Many people thought Buhari is trying to increase VAT because of himself or FG, but the truth is only 14% of VAT goes to FG while 86% goes to state government and their anex LGA

Its obvious that the state Government beged for the increase in VAT so as to be able to Pay the new minimum wage and salary structure review

Its the State and Local Government workers i pity, should Money bill not scale through some Governors would simply pay political apointees salary and do constructions to steal for themselves and completely forget about workers salary since Federal Allocation cant cover wage bill

I thought ours was a written constitution yet most of our politicians don't seem to seem what is written inside of it.....to sum it all, this country is just lost in vision and direction. .May God help this country.

With due respect, I want to say that Femi Falana is needlessly jumping the gun. Even the article itself made it very clear that the new VAT regime will only come into effect in 2020 after nationwide and multilayered consultations followed by amendment of the relevant laws.

So why the ALARM?

He is saying you cannot preempt the approval..

You have to get the approval before you start making stupid announcements.. cool

Getting approval before "making stupid announcements" is putting the cart before the horse. It think the current arrangement is more logical: doing proper homework before approaching NASS for necessary amendments. Mind you, based on feedback from consultations the proposed percentage increase of VAT could be adjusted down or even dropped.

Human Rights Lawyer, Femi Falana, has called on the Federal Government to propose a Money Bill to the National Assembly before the implementation of the increase in Value Added Tax (VAT).

Falana told the News Agency of Nigeria(NAN) in Abuja, said that the National Assembly (NASS) erred by inviting the Minister of Finance and the Executive Chairman of Federal Inland Revenue Service (FIRS) to clarify issues of VAT increment.

According to him, provisions of the constitution states that the President ought to have presented a money bill to be passed by the NASS before the increment.

“It’s illegal, under a democratic dispensation you cannot impose tax or increase tax without a law made by the National Assembly or the State Assembly as the case may be.

“In this case, it has to be realised that we are not under a military dictatorship.

“By virtue of section 59 of the Nigerian Constitution, any increase, levy or tax will have to be presented to the National Assembly by way of money Bill by the President, it has to be passed into law.

“The Senate erred in law by inviting them to come and clarify, the National Assembly has invited the Minister of Finance and the Federal Inland Revenue Services to come and clarify.

” No, the National Assembly must insist on its powers under Section 59 to pass a law to increase VAT or any tax, there can be no taxation without a legislation.

“The Federal Executive Council has no power under the Constitution to increase VAT or any tax in the country,” Falana said.

NAN recalls that the Federal Executive Council had last Wednesday approved the increment of VAT from 5 per cent to 7.5 per cent.

The Minister of Finance, Budget and National Planning, Mrs Zainab Ahmed, had explained that the increase would only begin after the VAT Act was amended by the National Assembly and after consultations with the state and local government areas as well as the Nigerian populace.

According to her, our projection is to finish consultations early enough so that it takes effect in 2020.

She further disclosed that the FEC approved the Medium Term Expenditure Framework and Fiscal Strategic Paper, MTEF/FSP for 2020 to 2022, which will guide the 2020 Budget.

The Minister also said the next step was to present the document to the National Assembly for consideration.

Falana goofed in this case. The VAT decree 1993 specifically empowers the VAT technical committee of the FIRS to determine the rates from time to time as appropriate. It does not require a separate legislation to be enacted.

Some headlines are misleading against the government, then you read the article only to discover the contradiction. Falana was used to in the headline instead of using the Minister of Finance. The presidency through the Minister already making the right moves, then Falana taking advantage of the gullibility in the National Assembly by saying the same thing as the Minister. Everyone trying to be relevant because we have funny people in the National Assembly

VAT is a consumer tax charged for luxury goods and services. Therefore increase in VAT does not affect the poor but the rich who consume luxury goods and services.

So, make una all relax una nerves. grin

What mr falana saying was correct, most of us have a text messages from our different bank, stating effect of cashless policy from 17th of September. How can they still claim it not yet effective when banks has started to make deduction.
