Now back to 2020, we moved to a new apartment as the former apartment where we've lived as a family for 18 years was about to demolished and the landlord gave us ample time for everyone in the apartment to move out.

We moved to this new apartment around July 2020 and we paid for 2 years upfront rent about 850k (350k yearly rent x2 plus agent and commission 150k) which means the rent is supposed to elapse June 2022.

Now before then, the landlord has been disturbing my father long before our rent was due that he wants to use our current apartment and that we should move to the next door apartment.

The apartment next door is 200k rent while ours is 350k
Ours is way furnished, tiled and more habitable than the other.
My dad refused after much in-house deliberation with me, my mum and my younger one and he outrightly refused.

By June 2022 weeks before our rent was due to expire, my dad paid for the rent for this current apartment where we are of which this man brought the issue of us moving to the next door apartment. My dad said he's not interested in moving to the next door apartment that it's not done and the man said no problem that our rent is no longer 350k but 400k.

I'm not sure if he paid the extra 50k tho but I outrightly remembered when he asked the man that if he didn't agree that the man should refund him the whole 350k and he sent his account number

Well, that means my dad paid which means our tenancy agreement is to run from July 2022 to June 2023 as he didn't send the money back to my dad account and receipt was issued.

Now, I just got home from nysc and lo and behold, I saw the landlord discussing with my mum of which he issued a quit notice letter to us dated 20th of December of which the letter states that we should move out on or before june 2022 and please remember our rent is supposed to expire June 2023

Now, I want to ask question
Is quit notice given when rent is not yet due
Is quit notice not suppose to be 6 months after it has expired.

Please, the location of the apartment is in lagos
I would appreciate any advise and if we can chase this legally cos the next door apartment is way below standard and when we told him that since the past tenant who just happened to pack out officially last week are paying 200k, we see no reason why we would pay 400k for that apartment.

Just saw online that quit notice should only be given after the expiration of your house rent. Meaning that our quit notice should start counting after June 2023

According to what you posted, it says tenant can be "ejected" after the rent expires.
It doesn't say quit notice should be given after the rent expires.


But let us wait for other inputs.

from what I know for a one year tenancy your are given 6 months to quit and can be given when your tenancy is still running this means as regards your case the notice is counting already.

The landloard already showed he didn't want your family in his property anymore your dad wouldn't have renewed his tenancy. I'll advise your family start looking for another property now and leave as the notice states. No need for all the unnecessary stress and trouble.

The tenancy law you are quoting here is old. Once your rent expires in June 2023. He can give you 7 days notice and show documentation that he is no longer interested in renewal

Jeremy, don't put yourself under any pressure.

Be grateful that you are still alive and healthy. People travelled and died, some have bad health issues that takes triple the amount of the rent you are talking about.

My dad even offered to pay higher
He only wanted us to move to the next door apartment at the current price of this one.

It's not fair at all
This place where we are was tushed to our standard, the tiles, the pop and everything
The next apartment doesn't even have half the quality of things in our own apartment that we literally installed to our own taste.

Apartment of 350 to another of 200k

We should then take the one of 200k and pay 350

How?

The man has not ejected you yet. He is just telling you to vacate his property at the expiration of your rent.

Why do you want him to give you quit notice only when your rent expires, won't you pay for that period of notice? Most people who have this your mentality usually think that the notice period should be rent-free.
