I read with interest items 1 to 18 as attributed to one Hashim Abioye Esq. I am immensely grateful to the legal luminary for the worthwhile compilation. In view of the law of evidence and the law of interpretation (of statutes), I'll be open to and request a live session with him to go over each of the #18 items as relating to the Osun Election Tribunal ruling. Perhaps a live Zoom or Channels TV might work.
I am of the considerate view that he owes a legal duty to defend his assertions and position. He is however welcome to reconsider his compilation where he sees legal lapses therein and welcome to also do so Ad Seratim to the Tribunal ruling.

If Edubond is not paid by you, then in my view/understanding, his/,her statements should be submitted, typically 6mths (I guess). Please note, this is in addition to yours.
AFAIK, Edubond does not exonerate you from showing/meeting financial capability. However, Edubond drastically limit the degree of (unwarranted) privacy intrusion into yours and sponsors finances.

Please guys, what other Financial Documents is needed from someone using Edubond?
Do they still require the statement of who paid the Edubond?

I'm not on WhatsApp. I'm on Telegram. There was discussion here about credible agents that might be able to ship/freight to the UK. Perhaps, you might wrap a biz around 'em as logistics. you'll still need a base in the YouKay. PS: there're number of 9ja outlets. Nonetheless, there'll always be room. If the Lebanese can enter that space, how much more a 9ja with direct access to farm!
You might also want to explore the agriculture forum on NL. All the best.

From what you narrated, the matter at hand is employment. Hence, you should have been in ACAS like today!!!
Yes, it's twisted in immigration. However, that's the distraction! I dare say, the employer understand the game they're playing. A good game of dart 🎯 Hit you most where it matters!!
All the best as you navigate this.
dubaiprince:
Thanks a lot. The immigration lawyer I met today said they don't really handle employment matters and this my issue is a mix of both employment and immigration matter. They said what they can do is to get home office to confirm the date the tier 2 visa was issued and I can use that as further evidence before going to ACAS. I am just waiting on the employers response they asked for 72 hours to respond which lapses tomorrow.

One thing about Masters, apart from course work, is #research. Getting started on 'research' now, will be great; although for your visa purposes.
AgricEcons is the closest you get to business and entrepreneurship amongst the Agric courses: far closer than agronomy, AgricExtension ...
Give a thought to why we have courses like
- Agri-business Management
- Agricultural Economics and Management
Talking of NUI, perhaps, that they offer link: MSc (AgInnovation: Agricultural Innovation & Entrepreneurship) might tell you of the closeness. It should also guide you on 'link' to the generic MSc Entrepreneurship.
Beware, mentioning the MSc (AgInnovation: Agricultural Innovation & Entrepreneurship) might lead to VO questioning you the more or ground for refusal. However, using contents from MSc (AgInnovation: Agricultural Innovation & Entrepreneurship) as inputs into how your AgricEcons links up / relates to MSc Entrepreneurship might assist.
All the best.

Irish Embassy always hammer on career progression and how your degree relates to the one you're pursuing.
In my opinion, as AgriEco is not so much related to Enterpreneurship as Business courses are, if you can convince the VO beyond reasonable doubts on your goals and how you plan to implement the course to your degree, maybe starting your own Agri Firm as an Entrepreneur lol.

Or you kuku find course related to your degree.

Let's start from the end. Heed to Lexusgs430 approach. With that said, you should have been in ACAS like yesterday (if not the
Employment Tribunal already) Ok, Keep Calm, it's ACAS first
PS: you already sound in the know already, so no need for details - link: ACAS approaching Employment Tribunal

Below is thoughtline on prima facie basis (information you've provided).
It is my considerate view the BRB is not the key issue, rather it is distraction.
PS: where is TheGuyFromHR

In ACAS _______
IN THE MATTER

Employee
AND
Employer

[Matter at hand]
Unfair labour practice: irregular and/or unlawful deduction of employee remuneration, withholding of fund

