can work and support the family while you're are studying.

Other reasons could be anything from the fact that your children are young, or your family has never been apart before. Family unification is important to Canada, so you can leverage on that.

Proof of funds (POF)

If you intend to apply with your family, you will have to pay extra application fees & also show more POF than a single applicant. You must also show that you have sufficient funds to support yourself & the family members accompanying you without working in Canada. You are expected to show enough to cover your tuition and living expenses as the student; and the additional funds for the living expenses of those accompanying you. And the total funds you need will depend on your own family number.

To be more practical, you need to show that you have the value of living expenses for one year (Naira equivalent of approximately CAD$26,400 for you in addition to the cost of your tuition for one year).

Let’s say you wish to study for a Masters in Marketing for 2 years, and your tuition is $12,000 per year, you are expected to have the sum of $26,400 living expenses (1year) and $12,000 tuition for one year, a total of CAD$38,400. So if you have a family and you will be applying for them as well, you need to have an extra CAD$4000 for each of them for their living expenses per year.

If you are applying alone (at first), then you or your spouse needs to show enough funds for the living expenses on your family (no definite amount for this but should be sizeable depending on your family size).

Home ties

Proof of home ties, this is very crucial and an important aspect of the Canadian study visa application owing to the fact that many applicants have been denied based on insufficient proof of home ties, that simply means having sufficient fund is not enough to guarantee your visa approval. As an international student, you are a temporary resident & need to show that you have reasons to leave Canada after your study (if required to do so).

IRCC wants to see evidence of your home ties. Many applicants find it easier to use their family members as part of their home ties. But in the case you're applying with your family, it means you must be ready to show other ties.

It could be your business, investments, employment, financial assets and most importantly landed properties (which are mostly preferred cos they hardly depreciate in value but appreciate more over time).

Therefore, you must know what the visa officers want to see and craft your application to satisfy them. Submitting a valuation report of your landed assets (land & building) along with other required documents for visa application could actually boost your chance of visa approval.

Either for visit, study, medical or other temporary or permanent residency visa applications, it is strongly advisable for applicants to provide a valuation report of their property(ties) in order to assist and convince visa officer about their economic/financial status in their home country and also as proof of strong home tie to pull the applicant to return on expiration of period granted.

Property Valuation report could make a visa officer develop good mental picture of who the applicant is, it just like what CV is to a job recruiter. An employer can develop an idea who a job seeker is through the CV to decide if the job seeker should be considered or not. A valuation report describe in detail the property(ies) owned by the visa applicant and the corresponding value of such a property either a house undeveloped land, agricultural farmlands etc which undoubtedly could be a strong proof of the applicant tie to the home country that can pull him/her back after his/her study.

This document shows the amount of wealth you own in property(ties) in your homeland which will make a strong pull factor for your return to your homeland once the purpose of your visit is over and that may eliminate doubt of your return and one point of visa rejection.

Also, it could serve as a support document to your proof of fund which are usually liquid assets such as bank deposit etc. It will make lots of senses if you have good financial status as confirmed by your bank statement of account and property or assets valuation report to corroborate your status.

Though, there are many who do not submit this document due to ignorance or it doesn't matter mind set but it would be wise to do it by a smart applicant especially if its a non apprearance visa application or the one you first submit your application for assesment prior to physical interview.

It is important to prove that your housing assets is valuable as a strong home tie for returning after your study abroad or temporary visit and back up for proof of fund especially Canada Express Entry applicants and schooling.

The report would be a guide to the visa officer to establish the affordability of expenses of visit, stay, study and that the applicant have assets that can be liquidated to raise funds if the need arises.

Properties / Basic Information You Need To Upscale Your Chance Of Study Visa Approval. by sternakin(m): 1:58pm On Apr 18

* Purpose of study
* Proof of funds
* Home ties

Hi everyone ,

Please anyone in this category
I am applying for nursing 12 months program in the USA and I am on spousal work permit in Canada .
What is my fate in getting a visa from
This .?

Hey 🤠

*** Your faith in getting an F1 visa is like the faith of a Canadian (citizen). The only different is that YOU NEED AN F1 visa because you are not a citizen yet.

1. You must proof ties to Canada.

2. You must give a reasonable post-study plans .

3. You must show ability to pay your school fees and other miscellaneous expenses .

4. You must be ready to answer : Why this particular institution? Why Nursing ? Are there no institution in Canada that offers same quality nursing programs?

