The Appeal of Barry George, convicted last July of the murder of TV Presenter Jill Dando, will be heard on Monday July 15th, in Court 4 at Royal Courts of Justice. The Lord Chief Justice will preside over the Appeal proceedings.

MOJO has grave concerns over the safety of the conviction of Mr. George, having supported Barry and his family throughout the trial process and through to this Appeal.

Mr. Georges defence team, led by Michael Mansfield QC will challenge the identification and scientific evidence which was presented by the Crown at the trial.

The prosecution sought to turn non-identifications into positive identifications thereby turning totally negative evidence into positive evidence - an approach which conflicts with the background of the safeguards of the Police and Criminal Evidence Act procedures for identification parades, and the Codes of Practice governing them.

This will be an important principle for future cases where similar identification evidence becomes an issue. An important fact to bear in mind is always the inherent danger that this type of evidence greatly increases the real risk of a miscarriage of justice.

Similarly, the appeal will look closeley at the scientific issues and question the provenance of such evidence going before a jury. Contamination, police exhibit procedures and the integrity of the vital exhibit will be re-examined.

This Appeal will reveal the pollution of justice that has ocurred in this case and will demonstrate the exceptional efforts that have been made to identify them. Anyone who has a genuine interest in the administration of fair justice should follow the Appeal closely. There are lessons to be learned, MOJO has been educated and we consider we have been privileged to be able to offer our service and support to Mr. George, his family and the defence team.

As with all similar cases, our thoughts must also lie at this time, with the family of Jill Dando for whom these proceedings will be a painful reminder of their tragic loss. "Justice for Jill" is important to everyone.

Dando case judge wrong on admitting evidence, says Michael Mansfield QC

Lawyers acting for the man convicted of murdering TV presenter Jill Dando will make sweeping criticisms of the trial judge at the appeal court on Monday, claiming crucial evidence should not have been put before the jury and that the guilty verdict is unsafe.

Michael Mansfield, QC, will argue that Mr Justice Gage, who presided over last year's Old Bailey trial, should not have allowed the prosecution to include forensic material or the testimony of four witnesses who partially identified the defendant Barry George at video ID parades.

The appeal against conviction is based on legal and procedural grounds rather than fresh evidence and could lead to George being freed or a retrial.

Since George has been in jail he has been recorded at length by two other inmates talking about the murder. During one conversation, he confesses to being at the scene in Fulham, south-west London, when the shooting happened - he claimed at the trial he was at home and had never heard of Jill Dando.

However, the crown prosecution service has decided not to include the tapes in its submissions to the lord chief justice, Lord Woolf, who will be sitting with Lord Justice Henriques and Lord Justice Curtis.

Orlando Pownall, QC, who led the prosecution team, be lieves the case is sound and does not need bolstering.

Last July George, 42, was convicted of murdering Ms Dando on the doorstep of her home in Gowan Avenue, Fulham, on April 26 1999. She was killed in daylight with a single shot to the back of the head.

The death of the presenter, who was engaged to be married later that year, led to one of the biggest murder investigations ever mounted by Scotland Yard.

The police team, led by Detective Chief Superintendent Hamish Campbell, struggled to establish a motive or identify serious potential suspects until a review of many thousands of tit-bits of information from lthe public - put George in the frame. He was arrested in May 2000.

The police case was built around two firm sightings of him in Gowan Avenue on the morning of the murder and a minute particle of gunpowder residue found in an inside pocket of a blue cotton jacket recovered from his flat.

This matched tiny particles found on Miss Dando's clothes and on the back of her neck.

George's lawyers will tell the appeal court that Mr Justice Gage should not have allowed the forensic evidence to be put before the jury because the jacket could have been accidentally contaminated when it was taken to a police photographic studio before being examined by scientists.

The judge ruled that the jacket was admissible and left it to the jury to assess whether the possibility of contamination - fiercely contested by the prosecution - was real.

He also allowed the prosecution to call the four witnesses who could not conclusively identify George during face only video ID parades. George refused to take part in all but one live line-ups - these are the normal ID parade procedure. Using the video technique, four witnesses said they could not choose between the second face on the film - George's - and the eighth.

Mr Mansfield will also say that the "lurking doubt" about the safety of the conviction - based on what he regards as the fragility of the prosecution case - is another reason for the appeal court to free George or order a retrial.

George has always denied murdering Ms Dando and police have never been able to establish his motive for killing her. But following his conviction last July, it emerged that George was a fantasist who for years claimed to be the cousin of Freddie Mercury, lead singer of the pop group Queen, and to be a former SAS soldier.

George had a history of pestering women, had a spent conviction for attempted rape, and an obsession with guns. He was once found hiding in bushes at Kensington Palace, carrying a rope, knife and a poem addressed to the Prince of Wales.

The appeal is expected to last four days.

London: Barry George was cleared on Friday of the murder of BBC presenter Jill Dando after a retrial at the Old Bailey.

His defence lawyer William Clegg had argued that the 48-year-old lacked the skills, ability, motive and expertise to have committed such a crime.

George is expected to be freed later after eight years behind bars.

Dando, 37, was shot at point blank range with a gun pressed against her head on the doorstep of her home in Fulham, west London, in April 1999.

Her murder shocked the nation and prompted one of Scotland Yard's biggest murder investigations.

Crown Prosecution Service lawyer Hilary Bradfield said it was right to bring the case, despite the not-guilty verdict after an eight-week trial.

Before arresting George, detectives examined a wide range of theories. One was that she was killed by a Serbian, angry that she had presented a TV fundraiser for Kosovan refugees.

Others suggested she was killed by an ex-lover or by an underworld hitman for her work helping the police on the BBC's "Crimewatch".

George, who stalked women and took thousands of photographs of them as they walked home, was first convicted of her murder in 2001. He lost an appeal against his conviction in 2002.

Dando was one of the most popular figures on television and thousands of viewers turned out to pay their respects at her funeral in her home town of Weston-super-Mare, Somerset.

She was engaged to gynaecologist Alan Farthing at the time of her murder.

July 2, 2001: George is jailed for life after being found guilty of murder.

July 29, 2002: The Court of Appeal upholds the conviction.

December 16, 2002: The House of Lords rejects an appeal by George against that decision, saying the evidence was "compelling".