[Facts]
Employee commence employment on ___ Nov 2020 and employment on 27 Jan 2023: amounting to around 26 months of employment service.
Employer sponsors the employee's Skilled Worker (hitherto Tier 2 visa).
Employer is entitled to claw back visa costs proportionally if the employee leaves the services of the employer within 24 months from date of commencement (Policy #: policy name)

[Issues]
The employer is desirous of deducting illegally and/or irregularly (remuneration) monies due to the employee, albeit wrongly so. The employer, wrongly so, claimed the employee has failed to render employment service for a period totalling 24 months. The employee, rightly so, assert that s/he has been in the employer service for a period NOT LESS than 24 months. This, has satisfied the suspensive clause
... ... {provide verbatim the extract of the paragraph or section referring to visa cost, period and clawing back} ... ...

The employer now clutching at straw with irrelevant, inconsequential reference to BRP, which has no bearing to matter at hand, vis-a-vis period of employment service rendered and right to claw back visa cost. I reiterate, my employment service with the employer is more than the 24 months required of me.
The employer by her action or intending action is vexatious, and/or victimising the employee or making false accusations against the employee (regarding employment commencement) and/ or orchestrating/orchestrated constructive dismissal of the employee.
The employer by desiring or mandating Proportionality of the ‘penalty’ (the visa sponsorship repayment obligation) is acting improperly and/or disaproportionally and/or irregularly.
The employer insistence on claw back after is against the ethos of the Home Office. It amounts to illegality, compliance (visa sponsorship), and/or immigration abuse, and/or imposing a ‘detrimental obligation’ on the employee which is ‘out of all proportion’ to any legitimate interest of the employer.

The records of employment are duly in the records of the employer. The start date, resumption, salary payment for November 2020 ...

[Relief / Desire Outcome]
The employer is not entitled to claiming back or clawing the amount of £3, 779, or any other amount in respite of visa sponsorship cost.
The employer be stopped or restrained from clawing back from the employee monies in respect of visa sponsorship in this matter.
The employer shall not Unlawfully deducts from employees wages

Further and alternative relief as applicable.

PS: advisory herein are not legal advice as contemplated in law
dubaiprince:
... ... I have a matter I plan to drag with my employer but would like to get suggestions probably from people with similar experiences.
I am on a tier 2 visa. I resigned from my current job giving them the required notice and the policy of the company says that they can claw back visa costs if I leave within 24 months of the issuance of the visa.
I joined the company in November 2020 on a tier 2 visa (the issue date on my vignette is 6/11) and this Friday would be my last day meaning that would make it 26 months. I however got a letter from the company saying they will claw back £3,779 being visa cost saying I was issued visa on 6/02/2021 which is the production date of my BRP . The BRP was delayed due to technical issues Experienced by Home office during covid (this is supported by a letter from home office) and it was stated in the letter that I already hold a lawful stay in the UK that my employer could reach out to them via a link they provided to perform right to work check. I provided all these communication to my employer then.
It is known that issue dates on BRPs are based on actual day the BRP was produced, they are not back dated.
So my point is that my employer cannot use the BRP date as the issue date of my tier 2 visa. This is because I started work with them in November based on the dates on the COS and the visa I used to enter the UK which is 6th of November.
Please which body in the UK handles these kind of issues. I know of ACAS and ultimately employment tribuna

Thanks for following up. 🙏 Deeply appreciated.
The challenge is that practically all the news outlets are copy-and-paste on the same 'news'. The Port Health Services and the parent's FMoH even NCDC remained numbed. Worse, the Port Services was reported, about 2 wks ago, wanting to only embark on assessments by checking and deploying Rapid Diagnostic Test (RTD).
About two wks after, boom, no official statement or COVID site availability. Just the news outlets reporting .... quote of the Director with no definitive source! By this weekend or next week, all will be clear. First-hand reports will start to filter in.

@Geekseventplace. The honest advice is embark on #missionabort. The earlier the better.
You might not be aware, my style of writing is lengthy, opinionated and legalistic.
In your case, I wrote very brief.
Perhaps, I should let you know why.
The challenge I have, which is personal, is that I do not believe in the ọmọ ọọdọ̀ (house help) concept, whether in 9ja or 'saner clime'. Why? The probs is not having 'house help'. The probs, for me, is the attitude, the mindset. (Well, no wonder #BUGA was a hit song!!) Buga wọn init?

