An Ikeja High Court on Monday discharged and acquitted a 29-year-old man, Ibrahim Yusuf, charged with killing a Lagos State Traffic Management Authority (LASTMA).

Yusuf was accused of killing one, Mr Olatunde Awotola.

Justice Oyindamola Ogala, in her judgment, held that the prosecution failed to prove two counts charge of involuntary manslaughter and causing grievous bodily harm on the officer on duty.

Ogala said there was no documentary evidence presented by the sole prosecution witness. He added there was no evidence to show that the incident was reported at a police station.

After considering the entire evidence, the prosecution failed to establish all ingredients of the offences.

The defendant is hereby discharged and acquitted,” she said.

The State Counsel, Mr Ola Azeez, had presented a prosecution witness in the case, while the Defence Counsel, Mr Bidemi Ademola-Bello, represented the defendant before the judge for verdict.

The prosecution had alleged that Yusuf attacked the official when he was trying to arrest him on Feb. 12, 2022 in Kosoko Ojodu, Lagos.

The prosecutor also alleged that Yusuf ran into trouble when he obstructed vehicular movement along the route and the LASTMA officer tried to impound his vehicle. The accused was alleged to have reached for a knife which he used to stab the victim in the head and neck, abandoned his vehicle and took to his heels.

According to the prosecution, the alleged offences violate Sections 224 and 251 of the Criminal Laws of Lagos State, 2015

Nigeria system of government is a joke 🤣 you can take someone to court without credible evidence and they won't *FINE* you... That's why you see different irrelevant case files in court.

Chai! It means Yusuf Ibrahim actually murdered somebody but due to the prosecution handling the case poorly, the criminal was asked to walk away freely by the court! Not the first time in Nigeria anyway that prosecution counsel would handle a confirmed murder case poorly and the court/judge would be given no other choice than to free the "accused".
The one who killed a person in Lagos state, dismembered the body and dumped it trash plastic was eventually freed by the judge when he was brought to court for hearing on three different occasions but the prosecution didn't turn up on those occasions

Evidence would have been a video, a knife and either DNA or fingerprint etc. Someone could have bungled the case

I reckon LASTMA went to court arrogantly believing that the court would rely on their word of mouth or paltry evidence and rule in their favour.

Like I always say, make sure you are not the guy who dies.

It is clear to the blind and audible to the deaf say, no be today aboki blend chosen. Not even a govt issued uniform can assure ur family of justice wen ur assailant is a chosen. Even an eyewitness account on a knife attack is not evidence enough against a chosen! Na wa…. Nigeria is so easy to defend….. when Nigeria is yet to happen to you. undecided

So the summary of the case is that the motorist allegedly stabbed the LASTMA official who wanted to arrest him, took to his heels and there was no evidence to tie him to the death of LASTMA official eventually? 😲

This is the man Vs Lagos state government I guess, so I don't think it has anything to do with money exchange hands.
If that's the case, then it would have been in favor of the decease.

Why won't he be discharged and acquitted, of course he is untouchable. If he were to come from the east, it would have been a death sentence. Why will someone take another man's life and run away to save his own life. He that lives by the sword shall die by the sword..

Money? Did you read what the judge said? If you were the judge, would you sentence an accuse just like that. The easiest thing to obtain in Nigeria is the police report, they didn't even have that! Medical report? No. Autopsy which is the most important thing? No. And they provided only one eye witness. Lol.