September 5, 2006: BBC's "Panorama" says a new interpretation of the forensic evidence casts doubt on George's conviction.

June 20, 2007: Criminal Cases Review Commission refers the conviction to the Court of Appeal.

November 5, 2007: George begins second appeal.

November 15, 2007: He wins the appeal and gets a retrial.

August 1, 2008: George is cleared of murder at the Old Bailey.

BRAZILLIAN MAN KILLED BY INCOMPETENT BRITISH ANTI TERRORIST OFFICERS

The man mistaken for a suicide bomber by police was shot eight times, an inquest into his death has heard.
Brazilian Jean Charles de Menezes, 27, was shot seven times in the head and once in the shoulder, at Stockwell Tube station, south London, on Friday.

Det Insp Elizabeth Baker revealed the details at a hearing in London.

Security sources said Mr Menezes had an out-of-date visa, but his family denied this. Foreign Secretary Jack Straw said he believed he was legally in the UK.

Mr Menezes' cousin, Alex Pereira, who is based in London, said the police would "kill thousands of people" if they were not held accountable for what had happened at Stockwell.

He said: "They just kill the first person they see, that's what they did. They killed my cousin, they could kill anyone."

Brazilian media reports say British human rights lawyer Gareth Peirce is acting as the family's legal adviser, amid reports that they are considering suing Scotland Yard.

The Independent Police Complaints Commission (IPCC) will investigate the shooting.

Nick Hardwick, head of the IPCC, said the commission needs to find out the truth of what happened "to ensure it can never happen again".

He said that "if people haven't acted in accordance with the law and their training" they would be held accountable.

Mr Straw met Brazilian Foreign Minister Celso Amorim in London, where they discussed the return of Mr Menezes' body to Brazil.

Both Mr Straw and Mr Amorim said they believed he was living in the UK legally - though there are reports that his precise immigration status is still being checked.

"I haven't got any precise information on his immigration status, my understanding is he was here lawfully," Mr Straw said.

The Home Office could not confirm his immigration status but said they were looking into it "as a matter of urgency".

Meanwhile, detectives are still hunting for the men who attempted to blow up three London Tube trains and a bus last Thursday.

A total of five people have been arrested in connection with the attempted bombings and the police have named two suspects: Muktar Said-Ibrahim, 27, also known as Muktar Mohammed-Said, and Yasin Hassan Omar, 24.

Tony Blair said he was "desperately sorry" an innocent man had lost his life.

The prime minister said it was right for Britain to express its "sorrow and deep sympathy" to Mr Menezes' family.

But he said the police must be supported in doing their job.

He added that they would have been criticised had the suspect turned out to be a terrorist and they had failed to take action.

Over the past year there have been an increased number of immigration checks at Tube stations - a policy widely reported in Brazilian papers in London.

Police chased him on to a Tube train where he was shot dead.

Cancer treatment

In Brazil, relatives are demanding answers as to why Mr Menezes ran and why he was shot by police.

Cousin Maria do Socorro, speaking before his immigration status had been questioned, said she thought the police had acted "like amateurs".

She told BBC Radio 4's Today programme: "If you are going to have a war on terror, you have got to use brains to fight it not just brute force."

Ms Socorro said the family were considering suing over the shooting.

Friends of Mr Menezes in London said he had recently returned to Brazil for eight months to be with his father, who was being treated for cancer.

Fausto Soares, 26, said Mr Menezes had been sending money to pay for the treatment and was concerned how the family would now cope financially.

BBC home affairs correspondent Danny Shaw said the type of visa Mr Menezes had been given would normally be valid for one-and-a-half to two years.

He said Mr Menezes had not renewed the visa, adding: "That wouldn't explain why he was shot, but it might provide an explanation as to why he ran away - if that is indeed what he did do."

The parents of the Brazilian electrician shot dead by police were offered £15,000 in compensation for the loss of their son, raising allegations that the family were being bought off.


The offer was made to the mother and father of Jean Charles de Menezes by a senior Metropolitan Police commander during a hurried meeting arranged eight days after the electrician was shot dead at Stockwell tube station.

His grieving parents, Maria de Menezes, 59, and Matozinhos, 66, claim they were pressurised into agreeing to the meeting with Deputy Assistant Commissioner John Yates at their home in the remote town of Gonzaga, with less than a day's notice.

Jean Charles's brother, Giovani, told The Mail on Sunday: "They thought we were poor people, stupid people. We may be poor but we are not that stupid. We will not exchange money for my brother's life - but we will punish them."

However, the money was offered as part of a larger financial package prepared by the Metropolitan Police to fund the family's funeral and travel expenses. The force insists it was not trying to buy the family's silence, but making a genuine offer of help.

The typed letter, written in English, also promised to pay for his body to be flown home, air tickets for close relatives, the funeral costs and some legal expenses for the family. The £15,000 offer, the letter stressed, was an ex gratia payment "paid without any consideration of legal liability or responsibility" - including possible legal action against the force. However, newspaper claims yesterday that the force had offered $1m (£560,000) were dismissed as wholly untrue by the Met.

The family felt insulted by the £15,000 offer, Mrs de Menezes said. "I thought it was disgusting for this policeman to be talking about money when my son was only just buried. I did not like having to sit near such a man."

Although the police letter advised them to get advice from the family's lawyers in Britain, the de Menezes's claim their requests to postpone the meeting until their lawyer could get to them were turned down by Mr Yates.

"We do not want money in exchange for Jean's life, but we want to punish them - so we want a lot of money. We are also concentrating on making sure these policemen go to prison," said Giovani.

The incident adds to the family's wider complaints about their treatment by the police and is consistent with their repeated demands for judicial action against the Metropolitan Police.

The family's campaigners, Justice4Jean, allege that close relatives who flew into Britain on Sunday 24 July, two days after his killing, were given a hotel on the outskirts of London and had the phone to their room cut off.

Their contacts with the police were restricted to two family liaison officers, and they were refused meetings with senior force commanders. Family members in London and Brazil also protest that their requests for detailed information were turned down.

However, his relatives did discover - from remarks to them by their police liaison officer soon after they arrived in London - that CCTV footage from Stockwell station had shown Jean Charles walking calmly into the station.

