Seemly for the NIW, the key consideration isn't so much of listing one's 'qualifications'/'achievements'. Rather, it's 'rewriting' to address what would be of key interest to the States.
USCIS Updates Guidance on National Interest Waivers
The three factors USCIS considers for a national interest waiver are whether:
- The person’s proposed endeavor has both substantial merit and national importance;
- The person is well positioned to advance the proposed endeavor; and
- It would be beneficial to the United States to waive the job offer and thus the permanent labor certification requirements.

Fair points. What ought to be in bona fide. Unfortunately, we've seen over and over, it's from an oversabi or mala fide or sanctimonious standpoint. The BAME dominated community reality speaks loud in news!
In-btw, the majority of 'these custodian of standards' don't tolerate indiscipline in their homes (and community)!
Ralphlauren:
The kids have complained to their teachers that they come to school hungry.
What will be going on in the head of these teachers/social workers is so what happens to these children during weekends, school holidays or after school hours? Are they given little or no food? Do they go to bed hungry?
If the family is struggling, this is where the social worker comes in. The need to understand where the family is struggling and how best they can support. The family can be signposted to food banks or given food vouchers to redeem or money to buy basic items for the kids.
I know a family that was given bunk bed for free (they had twins of different genders sharing the same bed) and they were fast tracked to get an affordable council house. They came under the radar of social services following a report made by the school.

? is, why do we have lots of societal ill vice in predominantly BAME areas. Fear of #discipline (not all those cane et al or outright maltreat types). Overly intrusive 'piercing the veil' by deceitful, hypocritical, sanctimoniosly, pharaseeism, double standard, double-dealing 'bigotries': 👃-poking oversabi teacher, social worker ....
We oft have entitled kids who are brainwashed on self-seeking wants rather than solid love.
By the way, we don't assist with our ... now we live in saner climes, I'll show you attitude, we display within the home front. It takes assistive two to raise a home. A ball 🏀 never have two centres. Perhaps, a rugby 🏉 or 🏈 might have two contending points of influence.
By the way, abuse is not our African culture although some portrayed it as such. So sad. We don't take charge of history, sociology, anthropology. That's a discourse for another day.
PS: I'm not saying we don't have abuse taking place. Reality is in the true African culture, there were lots of safeguards. They got slackened or removed as 'modernity' kicks in.

A good probs is sweet.
Great inputs from Mimilyrics and Solumtoya. Kindly reflect on them.
If my assumption is correct, the role is not a (financial) auditor role; obviously not IT audit.
If that is so, the audit firm might not offer much; even in the big 5!!
However, if preparing an presenting Financial Statement is critical/key to your career projection, then grab 2nd offer tight and (over)learn during the time you spend with them.
If otherwise, I'll incline towards 1st offer. Note that 1st offer, from how you stated it, does not refer to outside IR35.
PS: recommending 1st offer has nothing to do with the 13k extra. That Jara isn't massive. The selling point is the name which might gives you great flexibility in 'porting' easily to greater/higher role.
However, #name without tangible #experience might not work out or cut it much in the long run.

What is the best fixed rate one should look out for
I can't categorically say. Your risk level will also play a part. Rule of thumb though will be, the closer to BoE base rate (currently hovering around 4%) the better. Seems, lenders are dropping their fixed rate. Some coming down from 5?7 to 4.3!!!
Caveats: perhaps, it's an indicator of possible decreasing of BoE base rate in the next 1 to 2 years!

[This is a new question compared to earlier matter 'answered to']
Regarding NI/Tax, employer handles that. 'employee' only handle this themselves when they are outside IR35: in that case, the 'employee' transform to self-employed!!!
In any case. HMRC does not slack on money matter!! If however, outside IR35 gets detected and one's visa doesn't allow self-employment, yawa fit gas!!! Na there Home Office fit enter matter!!!
Note. This response speaks to what ought to be. Whatever, underhand arrangement between 'employee' and 'employeer', na their own water regatta be dat. So far ẹyọ no come out at wrong time!
Generalkoke:
Chief the question is if NI/Tax is not being paid can the visa/sponsorship be revoked by the home office? Cos I heard people pay their company money to pay their tax .

What's the difference between fixed and variable rates
By fixed and variable rates, one assume you're referring to mortgage rate.
In a nutshell, the common denominator is the Bank of England base rate
For variable, your mortgage repayment varies (fluctuates) according to the BoE base rate. When the rate increases, your mortgage rate and consequentially, you repayment amount increases. Vice versa, when BoE base rate decreases.
Fixed rate on the other hand doesn't fluctuates as BoE base. You pay a fixed (predetermined) amount for the contractual period: 2yrs, 3yrs, 5yrs, 7 yrs, 10 yrs. Getting the right fixed rate (percentage, timing) comes with skills and/or deep research.

Mortgage Redemption / Early Settlement, Early Repayment: paying off mortgage amount earlier. Be weary of penalty, however it's worth it.
#Wealth 🤑 #Equity #Asset

Taken from (old) Living in the UK thread page 15
lexusgs430:
... Mortgage redemption comes in 2 variations ...
shaybebaby:
... ...
mortgage redemption is just that, paying off the outstanding loan whether it prior to term of the mortgage or not.