5. If you have lived up to 3 years in Canada, then you may have a better ride , but if you have just landed in Canada , then you should be ready for battle of communication with the consular.

6. USA & CANADA are like Coca Cola & Pepsi ( almost 95% of anything you can get in the USA is also obtainable in Canada or from Canada) .

7. You have to give a convincing reasons to get your visa .

Best Wishes 🙏

Education / IRCC Changes Eligibility Requirements For Spousal Open Work Permits by Kishaimmigratio: 6:38pm On Mar 20
Immigration Refugees and Citizenship Canada (IRCC) has released more details surrounding changes to eligibility for spousal Open work Permits (SOWP).

On January 22, 2024, the department introduced several changes to Canada’s international student program. Among them, IRCC said that the spouses of international students in undergraduate and college programs will no longer be eligible for SOWPs.

As of March 19, 2024, partners and spouses of international students are eligible for a SOWP only if their sponsor is enrolled in a master’s or doctoral degree program at a university or polytechnic institution in Canada.

There are some exceptions for the spouses or partners of undergraduate students. Spouses of undergraduate students in one of the following professional degree programs at a university are also eligible to apply for an SOWP:

• Doctor of Dental Surgery (DDS, DMD).

• Bachelor of Law or Juris Doctor (LLB, JD, BCL).

• Doctor of Medicine (MD).

• Doctor of Optometry (OD).

• Pharmacy (PharmD, BS, BSc, BPharm).

• Doctor of Veterinary Medicine (DVM).

• Bachelor of Science in Nursing (BScN, BSN, BNSc).

• Bachelor of Education (B. Ed.).

• Bachelor of Engineering (B. Eng., BE, BASc).

Spouses and partners applying for a SOWP must provide documents that prove a relationship to the student and one document showing proof of their partner’s enrolment in a degree-granting program of study. IRCC accepts:

i) A valid Letter of Acceptance (LOA) from a Designated Learning Institution (DLI).

ii) A proof of enrolment letter from their spouse or partner’s DLI.

iii) Transcripts from their spouse or partner’s current program

What if you already applied?

IRCC says that those who applied for a SOWP before March 19 are still eligible if their partner:

• Has a valid study permit.

• Is eligible for a post-graduation work permit (PGWP).

• Is a full-time student at one of these types of schools;

i) A public post-secondary school, such as a college or university, or CEGEP in Quebec.

ii) A private college-level school in Quebec.

iii) A Canadian private school that can legally award degrees under provincial law (for example, a bachelor’s, master’s, or doctoral degree)

These requirements are the same for current SOWP holders who apply to extend their existing permits.

What if you’re not eligible?

Spouses and partners who no longer meet the revised eligibility criteria have alternative options. They can explore other types of work permits or apply for a visitor visa (TRV). However, it's crucial to note that individuals entering Canada on a visitor visa are not permitted to work.

IRCC's decision to narrow the eligibility for SOWPs stems from the aim to manage application volume and ensure the integrity of the program.

Immigration Minister Marc Miller highlighted the need to focus SOWPs on partners of master’s and PhD students to address potential misuse of the program.

So, while these changes might affect some spouses of international students, they're aimed at keeping the system running smoothly and helping families stay together in Canada.

Kurukuru:
Go and read the IRPA very well. The essence of the spousal Open work is not primarily to unite the families. It is under the International Mobility Pprogram aimed at supplementing the Canadian labour force. When the Trudea Government took over, he wrote a Mandate Letter to the Minister of Immigration to address the Canadian Labour shortage by uniting families through the spousal Open work permit program. That's why some people believe it is meant to re-unite families. Now, Canada is facing housing crisis and many white Canadians are complaining that foreign students and their families they are bringing to Canada are taking jobs away from them. Today, the popularity of the Liberal Party is dwindling, and the opposition is catching on it that the Liberal Party is bringing in "poor and low class students" to Canada. If you are in Canada, go and be listening to CBC programs on Immigration. Or you join the online forum on Immigration where the white Canadians are prominent. Go and read what they say about the international students and their family members. The Minister of Immigration himself said that as a result of the housing crisis, Canada need to reduce the intake of international students and the temporary foreign workers. How do you expect them to reduce the intake of foreign workers if not by refusing applications

On one hand you said the PM instructed they should use the SOWP to unite families and then you said that is why people think is for uniting families. I do not understand you here. Nigeria is not even in the top two countries sending students to Canada.