In contrast to widely circulated eyewitness claims that he had been seen running into the ticket hall and had vaulted the ticket barriers, the family were unofficially told that he had used his Oyster travel pass. And, they were told, he was dressed in a lightweight denim jacket, not the bulky coat which some witnesses claimed.

Those disclosures were confirmed last week when a confidential dossier compiled by the Independent Police Complaints Commission (IPCC) was leaked to ITV News. Those papers also revealed that Jean Charles had neither run from police nor resisted arrest, before being seized by an undercover officer and then shot dead at close range.

His mother said: "Now I know the real truth about why they killed him, I am so hurt I can't sleep. First they killed my son, now they are killing me. I take sleeping pills but still I wake in the night shaking."

Her son Giovani added: "When Jean came home in his coffin, they had bandaged the top of his head. My mother screamed and screamed. Why did they have to use this many bullets? Was it revenge because they thought he was one of the bombers?"

The family's lawyers say his parents and close relatives remain deeply unhappy about the Met's claims that it is unable to answer questions because the shooting is now being investigated by the IPCC.

According to Gareth Peirce, their London-based solicitor, this "reticence" is in stark contrast to the police's mistaken claims on the day of the shooting that Jean Charles was "directly linked" to the terror investigation. "We express incredulity that senior police officers would have made extravagant claims from the outset without first informing themselves of the true facts. To have done anything else was negligent in the extreme," Ms Peirce said

Death row trials can take up to 10 years and appeals even longer
Hundreds of prisoners on Nigeria's death rows did not have a fair trial and may be innocent, the human-rights group Amnesty International says.

It says many confessions are extracted under torture and people are sentenced to death on that evidence alone.

An Amnesty report calls on Nigeria's government to halt all executions.

"The judicial system is riddled with flaws that can have devastating consequences," Amnesty's Aster van Kregten said.

State prosecutor Williams Ashu admitted the report had identified real concerns.

"We're working on trying to resolve the problem," told the BBC's Focus on Africa programme.

Overstretched'

Amnesty's Mr van Kregten said in a statement: "It is truly horrifying to think of how many innocent people may have been executed and may still be executed."

Nigerian court frees 'dead son'

According to the 78-page report, almost 80% of inmates in Nigerian prisons say they have been beaten, threatened with weapons or tortured in police custody.

It says that after a prisoner has been hanged, other death-row prisoners are forced to clean the gallows.

"The police are overstretched and under-resourced. Because of this, they rely heavily on confessions to 'solve' crimes - rather than on expensive investigations," Ms van Kregten said.

Mr Ashu agreed that more needed to be done to train and equip the police force.

"The work they are doing is very hard work that some of them are not adequately trained for it," he said.

Ledap, a Nigerian legal organisation which co-authored the report, says that under Nigerian law, confessions under torture cannot be used as evidence in court.

"Judges know that there is widespread torture by the police - and yet they continue to sentence suspects to death based on these confessions, leading to many possibly innocent people being sentenced to death," Ledap's Chino Obiagwu said.

Bribes

Amnesty says that death-penalty trials can take more than 10 years to conclude, with some appeals waiting for 14 years or more.

"I am not an armed robber. I am a shoemaker. I bought a [motorcycle] from someone who stole it," death row inmate Jafar, 57, told Amnesty.

He filed an appeal 24 years ago, but he is still waiting for it to be heard as his case file has gone missing.

"The police asked me to be a witness. They got the man who sold [me] the [motorcycle] but shot him to death. After that, I became the suspect."

In the report, many prisoners said that when the police picked them up, they asked for money to release them.

Those who could not pay were treated as suspected armed robbers, they say.

Social services conceded yesterday that there were systematic shortcomings in the handling of the case of two women repeatedly raped and made pregnant 19 times by their tyrannical father over 27 years.


And the Prime Minister, Gordon Brown said everyone in the UK would be "utterly appalled" by the "unspeakable" plight of the sisters who now have seven children between them as a result of the incestuous attacks.

The 56-year-old father, who cannot be named for legal reasons, was given 25 life sentences at Sheffield Crown court this week after admitting rapes and assault. A serious-case review is now under way to discover how social services, police and health workers in South Yorkshire and Lincolnshire failed to pick up on the abuse despite having contact with the family.

Peter Duxbury, director of children's services and chairman of the Lincolnshire Safeguarding Children Board, admitted yesterday that the quality of the information shared between Sheffield and his authority was "not to the standard we would expect nowadays". He said there had been a wholesale review of children's services in the county since Lord Laming's 2003 report into the Victoria Climbié tragedy.

Mr Brown, responding to a question from Nick Clegg, the Liberal Democrat leader and MP for Sheffield Hallam, told the Commons: "People will want to know how such abuse could go on for so long without the authorities and the wider public services discovering it and taking action. If there is a change to be made in the system and the system has failed we will change the system."

The 56-year-old man's sister-in-law has also accused him of forcing his daughters to father his children so he could claim their benefit support.

She said: "He obviously thought the bundles of benefits he was getting for the children was worth the risk and was not bothered about any pain it caused them."

During the trial, the court heard that several concerns were raised with the authorities over the daughters. The family left South Yorkshire in the early 1990s, moving from village to village in Lincolnshire. They eventually returned to the Sheffield area in 2004.

But suspicions were raised over the parentage of the nine children, two of whom died and some of whom suffer from genetic abnormalities. As late as 1997, when the abuse had been going on for 16 years, the women's brother reported what was described in court as "hearsay evidence" of incest. Although police investigated, no further action was taken. One of the daughters eventually came forward in June to reveal the shocking details.

Hilary Barrett, assistant director of children's services in Lincolnshire, declined to say when the case review would be completed or whether it would be made public. School and medical records would be automatically transferred when families moved. Where a child was a suspected victim of abuse, professionals had a responsibility to raise concerns. "If a family moved to another area consideration would be given to sharing information to ensure the allegations were followed up," she said.

Colin Green, director of children services in Coventry, said plans to hold secure records on all 11 million children in England on a national database, to be piloted next year, would "improve sharing of information", adding: "This is exactly the kind of case in which it could help." But the scheme has been challenged on civil liberty and data security grounds.

