Every one in the Developed world understands that the Govt of the day whether through their Party or not, to unimaginable or low levels is an enemy of the citizens. Some countries founders long before their death planned to safeguard their offsprings by creating a counterbalance ~ a law that's unchanged that grants the citizens Rights to bear arms, such as the US Second Amendment: [i]The Second Amendment of the United States Constitution reads: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed." [/i] Now, the people who Nigeria were handed over to never in their widest imagination forsaw that a day will come when no. State actors like UGM, Boko Haram, Oduduwanistan secessionists etc would ATM themselves and fight the govt and the people! Neither did this same set of people foresaw that a day will come when the govt would muscle free speech or criminalize what should at worse be a civil offense! Or is it that they're just "BLACK" in thinking, in behavior and in understanding? Or possibly they Plan to always be in power, because such anti people laws will continually favor them! A lot of people are languishing in prisons, in remand centers through bogus, uncivilized law that gives power to the government to arrest, detain, charge and commit to prison anyone accused of "cyber bullying"..... Do these people actually understand the meaning of Cyber bullying? Ijele is still in prison for a civil offense, which could be sorted out in the courts while the poor dude continue his work, if actually he had one, and If culpable, made to pay fines to the Govt and also, to the victim. This is after both parties have proved their points! Noo....we are black and once we have Power, it's in our nature for dissenting opinions to stop! You're enjoying that law today, one day it will be used against you or your offsprings! This is the law I'm talking about: Sections 24(1)(b)(2)(a)(i) of the Cybercrimes Act, 2015, and Sections 374 and 375 of the Criminal Code Laws of the Federation of Nigeria, 2004. We will focus more on this law in a Prime Time show we are launching next week in Kigali Rwanda and also in Brussels Belgium in late June: NIGERIA TODAY with Bigkoko! Just imagine the impudence, open legal foolishness in asking a probably jobless TikToker to bring 100M NGN for bail while Sirika who stole billions, committed crimes against 200+ million people is asked for same bail bond! Them swear for Nigerian judges abi na follow come curse be this one! This is one law HE Peter Obi MUST work hard to repeal because it actually targets the Common man, the poor people whose saving solace is the Social Media, otherwise, without Abido Shaker shockers from dramas coming out daily in Nigeria, many people for don commit suicide especially those old, jobless, skill less nairaland residents! We shall be commiting significant resources to see this law repeal once PO gets elected and sworn in! Excerpts from a Post here on nairaland! Police arraign two Tiktokers for defaming Lagos monarch, Oba Elegushi Two Tiktokers – Adesola James and Odunmosun Awiye, were on Tuesday arraigned before the Federal High Court, Lagos State, for cyberstalking, illegal publication and defamation of character against the monarch of Ikate-Elegunshi, Oba Saheed Elegushi. The defendants, known as Arifanla Jogun Omo Odo Agba and Okiki-OshunT, respectively, were arraigned before Justice Abimbola Awogboro on four counts bordering on conspiracy, cyberbullying and defamation. The police prosecutor, Nosa Uhumwangho, told the court that the duo committed the offences between December 2023 and March 2024. Uhumwangho said James and Awiye illegally and unlawfully published audible sounds through their Tiktok platform known as ‘Arifanla Jogun Omo Odo Agba.’ He also told the court that apart from using their TikTok handle to commit the offences, they also used other social media handles such as WhatsApp and Facebook. The prosecutor further told the court that their actions caused insult, injury, criminal intimidation, hatred or needless anxiety to the monarch and the people of the Ikate Kingdom According to the prosecutor, the offences committed are punishable under Sections 24(1)(b)(2)(a)(i) of the Cybercrimes Act, 2015, and Sections 374 and 375 of the Criminal Code Laws of the Federation of Nigeria, 2004. However, James and Awiye pleaded not guilty to the charges against them. Following their not-guilty plea, the prosecutor asked the court for a trial date and urged the court to remand the defendants till the determination of the charge. However, the Tiktokers’ lawyers, P. O. Gongo and Elias Nwagiugwu told the court that they have filed their clients’ bail applications, which have been served on the prosecutor. They urged the court to admit their clients to bail in the most liberal terms. The prosecutor admitted being served with the bail applications and informed the court that he was not opposing it, but urged the court to use its discretion in granting the bail applications Consequently, Justice Awogboro, in her ruling on the bail applications, admitted each of the two Tiktokers to bail in the sum of N100 million, with two sureties in like sum. The judge also ordered that the sureties must be blood relations to the two defendants, who have paid three years tax, and with means of livelihood. The judge, however, ordered that the two Tiktokers be remanded in the Ikoyi Correctional Centre pending when they can perfect their bail terms. She adjourned the case till June 4 and 5, 2024, for further hearing. |
