MacDaddy01: i do not think you can compare the catholic organization or any other religious organization or even confraternity with corporate body. The catholic church and religious bodies operate under charity, NGO and non profit organization laws, that is why they get away with anything. They do not pay tax even for commercial undertakings. Priests are more like members of the organization than employees. That is why they use the word excommunicate rather than sack or termination of employment. Excommunication simply means any other member is not allowed to communicate with you, and any member can be excommunicated. Even at that you cannot compare laws made when Europe was under the tyranny of the church to modern day realities. Most of those laws have lost their relevancy as priest(catholic, protestants and even word of life Christians) openly break celibacy and funication rules, without any fear of excommunication. |

wirinet: WRONG. Just wrong. Is there a separate employment law for NGO's and charities? No. The point is simple. You enter an employment contract and it is binding. The rules of the christian schools do not violate ones human rights. It is foolish but not illegal. No pre-marital sex. Even in certain sports camps for certain durations, the sportsmen are not allowed to have sex because it is a distraction. If they do, they are kicked off the team or suspended. By the way, excommunicated is broad term that could include suspension or banishment. The excommunicated Rev. Fathers cant work in any catholic organisation. |

MacDaddy01: yes, NGOs, charity organizations and religious bodies do not operate same employments laws as normal business entities. They operate on a membership basis. So they can loose membership status by going against the status of their membership. For example an osun worshipers can loose membership status by refusing to bath in the osun river, likewise, you can loose nairaland membership status simply by insulting Seun. Having an employment contract is a different thing altogether. You and your employer have to abide by legally acceptable laws - both internationally and local. Same with sports, it is run on a volunteer basis. But in instances where there is a legal employment contract, you cannot be sacked for bridging house rules, you can only be suspended from playing games. Ask ballotelli or tevez |

Another good example is the shola ameobi's case. He signed a contract that he would not play for Nigeria. Now if he decided to bridge the contract and play for nigeria during the last nations cup and newcastle sacks him, he can take newcastle to fifa, and fifa would have definitely pronounced that section of the contract illegal, null and void, so the sack would have been illegal despite signing a contract. I hope you understand that not all signed contract is legal. |

Tevez could have been fired from his job for public disrepect of the manager's instructions and speaking ill of the club. It is in his contract. Footballers are employees as well. Tevez is worth more playing for the club or being sold than being fired for breach of contract. |

The problem is she would not have the time and resources to go all the way to the supreme court just to get her meagre teacher's salary paying job back. A lot of people in this thread makes me laugh. I hope they get good lawyers when signing agreements instead of charge and bail lawyers, A lot of agreements are not worth the paper they are written on in court. There is something called hierarchy of laws, the lowest on the ladder being contract agreements and local laws while the highest is the constitution. A law or an agreement can be annulled, rendered null and void if it conflicts with a higher law. It does not matter that the agreement is signed by both parties or the law is duly passed by the local, state or national assembly. Let me give you people the best example. Before Goodluck Ebele Jonathan was allow to be nominated as the presidential candidate of the PDP, he was made to sign an agreement that he will run just a single term and then hand over to a northerner, he happily agreed both verbally and literally. And so the rest is history as he won the election and was sworn in as president. Now 2 years later, Mr Jonathan seems to have change his mind as he is gearing for a second term. So how will the governors enforce the signed, sealed and delivered agreement? They can't. If they dare show the agreement in court, the judge would throw their case out, probably with insults for wasting his time. Because the agreement is illegal in the first place. The constitution provides for two terms for the president, not 1, not 3, but 2 terms. The governors might as well as Jonathan to sign for a 3 term tenor. So now the governors have realized they are holding a worthless piece of paper in the name of agreement. The agreement has only moral value and not legal value. So as i have tried to tell you guys not all agreements can be enforced legally, so shine your eyes before signing agreement. Another difficult agreement to enforce is adoption agreements, but i would not go into that now. 2 Likes |

^^^^ GBAM! Some legal agreements have only moral values and not a legal value, they will simply be thrown out of court. Chei. LOL this is soooo true! I got involved in one Legal brouhaha towards the end of 2012. Major stuff with one of our clients, and I finally got to understand the above. I won't go into details for privacy's sake but even though our company lost money, I kind of respected how that client's lawyer twisted things around for their benefit - based on tiny holes in the agreement. That client's lawyer was one smart one like that, I found out. After the dust had settled, I found out more about her. Story goes that once, when she had a case that she knew she couldn't win, she researched and found out the presiding judge is an elderly man who does not like paperwork and lots of details: they drive him crazy. So she got some lawyers from her court to follow her to court with large books and sheaves of paper and cartons of seeming evidence. Immediately the judge saw it, he adjourned the case for some months. In that time, that lawyer was able to get her client to settle out of court with the plaintiff. Lesson: Ironically Law is not all black and white. |

I was going to make the same point that wirinet just made. Just because a contract is in place that doesn't seal the deal. A contract can be declared to be unfair if it breeches certain human rights or comes into conflict with other laws. I studied constitutional law in the states for half a year and I remember there was a never-ending conflict between state law and federal law. Even in the UK there are a few examples of contracts or statutes that have been revised or changed because they conflicted with the EU laws on human rights. So it isn't certain how this will turn out. Nevertheless, I personally would never have signed such a contract if I knew that I wasn't against pre-marital sex. |

MacDaddy01: All that matters is the contract the teacher signed. No premarital sex. Period.that is the main bone of contention here, there is really no way of knowing that a man is engaging in premarital sex, except he is caught red handed with pictures to prove it. |