More people are dying in Britain due to being overweight or obese than anywhere else in Europe, a study revealed yesterday.
Around one in every 11 deaths in the UK is now linked to carrying excess fat - 50 per cent more than the rate in France.
Experts also warned that the number of fatalities due to obesity may soon, for the first time, exceed those caused by smoking.
Being overweight or obese leaves people at high risk of heart disease, diabetes, high blood pressure and osteoarthritis. It also makes them much more likely to develop several types of cancer.
The growing health disaster is being blamed on the rise of aggressively marketed, fatladen fast food and couchpotato lifestyles.
Around half of British adults are overweight, and 17 per cent of men and 21 per cent of women are obese.
The difference between being overweight and obese lies in a person's Body Mass Index, which is calculated from weight and height. An adult with a BMI of more than 25 is classed as overweight and one with a BMI of more than 30 is obese.
Britain is the 'fat capital' of Europe, according to researchers from the University of Madrid's School of Medicine whose study is published in the European Journal of Clinical Nutrition.
The lowest death rate from being obese and overweight was in France, but the researchers said it was clear that Europe as a whole has a problem.
The study found that up to 400,000 deaths each year in the EU are directly linked to excess weight.
Of all the deaths in the UK that were linked to excess weight, about 66 per cent were down to obesity, and 33 per cent to being overweight.
In around 70 per cent of overweight-linked cases, the final cause of death was heart disease and in 20 per cent, it was cancer. Overall, around 12 per cent of heart disease deaths in Britain were due to being overweight, and 5.7 per cent of total deaths from cancer were also directly caused by being overweight or obese.
Dr Jose Banegas, who led the research, said excess weight is a major public health problem.
'One in two in the EU is obese or overweight,' he added. 'Excess weight may well come to replace smoking as the major killer of adults in the near future.
'Most countries have not yet made any systematic effort to raise public awareness as to the dangers of obesity.'
As well as being worst for fat-related deaths, the UK tops the smoking mortality league, with 21 per cent of all deaths linked to tobacco.
Obesity costs £2.6billion a year in NHS bills and indirect losses to the economy. Other studies have shown that the percentage of overweight children in Britain has virtually doubled in the last decade.
Dr Andrew Hill, of Leeds University, said the rate of adult obesity in Britain is rising by one per cent of the population a year.
Doctors say that being obese when you are 40 knocks up to seven years off your life. Obese people who smoke will die more than 13 years before their time.
Doctors are unsure why France should come out with the lowest rate of deaths due to excess weight. The French do not eat less saturated fat than the British and have similar cholesterol levels.
It has been suggested that they are protected from heart attacks by drinking alcohol, particularly red wine.
Fat families are to be prescribed a visit to their local Sainsbury's by GPs, where they will be taken by the hand and shown healthy foods.
The supermarket has struck a deal with family doctors and the drug firm Roche under which overweight patients will be offered tours of selected stores with advice from nutrition experts.

Binge drinking costing billions  

Ministers will publish a strategy to tackle alcohol problems next year
Britain's binge drinking culture is costing the country £20 billion a year, according to a government report.
The study by the Prime Minister's Strategy Unit shows 17 million working days are lost to hangovers and drink-related illness each year.

The annual cost to employers is estimated to be £6.4 billion while the cost to the NHS is in the region of £1.7bn.

Billions more are spent clearing up alcohol-related crime and social problems.

In addition, alcohol-related problems are responsible for 22,000 premature deaths each year.

However, the authors of the report said that even these figures may be a conservative estimate.

They found that there are 1.2 million incidents of alcohol-related violence a year.

Around 40% of A&E admissions are alcohol-related. Between midnight and 5am that figure rises to 70%.

Alcohol-related accidents and illnesses land around 150,000 people in hospital each year.

Up to 1.3 million children are affected by parents with drink problems, the report said.

They are also more likely to have problems later in life themselves.

In addition, youngsters are starting to binge-drink at an earlier age.

The binge-drinking period that was once confined to the late teens now often runs from 16 to 24, it said.

Ministers are planning to publish a strategy to tackle binge-drinking and other alcohol-related problems next year.

Home Office Minister Hazel Blears said changes to pub opening hours would also help.

She said the licensing bill would help tackle the problem by removing a single closing time and reducing disorder in town centres.

She said there would also be a drive to give more information to young people about the risks of drinking too much.

Ms Blears told Radio 4's Today programme: "Young people will say to you 'We have a lot of education about drugs, but not enough information about alcohol.'

Lord Adebowale, chief executive of charity Turning Point, called for more money to be spent on alcohol treatment, education and social care.

"We are talking about families dissolving in a sea of alcohol," he told the BBC.

Eric Appleby, chief executive of Alcohol Concern, said the government would have to increase spending on alcohol services from £100m to £300m.

Lesley King-Lewis, chief executive of Action on Addiction, said: "More money should be invested in alcohol services, as they are seriously under funded at the moment."

Professor Ian Gilmore, of the Royal College of Physicians, urged ministers to act on the report's findings.

"It's crucial that the government follows up this report urgently with strong recommendations to tackle the problem, including labelling of alcohol content and health warnings on drinks."

Rob Hayward, chief executive of the British Beer and Pub Association, said: "Alcohol misuse needs tackling and treating.

"We also need to get to the root causes of what motivates a significant number of people who think it is acceptable to go out on a Friday or Saturday night, drink to excess and indulge in anti-social behaviour."

Jean Coussins, chief executive of The Portman Group - the industry back organisation that promotes sensible drinking, also called for action.

"The government should develop mass media campaigns to curb excessive drinking, funded at the same level as its drink-drive campaigns over the years."

Shadow home secretary Oliver Letwin said: "The government has been far too complacent about the problem of alcohol abuse - particularly among young people

The number of winter deaths rose last year
Soaring energy prices could mean more deaths among elderly people this winter, a charity says.

An Age Concern poll of 2,300 people found many over 60s were worried about being able to heat their homes.

And with one of the coldest winters for some years predicted, the charity said that could lead to more people dying.

The warning comes after figures for England and Wales suggested there was a 7% jump in extra deaths last year despite a relatively mild winter.

The Office for National Statistics said that from December 2007 to March 2008 there were an extra 25,300 deaths in England and Wales compared with the average for non-winter months.