Reading through your #advert, as you've posted, I see and it is evidently clear to me that you were looking for the so called 9ja kind of house help. Not even a 'nanny'. For you, it's the ọmọ ọọdọ̀ of a thing.
You change of tact and trying to hide under the guise of Au Pair is that of someone that fits into ... ajá tó bá ma sọ nù, ko ni gbọ fere ọlọdẹ. Fade close.

Now, are there Au-Pair. Yep, there is. Are there people abusing the Au-Pair concept/program. Yes, there are. Why. Cheap labour by the 'host family', disguised immigration by the Au-Pair. As they say, two ge two. Both achieve their aim. Ko ba hakaba. A bi kín nsọ ni Ibadan tia tia.

Be it as it may, is it something you can do. Yes, possible. There are legal way to circumspect. Is it something you should do. Like I said in my earlier post, heck no.

In-btw, rather than refer you to well known and established Au-Pair, I'll use the same link: Au-Pair world to engage you.
For a moment, close your mind to the typical (I dare say the nonsensical) ọmọ ọọdọ̀ of a thing as practice in 9ja and some other places. Now with an open mind, read the expectation of an Au-Pair and the requirement of a host family.

You as a host family
- You have at least one child under 18 living in your household. ✅✔️
- You can provide your au pair with a separate room. ❔❓
- Your au pair should help with childcare and with light housework. ❔❓
- You speak English in your daily lives. ❔❓ (Truly, if 9ja Au-Pair, will you?)
- You have a different nationality than your au pair. ❔❓
- You give freedom for the Au-Pair to experience their world as a youngster ❔❓

Your Au-Pair (on the other hand)
- You are between 18 and 30 years old. ❔❓ You indicated below 50
- You are not married and have no children. ❔✔️ Possible what you desire
- You have a good knowledge of English and would like to improve your skills. ❔❓ Not really of interest to you
- You are entitled to apply for a visa. ❔❓❌🚫 You seek 'immigrants'!
- You are, depending on the visa, able to pay 244 - 516 GBP for the visa application. ❔❓ Doesn't seem of interest to you
- You can afford the travel costs. ❔❓ Not the profile you sought.
- You have enough money to support yourself without help from public funds, at least 1.890 GBP. ❔❓ Not the profile you sought. You want a dependent on you, at your mercy
- You desire exploring ❔❓ Doesn't seem of interest to you

So our dear @Geekseventplace, if what you truly desire is a live-in Nanny and you have urgent need, link: Indeed can assist you. . While at it, out of many options, link: Child Care can be assistive.

PS: As I iterate to people, 9ja probs is not even so much of President, (unaccountable) Governor ,and (career) politicians. The bulk is 'us'. What was that Obey song ... ẹyin ariṣe ninu madaru, ẹ jẹ lọ dawọ. Probs is, that ain't happening. Why, people enjoy and enrich in the chaos/mess

Let's say the contracting is condition upon clocking, and the clocking is structured on compulsory performance of duty between 9-5 (with no discretion of the contractor), then all points to #conflict.
If however the contractor has self discretionary control over their time-to-work (whether remote or on-site), then the dynamics changes.

How about if the 2nd Job is a contract role inside IR35 and the first job is a Permanent Job, Does it still count as a conflict?
Travel / Re: Living In The UK: Property,Mortgage And Related by semmyk(m): 9:08am On Jan 24, 2023
Property chain in itself, might be inevitable. Often, the seller is putting his/her/their property on the market for sale because (s)he/they are also buying another (primary) residence property (or off-loading a property to invest in another).
What then happen is that there are suspensive clauses. In essence, B put property Y on the market for sale. C offer to buy property Y from B. In tandem, B puts in offer to buy property X from A. If B's condition to A to buy A's property is that B's offer to purchase A's X property is that B MUST sell his/her/their Y property (whether mortgage or not mortgage), then you have property chain. There's a chain around property Y, which must be 'cut' before C can be successful in their purchase (outright or mortgage) of B's chained property. ⛓️
PS: there are other nuances of property chain.

