Sss’ll Appeal Court Judgment On El-rufai, Says Ogar by Anikulhapo(m): 4:04pm On Sep 30, 2014
The Department of State Services, has said it would appeal the judgment of the Federal High Court, Awka, which ordered it to apologise and pay N2 million to a former FCT Minister, Nasir el-Rufai, for restricting his movement during the governorship election in Anambra State in 2013.
The service rejected the order, saying some facts may have been overlooked in the case, noting that it would therefore appeal the judgment.
The Deputy Director, Public Relations, DSS, Marilyn Ogar, in a statement on Tuesday in Abuja, said the 1999 Constitution empowered the service to detain any suspect for not more than 48 hours before recourse to a court of law.
According to her, the department would be operating like a ministry if it cannot intercept, detain and investigate suspects.
She said, “As a responsive Service, we hold the Judiciary and its sanctity in high esteem, but when you disagree with certain pronouncements of Court, you have the right to appeal and in this case, we will appeal.
“The Instrument setting up the Service and the 1999 Constitution of the Federal Republic of Nigeria as amended gives the Service statutory powers to detain and investigate any suspect for not more than 48 hours before recourse to a Court of Law. In this instance, the complainant was not confined or ‘detained’ for more than two hours.
“If we cannot intercept, detain and investigate, then we would, with due respect, be operating like any Ministry of the Federal Government.”
Ogar denied that the DSS imposed a general restriction on movement during the elections as averred by el-Rufai, noting that it was the duty of the Independent National Electoral Commission, to take measures necessary for the smooth conduct of any election, “and in this case they deemed it proper to restrict movement during voting hours,” she added.http://www.punchng.com/news/sssll-appeal-court-judgment-on-el-rufai-says-ogar/

When you have Activists and Social Crusaders on the bench, there abound to be misinterpretation of Institutionalised laws and statutes establishing various Agencies of Government, this indulgence is driven by public opinions at a time rather than the content of laws of the country (constitution and acts of National Assembly).

This Judicial overzealousness (judicial talibanism if you like) is defined as "Legislation from the bench" rather than judicial interpretation of various Legislation and the Constitution of the country as required by law from an organ of the Government.

The Judiciary can reprimand an Agency of Government on operational procedures and not challenging their statutory functions.

This matter is very simple.
Did d SSS detain mallam for few hours? Yes

Do they have d statutory right to detain suspects for a number of hours to enable them carry out preliminary investigation? Yes

Is Elrufai above d law? NO

Do they have d right to appeal a court judgment? Yes

We must not gag our security service because a political figure is involved or that d man shares similar political ideology.

We mus grow up and allow d law to reign supreme

Don't misunderstand me, I am not against Elrufai in any ramification.

I was trying to reconcile this Court judgement with Laws and Statutes establishing DSS and the implications of this judicial pronouncement on their operational procedures if not appealed.

Let them operate within the constitution and not outside the law thereby trampling on an individual right,what they did was acting the ruling party script,the similar case happened in ekiti and osun,if a judgement like this failed to teach them a lesson,they will nt change.
Let them stop acting like superhuman,the judgement is timely,cos the election is by corner,let them rethnk their action b4 then.

Do you work for the DSS...... It seems that you know much more than Marilyn Ogar......... So you mean DSS did not view other party chieftains were not seen as Nigerian citizens.......