 With this winter set to be colder than last, the numbers are likely to rise

However, the figure was still some way short of the increase in deaths seen in the winters of the late 1990s when totals hit nearly 50,000 as flu swept around the country.

Nonetheless, the figures still indicate one of the highest rates of winter deaths - ahead of the likes of Finland and Denmark which generally have colder winters.

Gordon Lishman, director general of Age Concern, said this was a scandal.

He added: "With this winter set to be colder than last, the numbers are likely to rise. Pensioners are clearly more worried about staying warm and well this year.

"Yet, the impact of increased energy bills is causing thousands to risk their health by cutting back on heating."

The poll showed nearly two-thirds were worried about their ability to stay warm, with half of older people already cutting back.

Mr Lishman urged the elderly to take several key steps to help protect themsleves this winter, including claiming benefits and getting the annual flu jab.

And despite the rise in the winter fuel allowance, he also urged ministers to do more to keep energy prices low for the most vulnerable, pointing out most people were in favour of some kind of market intervention.

A Department of Health spokeswoman also urged people to get the flu jab.

She added: "Cold weather and winter illnesses can have a very big impact on people’s health, but many winter deaths are preventable."

Almost one in 10 British citizens is living overseas, according to a study of people coming in and out of the UK.

Studies by the Institute for Public Policy Research, published on the BBC News website, indicate that at least 5.5m British-born people live abroad.

Figures suggest the rate of departure has been so great that population falls are only masked by immigration.

While Australia and Spain are the top locations, increasing numbers are heading to major Asian economies.

The research by the institute (IPPR) is the first significant attempt to put a figure on the number of British citizens who live overseas.

The study found 5.5 million expat Britons - a number that rises to six million if those who live or work part of the year abroad are included. Taken together, they represent approximately 10% of British citizens. Until now, tentative government estimates of expats had ranged from 4.5 million to 14 million.

Over the course of 40 years, some 67,500 more Britons have left the UK every year than have returned - a population loss that has been balanced out by increasing immigration.

The number of British citizens who chose to go permanently abroad doubled from 53,000 in 2001 to 107,000 last year - some 2,000 people a week.

The majority of expats live in Australia, Spain, the US and other English speaking nations. But in all some 41 nations each have at least 10,000 permanent British residents. The IPPR's figures have been calculated from official sources, such as census data, counts of pensions paid overseas, passport applications and other statistics.

How the Brits Abroad data was compiled

Dhananjayan Sriskandarajah, co-author of the report, said that the scale and spread of the British expat diaspora was probably being driven by the UK's economic strength.

A strong economy was attracting economic immigrants - but also encouraging Brits to broaden their opportunities.

"Britain is truly at the crossroads of the global movement of people," said Dr Sriskandarajah.

"Two-thirds of Britons who leave do so to seek employment abroad - and are replaced by skilled professionals from elsewhere in the world.

"When the going is good, Brits get going."

More emigration expected

Earlier this year, a BBC survey on emigration attitudes found the number hoping to leave in the near future had doubled since 2003.

Young people were the most likely to want to leave, with a quarter saying they were hoping to live abroad.

Dr Sriskandarajah said the new figures indicated emigration would grow further.

"If current trends continue, we could expect as many as a million more British nationals to emigrate over the next five years," he said.

But Sir Andrew Green of Migrationwatch UK said the departure of British citizens should be seen against an annual arrival of some 300,000 immigrants.

"This net migration is the key issue - that is those who come minus those who go," he said.

"We now face by far the largest wave of immigration since 1066, even allowing for those who emigrate. This is putting enormous strain on our infrastructure, public services and on social cohesion."

Foreign Office urges 'know before you go'

Lord Triesman, Foreign Office Minister for Consular Affairs, said he welcomed the report.

"Globalisation has increased movement of people both to and from the UK," he said.

"The policy challenges are how to manage these flows effectively in order to respond to the changing needs of the UK. This research will be helpful in understanding how best to address those challenges.

"The report also confirms what we at the FCO know to be true - that a small but significant proportion of British emigrants run into trouble because they have not planned their departure properly.

"Much of what we do is designed to help people avoid such pitfalls, and we will continue to work hard in this area.

British expats in Spain fear attack 14/11/2008

Brits living in Spain will soon face anti-foreigner attacks, a former Europe minister warned yesterday.

Labour's Denis MacShane believes the credit crunch and rising unemployment will lead to angry Spaniards targeting British expats who had taken their jobs.

He said there had already been "rumblings" against elderly Brits putting strain on Spain's health service.

Mr MacShane added: "As Spanish unemployment is rising the fastest in Europe, you will see the arrival of anti-foreigner feeling."

Nigerian Death Row Prisoners Denied Appeal, Despite Waiting 24 Years For One

Dozens of death row prisoners in Nigeria have not been able to appeal their sentences, others have waited up to 24 years to have their appeals heard, and some are just teenagers, Amnesty International said Tuesday.

At least 80 of the 736 inmates currently languishing on death row in Africa's biggest oil producer were sentenced by tribunals, without the right to appeal their sentences, the London-based rights group said. Others have faced decades-long delays for appeals, due to a lack of legal representation or missing case files, it said.

In addition, there are at least 40 juvenile offenders on Nigeria's death row. [size=20pt]Their ages at the time of their alleged crimes ranged from 13 to 17 years old.[/size]
The rights group called upon the Nigerian government to declare a moratorium on executions, saying the West African nation's criminal justice system is "riddled with corruption, negligence and a nearly criminal lack of resources."

Government officials had no immediate comment on the Amnesty report.

The report also claimed that thorough, impartial police investigations into capital crimes were rare and said over half of the death row inmates were convicted on the basis of written confessions that many said were extracted under torture.

"It is truly horrifying to think of how many innocent people may have been executed and may still be executed," said Aster van Kregten, Amnesty International's Nigeria researcher.

Nigeria made an attempt to address the flaws by establishing two commissions of inquiry, which both recommended a moratorium on death sentences because the existing justice system could not guarantee a fair trial, but no action has been taken yet.

The report says Nigeria's soaring violent crime rate puts pressure on police to make fast arrests and few politicians want to publicly oppose death sentences.