I believe someone else will provide us all with a detailed breakdown/ explanation. @Gurus in the house, kindly assist.
Jojujewel:
... ... Please can someone please explain this chain/no chain term
Chain does not sound good or is it?
Thanks

Key Term for the week (well, maybe for the day!): #Commonhold
___________
Commonhold: A variant of freehold, where multi-occupancy building is subdivided into smaller, distinct freehold units on the same land. Commonhold was created by the Leasehold Reform Act of 2002, which overcomes some of the worst aspects of leaseholds. See Home Owner Association . NB: Referred to as Sectional Title in South Africa, Strata Title system in Australia, and in North America the condominium system.

In commonhold, you become a 'unit owner's. Own na own, e better pass lease! 😉
YouKay Gov talk am say, "... As a unit owner you have the opportunity to participate in the commonhold association and to vote on decisions like who to appoint as a director and whether to make building improvements, such as vehicle charging points, for example. ..."

In my view, you've received well articulated feedbacks. Each comes with its reasoning.
Bit of add-on.
For the FTC, you might want to explore with them flexible work arrangement. Perhaps along the line of flexible work hours based on deliverables (technically, this converts you to contracting. Sort of outside IR35). Kindly note FTC doesn't automatically implies contracting.
Legally, @Koonbey already articulated. If you're on Skilled Worker visa, you'll be breaching your visa.
Also, legally, employment are within Labour law, which falls under Civil. Hence, disputes between you and employer will not be in the trial court #criminal
Ethically, you are bound by non-maleficence (no harm) and beneficence (do good). By the way, that is broad!

kwakudtraveller:
... ... I'm just wondering if it's ethically sound to do so. Is there anyone who has held two full time jobs, how did you go about navigating both of them? ...
kwakudtraveller:
One is fully remote and one is hybrid. ... But how do people work full time and still do contract roles, is it not the same thing?
kwakudtraveller:
... I just realised that one is a Fixed Term contract, would that still be bad?
koonbey:
... ...
Legally, theoretically, nothing stops you from working a second job, as long as you’re not violating the terms of either contract. In practice, you probably will be ... ...
It’s a very bad idea, in sum. I’d say that you should focus on getting freelance work on the side to earn more. The risks outweigh the benefits here, but then high risk = high reward so feel free to do it. Sha give us updates o eventually make other people learn 😉.

- It is focused on freehold properties.
- It includes a short overview of how to buy a leasehold property – more detailed information is available in government’s How to lease guide.

I wonder if anyone has a general overview of developers, best ones to go for.
Iolo:
Persimmon, Redrow, Bellway are some of the largest developers in the UK with reasonably good quality. In terms of build quality I do think it varies on the development and sometimes on the property within the same development itself. For example, a persimmon home in Leeds may be rubbish but another in Colcester of good quality.
The key thing is to make sure you do your background work as much as possible, and once the deal is closed get a professional snagger to identify issues and get them to fix it.
New builds will typically come with a 10 year warranty with the developer directly fixing issues within the first 2 years of your moving in.

Nov 2020 Post from part 1 of living in the UK. See pp 431-432
nihilistjnr:
New Builds should be avoided as much as possible. Many of these developers are thieves.
For example, during this stamp duty holiday, new-build prices have gone up to swallow the money that buyers would have instead paid the government.
Same thing with help-to-buy, the 20% you get from the government has been priced into the cost of the house.

Pydroid 3 works on smartphones just like any other app.
In essence, Pydroid 3 is an IDE for writing Python programs on Android phones 🤳 📱 (without using a PC/laptop)
It is more for learning, educational purposes than it is for actually (commercial) development.

