The Court of Appeal on Tuesday affirmed the inalienable right of Nigerians and asscociations to hold rallies without police permit.

The court upheld the judgment of a Federal High Court which had, in June 2005, declared the Public Order Act, (Cap 382) Laws of the Federation of Nigeria, 1990, which requires Nigerians to obtain police permit before holding public rallies.

The Act makes it mandatory for individuals or groups to apply for and obtain police permit or approval to hold rallies and peaceful assemblies.

In its judgment, the appellate court, presided over by Justice Danladi Mohammad, held that such police approval infringed on the fundamental human rights of individuals and groups provided for in the 1999 Constitution.

“The provision of the Act are unnecessary. We are in a democracy and Nigeria has joined the league of civilised society,‘‘ Justice Olufunmilayo Adekeye, who read the lead judgment said.

The other member of the panel who gave a concurring judgment was Justice O.F. Omoleye.

The panel gave the judgment in an appeal by the Federal Government against the decision of the Federal High Court, Abuja.

The high court had, on June 26, 2005, voided the Act while giving judgment in a suit initiated by 12 political parties under the aegis of the Conference of All Nigerian Political Parties.

Justice Anwuri Chikere also issued an order of perpetual injunction restraining the Inspector-General of Police from preventing aggrieved citizens of Nigeria, including the plaintiffs from organising or convening peaceful assemblies, meetings and rallies against unpopular government policies.

According to her, the court held that the provisions of the Public Order Act (Cap382) Laws of the Federation of Nigeria (1990) were in conflict with the provision of Section 40 of the 1999 Constitution.

D simple question to all doz castigating Amaechi on dis is "how many of u collected ur appointment letter via email"? If d govt wants to celebrate giving 13,000 people job,is there anything inherently wrong wit it? Despite ur hatred for Amaechi, we should be unanimous in condemnin dis police commissioner. He should be warned to desist from unnecessarily antagonising d state govt.

For me, i am from rivers state, i wont vote jonathan cum 2015 coz jonathan have not done anything to justify anyone's vote cum 2015 from any right reasoning nigerian. As for me I do not really care about rivers state - no be the same Niger delta? As for me and my house no more no shoe man. my wife and voted for him, my brother campaigned for him for free - even when there was a risk to his life - but now... no more! I'll vote for anyone but Jonathan!

I think we are being unduly critical of Governor Amaechi here. Most states in Nigeria are yet to embrace the use of the internet for easy administration. In my state, the government advertised a teachers' recruitment exercise. Ten thousand applicants were made to report at the Teaching service commission to obtain application form as after parting with N1000 each. You needed to see the venue on that day. I had gone there to obtain the form for my cousin who was not in town then. When I got to the venue, I simply turned back. The young man traveled all the way to Lagos to obtain the form. It took him three days to be able to accomplish this task! Shortly after the same government advertised recruitment into the civil service. Again all applicants had to travel to the state capital to obtain the form. As in the previous case, thousands came out and the entire area became a war front of shoving and pushing. Yet at the end of the day, months after, no single person has been employed! I think Amaechi's case is better. At least these ones were to collect appointment letters. Now that the Police has stopped the exercise, l;let's see if they will be absorbed into the Nigeria Police Force.

Who's going to send the 13,000 emails? oh wait bulk email? By the time all the teachers receive their letters at once, where in the secretariat will house say 6 thousand that comes on the first day? because we all know with the employment issues in Nigeria, an email to 13,000 people that they have been employed will be responded to on same day.


GEJ supporters are dumb, stupid geeezz!!!
And is it a taboo to attach specific date and instructions to the mails, where and when the recruits should come for orientation or resumption ?that is if there is any..........my friend take your cave man's mentality to the gutters you guys need functioning brain cells.....FYI i'm not a GEJ supporter ,i'm a realist.

Are these not the same teachers SUPPOSED to have been

- recruited in June and
- trained since August

so they can resume at their schools this month


wealthyprince: Newly employed 13,000 teachers in Rivers State will commence training August 5 at designated centres across the state. The 13,000, comprising both indigenous and non-indigenous applicants, were selected outof about 60,000 who went through written and oral examinations run by consultants. While the Joint Admissions and Matriculation Board, JAMB, conducted the written examination, global recruitment outfit, PricewaterhouseCoopers conducted the written stage of the recruitment exercise andcomputed the candidates’ assessment and final recommendation to the Rivers State Ministry of Education. Another consultancy firm searched the candidates’ academic and other pleaded credentials with relevant examination bodies.
Speaking to The Neighbourhood reporter on Friday in Port Harcourt, Dr. Richard Ofuru, the Permanent Secretary Ministry of Education said the training will be de-centralised but will run simultaneously. “The training of the new 13,000 teachers will commence August 5,” the Perm Sec stated, adding that letters of postings would be issued to the teachers in the course of the training.
The Neighbourhood gathered that not all whose names got shortlisted turned up at the State Universal Basic Education Board, SUBEB, and the Senior Secondary Schools Board, RSSSB, during the deadline for the submission of academic credentials conducted at the respective Boards. An unofficial source disclosed that replacements were being recruited by the consultants.
The new teachers are expected to be at their places of posting soon as schools re-open after the long holidays in September.

Why will people hide behind their computers to spew rubbish. Individually Nigerians re advanced but collectively we re still way behind. When some people mention we re in supersonic age? Has anyone received anything organized by Govt online? ? from jamb slip even first school leaving cert. Maybe ur Nysc call up letter was online or discharge cert. What is it. Incase u don't know Lord Lugard typewriters are still used in d ministeries in this age of computers. So pls give d governor some slack. This is how we re. politics apart we have not gone digital.

This Amaechi dude is a political strategist.
He deftly played GEJ and the CP for fools.

For those of you who do not realise it, there is nothing that stops them from issuing the letters at the LGA levels, but Amaechi knew that to ingratiate himself and paint GEJ black with the people he has to force GEJ to commit an error.

Thus, the massive publicity given to the event, then seeding the intelligence community with a rumour of a protest to galvanize them into action.
Hook, line & sinker, the CP and GEJ swallow the bait..... the rest as they say is history.

13,000 new enemies(+ family members and friends) for GEJ
Political capital for Amaechi.
Anger at the CP for trying to destroy the economy of rivers state and her people(teachers)... etc, etc.

Reports on social media and Nigeria Info station, 92.3 FM, a local radio station in Port Harcourt indicate that the Rivers Police Command today stopped the Rivers Government's newly recruited 13,000 teachers from collecting their posting letters.

The baffling action of the police took place at Liberation Stadium on Ken Saro Wiwa Road in Port Harcourt, where, owing to the teeming number of people involved, the Government had sensibly staged the posting letters collection event.

It's still unclear why the police stopped the new recruits from collecting their posting letters, but going by recent unsavoury events in the state, there are now palpable fears that Rivers State is now effectively under a police-supervised Gestapo rule.

Or better still, a state of emergency has been unofficially declared in the state. You will recall that there has been a political stand-off between President Jonathan and the Governor of Rivers state, Mr Chibuike Rotimi Amaech.

People are now at a loss as to why the police will be so compromised to stop legitimate functions of government and infringe on the fundamental rights of residents of the city of Port Harcourt.

There's yet no official response from the police.

But seriously how much is Ameachi paying you to run your mouth like this?