"The death penalty is used as a distraction from the real issue: Addressing the underlying factors that lead to violent crime," the report said.

Nigeria is Africa's most populous nation, with 140 million people. In spite of massive oil earnings, poverty is widespread and criminality and corruption are major problems.

A FORMER star of the television show Gladiators was jailed for 15 months yesterday for his role in a plot to pervert the course of justice.

Michael Ahearne, 37, a former nightclub bouncer who played Warrior in the popular ITV show, acted as the link between a corrupt policeman and a drugs empire led by one of Britain's most notorious gangsters. Potentially fatal information gleaned by Det Chief Insp Elmore "Ellie" Davies, of Merseyside police, was passed through him to subordinates of Curtis Warren, himself serving a 12-year sentence for drugs trafficking in Holland.

The intention of all three men was to secure the release of Philip Glennon Jnr, the son of one of Warren's closest associates. He had been charged with attempted murder following a shooting outside a Liverpool nightclub in July 1996. The charge against Glennon Jnr, 27, was ultimately reduced to one of a firearms offence. He is now serving a six-year prison sentence.

Philip Glennon Snr originally appeared in the dock alongside Ahearne, Davies and Bray. He was charged with perverting the course of justice. However, the case against him was dropped on the orders of the judge. Glennon Snr was described in court as "a very wealthy man as a result of drug-dealing activities from which he amassed a fortune."

The jury at Nottingham Crown Court, having heard 24 days of evidence, took seven and a half hours to unanimously convict Ahearne, Davies and a third man, Tony Bray, of corruption and perverting the course of justice. Davies, 51, was jailed for five years and Bray, 37, for three years.

Passing sentence, Mr Justice Curtis told Davies: "Your motives were sheer greed - and anger at not receiving the recognition, by promotion or posting abroad, you felt you deserved. No legal system can possibly tolerate miscarriages of justice that are engineered by deliberate planning, skilfully and ruthlessly executed with every single step camouflaged to prevent discovery and that also involve very large sums of money and the corruption of a senior detective in the very force responsible for the prosecution of the case."

Ahearne, said the judge, had been led into his crimes by his policeman friend, while Bray acted as the willing helper of powerful criminals. During his trial, Ahearne, of Oxton, Birkenhead, Wirral, had frequently paused outside the Crown Court building to sign autographs for fans. As he was led to the cells, he nodded towards the public gallery. His girlfriend, Lyndsey Beattie, broke down in tears.

The court heard how Davies, former deputy head of Merseyside's drugs squad, "changed sides" only months before his 34-year career was due to be rewarded with a lucrative pension. His involvement with Warren's gang was disclosed by a tip-off from Dutch police investigating the drug baron's activities in Holland. Intercepted phone calls suggested that Warren had a mole within Merseyside police.

Merseyside's Chief Constable, James Sharples, gave his permission for a surveillance bug to be hidden in the ceiling of Davies's lounge. This eventually yielded a number of incriminating conversations, including Davies's disclosure to his new paymasters that an undercover detective was shadowing Warren in his Dutch prison.

But he also gave them personal information about two of his colleagues, both of whom he had anticipated would be crucial prosecution witnesses at Glennon Jnr's trial. In the case of Pc Gary Titherington this included details about his home security, his car and the location of his daughter's nursery.

Davies, the crime manager of Tuebrook police station, Liverpool, told the gangsters he believed that Pc Titherington was the key to their attempts to "Bleep up the case" against Glennon Jnr. He himself had "tried to influence" the Crown Prosecution Service into abandoning the case.

Ahearne received a £10,000 down-payment for Davies's information.

Wednesday. Manchester. UK. Community leaders in Salford, the Manchester suburb, have today announced ambitious new plans to combat the alarming rise in crimes amongst teenage youths.

Feral Youths

Manchester, which is twinned with Mosul and Beirut, has suffered a recent upsurge in violence from its younger population with an increasing number of attacks on innocent adults by gangs. Famously the local Police Chief Superintendent, David Baines, recently warned that that the area was infested with ‘gangs of feral youths running wild' - a reference to the large number of hooded-top wearing little brats who terrorise and abuse those poor, innocent people they meet on the streets.

Searches are carried out of the homes of brothers Neil and Jamie Acourt, and David Norris and Gary Dobson. Mr Norris is not at home but the Acourt brothers and Mr Dobson are arrested, then released on bail.

Mr Norris surrenders to the police and is arrested and interviewed.

May 13 1993
Identification parades are done for Neil Acourt, Mr Dobson and Mr Norris. Neil Acourt is identified by Mr Brooks as one of the gang responsible. Acourt is charged with the murder of Stephen and the attempted murder of Stacey Benefield a month earlier. Mr Norris is charged with the attempted murder of Benefield.

June 23 1993
Luke Knight is charged with Stephen's murder and remanded in custody.

July 29 1993
Committal proceedings are scheduled for Neil Acourt and Mr Knight but the Crown Prosecution Service formally discontinues the prosecution after a meeting between the CPS and the senior investigating officer.

December 22 1993
The Southwark coroner, Sir Montague Levine, halts an inquest into Stephen's death after the family's barrister, Michael Mansfield QC, says there is "dramatic" new evidence.

April 16 1994
The CPS says the new evidence is insufficient to support murder charges.

September 1994
The Lawrence family begins a private prosecution against the prime suspects.

April 18 1996
The murder trial begins against Neil Acourt, Mr Knight and Mr Dobson at the central criminal court.

April 25 1996
The case collapses after Mr Justice Curtis rules that identification evidence from Mr Brooks is inadmissible. All three are acquitted.

February 13 1997
The inquest into Stephen's death ends and the jury decides he was "unlawfully killed by five white youths".

July 31 1997
A judicial inquiry is announced by the home secretary.

December 15 1997
A Police Complaints Authority report on the original police investigation of Stephen's murder identifies "significant weaknesses, omissions and lost opportunities".

February 24 1999
The MacPherson report is published.

May 5 2004
The CPS announces there is "insufficient evidence" to prosecute anyone for Stephen's murder.

The double jeopardy legal principle, preventing suspects being tried twice for the same crime, is scrapped.