I'll recommend that you get a good micro SD card.
- Why: when you start to install python libraries/ packages, your storage starts to cry 😢
- How: try to get like a 128Gb memory card (or maybe 64Gb). Preferably, go for a U3 and not U1

To install additional libraries, packages, you also need to install the Pydroid Repository Plugin.
All the best.
[Edit] install from Google Play - https://play.google.com/store/apps/details?id=ru.iiec.pydroid3

Awesomely remarkable. Did a quick search. Interestingly, there are 'bodies' for intermediaries.
My opinion will be if engaging an intermediary, as part of DD (due diligence), verify if they belong to a body or are affiliated to a body for 'accountability'.
IMLA: Intermediary Mortgage Lenders Association - www.imla.org.uk/membership/members-list/
AIM: Association of Mortgage Intermediaries - www.a-m-i.org.uk/about-us/
dupyshoo:
Easiest way to find out about what each mortgage lender accepts is to search for the lender name with intermediaries. For example, searching for Natwest intemediaries will give you details about Natwest lending criteria.

Did a quick search. Interesting findings and learned new terminology AiP (adding to the list of key terms)

@Regex: I can't find anything from their site requiring one to have an existing account with them (Barclays) - www.barclays.co.uk/mortgages/agreement-in-principle/
As indicated by @Dupyshoo, it's best to go via a mortgage broker. Just ensure you engage with a credible broker.
Over time, I hope to curate a list of brokers mentioned on this forum. {Maybe, I could even ipe them to a list and do data analysis and ML/NLP on them! cheesy )

From www.barclays.co.uk/mortgages/help-to-buy/mortgage-guarantee-scheme/
"The government’s mortgage guarantee scheme enables us to offer 95% mortgages for first-time buyers and people looking to move to a new home – as long as they have a deposit of between 5% and 9.99%. It’s available for buying a property that will be your only home, and you’ll need to submit your mortgage application to us by 31 December 2023."
Well, apparently, the 95% LTV won't be available to those without ILR or residency less than 3yrs. Nonetheless, it's worth exploring.
I must say, without reading this and the 'email' response to @tshoboy, I won't consider Barclay for a mortgage. Hum, no wonder they say never judge a book by its cover!

dupyshoo:
Don't think so. Contact a broker to help with the application.
Regex:
Do I need to own an account at Barclays? I am on a work visa (5yrs), I have lived in the UK for 2yrs. How do I go about this?
tshoboy: :
Barclays can also do 90% LTV, but you should have stayed in the UK for three years and be on a work visa (or similar visa that has long term residency). Moneybox has a free brokerage service. You can chat them up and they will advise you based on your situation.

Hello All,
For those who have gone the route of purchasing their first property after moving to the UK, please I have some questions:
- Did you have to wait for atleast 2 years before purchasing?
- How did you go about finding a mortgage broker that was not asking for 25% deposit (this seems to be the norm for those of us without up to 2years residency in the UK)
- Now that Help to buy is over - what other options are available for first time buyers aside LISA that has a cap of £450k on property value?
Recommendations for brokers who have experience with immigrants witout ILR will be appreciated. We really need a guide o for newbies here please

Has anyone here been successful in buying a house with their student visa or dependent visa? With the amount I'm paying for rent, I think it's better to just buy a two bedroom apartment but I don't know how to go about it. If you have, the please help a brother out with some information.

I know this was discussed here late last year. The consensus was ... such a person should bone up and travel
In doing so, (s)he must go along with
- expired 9ja passport
- 9ja embassy slip (confirming capturing)
- ILR card
Based on further posting, (s)he should also print the status from the NIS passport tracking site.
PS: I do not have first hand experience of this.
Lexusgs430:
He can travel with his expired passport.........
https://guardian.ng/news/nigerians-with-expired-passport-can-return-home-nis/
[Extract from article]
You have to show that you are a Nigerian, that is why we say they can come with their expired passport. Dual citizenship means carrying two passports.
The whole essence is that when they arrive, they must renew their Nigeria passport before going back,” the NIS spokesman added
.
Osoderi:
..., but he was told till March that was the date that was written on the bottom paper he was given. he was shocked, bc he wants to travel for his dad burial around Feb.
pls is it possible for him to travel with expired passport? he has his indefinite leave residence card. pls kindly advice what is the best option to take. Thank you.