The redemption amount is the amount required to settle the debt in full. Where you are paying it off before the end of the mortgage term, that is called early repayment and as such may incur additional charges in addition to the outstanding amount.

You can redeem your mortgage before the end of the mortgage without incurring additional if you make no more than an additional 10 percent payment of the outstanding loan amount in a year.
Eg if you take out a mortgage for 200,000. In the first year of the mortgage, you can pay an additional 20k of repayment in addition to your monthly payments (I'm ignoring the capital you are paying for if on a repayment mortgage and not interest only, however banks will calculate that).

Year two, assuming the outstanding amount is 180k,you can pay off an additional 18k. Etc

Doing it this way, one can be mortgage free in less than the term of the mortgage without incurring early repayment charges.

With a scheduled resumption 23rd Jan 2023 and we're already clocking ONE mth the resumption date, a letter from the school might be necessary. The school letter should indicate readiness to allow the student to continue with resumption and/or contingency plans/arrangement made to accommodate the student.
In the absence of that, one will expect deferring. In your case, deferring to 24 April 2023. This depends on the school's conditions. However, it shouldn't be difficult as the proof of delayed visa processing should suffice.
People with hands-on experience would advise better.

... ..., cos if you get into a confrontation with your current employer, they may withdraw/revoke your CoS and you know what it means - for them, they may just face a fine or loss of their sponsorship licence; for you it may mean having to go back to Naija.
If you wish to pursue it legally and need some guidance, you may seek professional counsel from a labour-matters or immigration lawyer. ... ...
Also, you can enquire about labour unions, such as Unison, that may be able to assist you in fighting for your rights. I've specifically searched and found the links below which I hope would provide useful information and assistance to you and others:
-> https://www.acas.org.uk/your-rights-during-redundancy/appeal-a-redundancy-decision
... ...
However, at this point, my advice to you, and others in similar situations, is to fall back to aggressive job hunting ...
... ...
To go alongside labour unions and labour/immigration lawyer is to engage ACAS (not necessarily for dispute purposes).
Should things gets bad to the stage of your current employer withdrawing/revoking your COS, they would most likely, without fail, do everything to rope you in as complicit or accomplice. Why? Because they would want to save face in the hefty fine they'll be slapped with and revocation of their license. Of course, whichever way, they'll still slammed. However, from the way you portrayed them (your employer), they will take you along with their fall.
Also, they (employer) would want to 'punish' you for getting them in the 'dock'. So, they'll not want you to enjoy the 60 days grace to hunt for another job in the UK.

All the best as you 'wisdomly' this.

Property search and offer negotiation: the water factor
Apparently, in most of Scotland, water 💦 bills 💵 are integrated into Council rate.
For those in England, water bill varies from Councils to Council, from size of property to property, and most importantly usage per household.
Before putting in that offer, give thought to post mortgage cost regarding water bills.
You might have the dreaded estimated billing that makes your £ 💸 fly away or you have water meter that watches you like a hawk.
Water bills are wide apart from £150 to £750 per year.

[Extracts] discussions from Living in the UK thread
Lexusgs430: What about if a water meter was installed, after you bought the property...........😂😜💰
chrisnwaa123: It can't be installed without the owner's consent lol. The flat I bought doesn't have water meter, and was even adviced by d customer rep not to request for one.
Lexusgs430: You would have no choice, if your utility company is rolling out water meter to every property they supply......

They have legal protection/provisions to install water metres.......
Can a water customer refuse smart meter).

Go and verify.......😂🤣⏫⏫⏫⏫⏫

🚿With or without water bill, keep calm and let's use water responsibly🚿
#Responsibly is subjective 😉

It all boils down to ...
If you enjoy the shower/bath, then enjoy the water bill 💸
If you relish in luxury of water 🌊 comfort, then comfortable pay without iota of complain or engaging complaints. QED
What's fair use is commensurate to each ones £pocket or ones comfort level or degree of comfort/luxury.
If you wanna live it, live it £ poundly comfortably. If you don't wanna, then adjust living to £level.

Be it as it may, for us that are conscious of water bill 💵, we take all the saving measures we can. Especially, for a Ìjẹ̀bú person like me.
- when using shower, don't pull the 'trigger' to full. You don't need that full force. You no be naval officer! Just the little drizzling required. As much as possible, pull down/close the tap inbtw the first water to wet body, then rinse body. Once in a while, you can do not shower 🚿 but not everyday or every order day. Ditto hot soak.
- If you can, which is difficult for many except baba Ìjẹ̀bú like me, do away with dish washer or use dish washer sparingly. Rather use one sink to wash and the other to rinse and wipe. Of course, I don't support the 'soapy' rinse thingy. You just need enough water to rinse plates/utilities/cookery. You can simulate the two sinks process even with one sink. Perhaps this is the beauty of some of us growing up with most water corporation starting to 'take' water. Well, before when it becomes non functioning water corporations!
- never do a full flush for wee-wee. Only for no 2. Even with that, there're some no 2 that don't require full Voltron flush! Well, getting/having the right/appropriate toilet cistern is key.
- learn to wash panties with good ol' hand. Dumping brief/panties in washing machine might wash away your away £💸. If you wash 'em with other clothes as part of machine load, then fine.
- lots of ways.
Critical is having a 'conscious' consciousness. Once the mindset is there, it weaves itself into the fabric of everyone in the house whether spouse or children or any other dependents including alejò (guest). Any dissenters should go the way ... enjoy use, enjoy pay