The Independent Police Complaints Commission finds no evidence of police corruption and no evidence of dishonest links between Mr Davidson and Clifford Norris.

Gun crime soars by 35%


Every day there were 27 firearms offences

Gun crime has risen by 35% in a year, new Home Office figures show.
There were 9,974 incidents involving firearms in the 12 months to April 2002 - a rise from 7,362 over the previous year.

RECORDED CRIME RISES
Overall crime: 9.3%

Gun crime: 35%

Robbery: 14.5%

Domestic burglary: 7.9%

Drug offences: 12.3%

Sexual offences: 18.2%

That represents an average of 27 offences involving firearms every day in England and Wales, with guns fired in nearly a quarter of cases.

Overall crime in the year to September was up 9.3%, with domestic burglary up 7.9%, drugs offences up 12.3% and sex offences up 18.2%.

Home Office officials insisted, however, that the new system of including all crimes, whether there was supporting evidence or not, was responsible for some of the increases.

When that new recording system was taken into account, overall crime rose by 2%, they said, with burglary up 5%.

Home Office Minister John Denham also pointed to new data from the British Crime Survey - which includes crimes not reported to the police - which he called the most reliable indication of trends.

 

The survey put all crime down 7% in the year to September.

"The British Crime Survey shows crime has been falling since 1997 and the risk of being a victim is very low - around the same as 1981," he said.

The statistics come after the government this week announced a crackdown on gun crime with a series of plans to tighten firearms law

Jacqui Smith pledged to tighten the police's grip on violent crime in 2008
The spiralling problem with gun culture was highlighted by figures that show 28 firearms crimes are committed in England and Wales every day.

Home Office figures showed gun crimes rose by four per cent last year, the largest increase for three years.


It follows a crackdown unveiled by Jacqui Smith, the Home Secretary, after the shooting of 11-year-old Rhys Jones by another boy in Liverpool last August.

Police chiefs said the figures were concerning, while Tories said they showed Labour was "failing to combat violent crime and its causes". The Liberal Democrats said the data was "alarming".

There were 10,182 firearms offences in the year to the end of September compared with 9,755 in the previous 12 months - an increase of more than 400 crimes, or more than eight every week.

The rise is the biggest percentage increase since September 2004, when figures showed a five per cent increase in gun crimes.

While gun-related deaths were down, from 55 to 49, the number of slight injuries, threats and non-injury incidents linked to guns increased.

Victims' groups were appalled by the figures in the quarterly crime statistics released by the Home Office.

Norman Brennan, a policeman who is spokesman for the Victims of Crime Trust, said Government initiatives to tackle gun crime seemed to make no difference.

"Children as young as 11 or 12 are carrying guns," he said. "The sad reality is that it is becoming so routinely reported by the press that a child has been shot that the shock value has been eliminated."

Police chiefs said they were "concerned" about the rise. Bob Jones, the chairman of the Association of Police Authorities, said: "This is an area police authorities will want to monitor carefully."

David Davis, the Conservatives' shadow home secretary, said: "These latest official figures show that Labour is failing to combat both violent crime and its causes."

Mr Davis said the gun figures were linked to a steep rise in drug offences - up 21 per cent in the third quarter of last year. The number of drug crimes was 55,700, against 9,500 in the same period in 2006.

He said: "Violent crime is fuelled by drugs and Labour's chaotic and confused policy on drugs. Drugs wreck lives, destroy communities and are a major symptom of our broken society."

Chris Huhne, the Liberal Democrat home affairs spokesman, said: "Violent crime - including, most alarmingly, gun crime - is still far higher than 10 years ago and has to be tackled much more vigorously."

Overall recorded crime fell by nine per cent to 1.24 million offences in the third quarter.

The British Crime Survey, a separate set of figures based on interviews with members of the public, showed there had been little change in people's perceptions of crime.

The Home Secretary said she was pleased the risk of being a victim of crime was "at a historically low level".

She said: "Enforcement is a key part of our approach to tackling drug harm.

"In 2008 we will tighten our grip on violence and anti-social behaviour, working with police and local partners

Girls of 11 on rampage as mobs terrorise estates Experts back US scheme that cut crime by a quarter PEOPLE INVESTIGATES

More than 1,000 teenage gangs hellbent on murder, mayhem and terror are roaming Britain's streets today, a shock People investigation can reveal.

Households in towns and cities across the country are living in fear as vicious turf wars erupt between mobs of baying kids brandishing knives and even guns.

One notorious sink estate is being overrun by savage groups of schoolgirls as young as ELEVEN.

And a horrifying string of teen stabbings has left police, politicians and child welfare chiefs desperately seeking new ways to end the plague of gang-related violence.


London alone has seen 18 kids killed by knife-wielding thugs so far this year.


The most recent were 16-year-olds Ben Kinsella - brother of ex-EastEnders TV star Brooke - and Shakilus Townsend, both murdered last week.


Pioneering schemes in America run by reformed thugs have seen street crime in some inner cities cut by almost a QUARTER.


But incredibly no official study has been done to pinpoint the extent of gang culture in Britain.


And former Tory leader Iain Duncan Smith is convinced teen crime is getting out of control.


He warned: "Gangs are a major problem - a lot bigger than most people realise.


"And I believe it is something that will get only worse.


"There are at least 1,000 street gangs operating today and the number is growing rapidly."


Kids dubbing themselves "urban terrorists" use internet websites to boast of their violent exploits, trade racist abuse and set up street fights.


They also draw up boundaries to create gangland territories - sparking a rash of bloody postcode wars.


Prime Minister Gordon Brown has pledged a major crackdown on anyone caught carrying a knife.


And a campaign to cajole youngsters into ditching their weapons is being led by Metropolitan Police Commissioner Sir Ian Blair and London mayor Boris Johnson.


But after The People revealed in May that hospitals in England treated 5,720 victims of knife attacks last year, experts warn much more needs to be done.


Mr Duncan Smith, who heads the Social Justice Policy Group think-tank, said: "Gangs are a symptom of the way British society is today, with the breakdown of the family unit.


"Members are usually from dysfunctional families and broken homes.


"And they are failures at school who end up playing truant at an early age and forming little groups.


"From the age of around 11 or 12 they start joining gangs and these become the alternative families they do not have at home.


"But they are ruled by brutal discipline which often spills over into extreme violence." He added: "This emerging gang culture is a direct result of the social breakdown in Britain where we have more divorces, more family break-ups and more teenage pregnancies than anywhere else in the western world.


"We need to help these people and draw them back into society before a new generation of gangs are born."


Many UK experts are now studying a breakthrough scheme in the US.


University boffin Dr Gary Slutkin believes urban violence is a disease - and should be treated as an illness.


His CeaseFire initiative in Chicago uses ex-thugs as "credible messengers" who act as mentors to kids identified as most likely to commit violent crimes.


The youngsters in turn help reform other thugs, leading to the "infection" of gang violence being killed off.


The US Justice Department said gun violence alone was down by up to 24 per cent in six of the seven rundown neighbourhoods where CeaseFire operates.


An ex-gang member in London is convinced Britain should urgently adopt the same scheme.


Junior Smart, 32 - who helps young tearaways through a mentor programme called SOS Gangs - said: "We've been successful because we speak to these young men on their level.


"We've grown up in similar situations and shared the same experiences so we can relate.


"We ask them to take responsibility for their actions and break down their association with gangs and crime and help them make a fresh start.


"We don't act as authority figures - we are there to empower these young men and help them get into education and employment."


Junior warns the number of gangs in London could be as high as 400.


He said: "Some are harmless - just friends hanging round together.


"But others are becoming more and more dangerous as they do their best to live up to the bling-bling lifestyle.


"I recently spoke to some girls as young as 11 who had formed a gang on a housing estate in Woolwich.


"Their leader was running round boasting about having an ASBO.


"The older gangs involved in the postcode wars are ruthless.


"I know people of who have had contracts put on their heads for crossing the line and they have been moved into safe houses by police."


But Junior added: "There is no point throwing money at the problem like the Government's been doing.


"We need to go into schools, work with young people and their families and earn their trust.


"Gangs have been around for a long time and they are not going to disappear overnight.


"But we CANmake a difference if we all work together."


GLASGOW


Dominated by the Barlanark Young Team and Calvay Boys.


There are more than 170 gangs in the city which are breeding grounds for thugs like brothers Neil and Paul Murray.


Neil, 23, was caged for life in 2004 for the gun murder of a 46-year-old dad of three.


Paul, 20, was jailed for ten years for shooting and injuring a cop at a police station in 2003.


BRADFORD


Run by the Ointment Gang which allies itself with Bradford City - to the club's annoyance - and has been linked to Manningham Lane race riots.


Mobs of Asians often clash over drug cash which is said to be laundered through a network of shops.


In May, a 31-year-old man was stabbed to death after being dragged from his car in a street behind a mosque.


LIVERPOOL


Blighted by a string of turf wars between the Croxteth Crew, Nogga Dogz, Moss Edz and Dovey Edz.


The rivalries - centred on Norris Green, Croxteth, Huyton and Dovercot - sparked nationwide outrage last year when innocent 11-year-old Rhys Jones died in his mum's arms in a pub car park after being shot in the neck.


MANCHESTER


Ruled by mobs like the Doddington Gang and the Gooch Boys, city has been dubbed Gangchester.


Jessie James, 15, was shot dead in 2006 as he cycled in a park "owned" by the Gooch Boys. Cops say he was wrongly identified as a member of a rival mob.


Ethnic minority gangs regularly clash with white thugs from nearby Salford.


NOTTINGHAM


Feuding mobs include the Meadows Posse, St Ann's Crew and the Radford Road Posse.


Nottingham's setting on the drug route between London and Manchester has led to a huge increase in gang violence.


In 2004 Danielle Beccan, 14, was killed when gunmen fired at a crowd. Mark Kelly and Junior Andrews were jailed for 32 years.


BIRMINGHAM


Race-HATE thugs like the Johnson Crew and Burger Bar Boys plague the city.


Clashes between black and Asian gangs in the Lozells area in 2005 left three people dead.


And in 2002 Letisha Shakespeare, 17, and Charlene Ellis, 18, were shot dead after a party in a vendetta between rival black mobs - who later joined forced to fight Asians.


CARDIFF


Football thugs like Soul Crew have been sidelined by Canton Youth and other teenage gangs.


Canton Youth specialise in intimidation and vandalism.


Ringleader George James, 20, was jailed in May after the gang bragged of their exploits on video-share website YouTube.


LONDON


Ultra-VIOLENT gangs include the Peel Dem Crew, Murder Dem Pussies, the Peckham Boys, the Untouchables and the Tottenham Man Dem.


Detectives believe more than 40 mobs have been involved in killings across the capital.


And community leaders who work with street gangs claim there are up to 400 mobs in London - DOUBLE the official estimates.


The Metropolitan Police has set up a 75-man taskforce to crack down on knife crime, which bosses call their No1 priority.

1 in 4 teenage pupils confess to crimeAlan Travis, home affairs editor guardian.co.uk, Monday May 20 2002 08.24 BST One in four teenage schoolchildren admit they have committed a crime in the past 12 months, according to a survey published last night by the government's youth justice board.
The most common offence was fare dodging, and the detailed survey results suggested that levels of youth crime have remained relatively stable since 1999.

In the 2002 Mori youth survey 26% of teenage pupils said they had committed a crime in the past 12 months. This compared with 24% in 1999.

The most common profile of a teenage offender was a white male aged 14-16, living in London or the north-east, who was excluded from school and had committed more than five crimes in the past year.

The survey revealed much higher levels of crime among teenagers who had been excluded from school, with 64% of this group admitting they had been involved in crime - down from 72% in 2000.

This group of teenagers was engaged in much more serious crime. Some 60% said they had been involved in handling stolen goods; 55% said they had carried a weapon other than a gun, and 25% admitted they had stolen mobile phones.

The only crime in which there appeared to have been a drop was shoplifting, down from 58% to 49% among excluded children in the past year.

The results also showed that more schoolchildren who were caught were being punished. In 2001 some 22% said they were not punished after being caught for an offence. This figure fell to 16% last year.

But there were big variations around the country in the chances of a teenage offender being caught. Only 11% of those in London who admitted they had committed a crime said they had been caught, compared with 43% in Wales and 44% in the north-east.