As at 13 Feb, the status remains they are attending to study appeals received by 24 Jan 2023 and study visa application received by 03 Jan 2023. Once they start processing appeals received from 30th Jan, they will update. Unfortunately, AFAIK, that's the way the Irish embassy operates.
Flourish4L:
... My appeal got to the embassy on 30th of Jan. and still no response. For the past 3weeks on the decision page, it displays only study appeals received in Abuja on the 24th is being covered.
Any info or update anyone pls?

If by valid Tribunal ruling, you imply the issue of leading ruling, concurring ruling and dissenting ruling, then, indeed there's a point-in-limine matter before the Appellate. Correctly so, as you've indicated, it just be dealt with on that basis in the first instance before ventilating the merit of the case.
As I have alluded, the Appellate at in a fortunate situation to engage with s292 as read with s294. More so, they would also have to give credence to recent SC case dealing with similar scenario, albeit from an appearance basis. IMHO though, the jurisprudence of law, except where explicitly stated otherwise, as it is for AC and SC in Nigeria, leading judgement stands in coram. Should there be need for concurring, then concurring judgement must follow. Likewise, if dissenting, a dissenting judgement must follow.
One will suppose the dictum in the SC 84/2010 imports well.
adee17:
The first and major issue that will be determined by the appellate courts is if there's a valid tribunal judgement before them. If they decide there's none, then the purported tribunal judgment will be nullified and order a retrial.
semmyk:
If per chance there's no valid judgement, then, in law wouldn't it then be that there would be nothing live before the appellate court? As in jurisdiction 101
Invariably, what would the appellate court be considering. What would be the matter at hand?

On second thought. Is your argument that the Tribunal ruling is nullity on the basis that there are *only* two ruling. If so, are you saying, there's no leading ruling and dissenting ruling.
PS: I used leading and dissenting instead of majority and minority (as used by many). My choice is premised on SC judgement resolving that Nigeria follows UK where it's been resolved it's leading and not majority. In any case, this is mere schematic of law.
On the serious issue at hand, let's suppose the ruling is split into two; one for and one against. It appears that has not created a nullity yet. Why?
It is a ruling devoid of leading and dissenting. The remedy in law ought to be the Appellate compelling the third Tribunal judge to write concurring ruling. Why would it be concurring ruling. Simply put. The third Tribunal judge already signed in coram to the ruling for an unlike SC 84/2010, was in attendance.

In all of those let's all see how the Appellate handle this. More certainly, the matter ends in SC.

There's no valid judgment of the tribunal that the appeal or supreme Court will adjudicate on. The appeal and supreme Court will ask for retrial by different panel which will become academic exercise because of time.

I won't be surprised if parties rely on this (recent) ruling or one of the party has not updated themselves with this ruling. Seems the appellate court will have their hand full ventilating and considering this SC ruling.

Thanks @Ejimatic for expressing this. From this interesting ground of appeal, one would have thought 9ja follows a different jurisprudence.
In saner clime, which isn't so much of saner climes but principle of law, ALL the Judges or Justices do not voice an opinion on majority judgement (leading judgement as called in 9ja or UK). When do Judges penned an opinion? They do when they have disagreement (like in the case of the 3rd panel member). When a Judge or Justice is in agreement (that is concur) but want to emphasise an aspect of law or express a different approach that would arrive at the same outcome but from another angle/perspective.
Invariably, all that is required is to concur or dissent.

“The second member of the lower Tribunal could not have validly signed the decision of the chairman of the lower Tribunal without an opinion.
“What was presented as the lead decision of the Tribunal is a nullity in fact and in law, not lead decision of the lower Tribunal.”

In my view, this ground of appeal, if 9ja legal jurisprudence follow others, would be fantastically interesting. Hopefully, it's not a 'milking off' of client by the advocates/lawyers.
Be it as it may. I'll have to read up appropriate sections of the Constitution and Judicial Act on this aspect as what is applicable to 9ja.
In any case, one would expect a person in Adeleke's position, who affirms he's won correctly, to be raising factual appeal grounds rather than what would be construed as clutching at straw. Or maybe even those of Chapter VII s295 of the Constitution, or 285 read with 294.
I won't be surprised if parties rely on this (recent) ruling or one of the party has not updated themselves with this ruling. Seems the appellate court will have their hand full ventilating and considering this SC ruling.

. Section 294 of the constitution subsection 1 2 and 4 mandates AC and SC members to have a say in any judgement they make It doew not apply to TB . Whoever has something different can show us here for consideration. Additionally if both of them are minority judgements AC will decide another minority and majority judgement! ..My opinion.
