Ekiti Election Tribunal delivers Judgment today by Nobody: 10:02pm On Dec 18, 2014
The Ekiti State
Governorship Elections
Petitions Tribunal sitting in
Abuja will on Friday deliver
its judgment on the petition
filed by the All
Progressives Congress
challenging the victory of
Governor Ayodele Fayose
in the June 21, 2014, poll.
The Justice Siraju
Mohammed-led tribunal on
Wednesday adjourned for
judgment after lawyers,
representing parties in the
petition, adopted their final
written addresses.
The respondents are the
Peoples Democratic Party,
Fayose, the Independent
National Electoral
Commission, the Chief of
Army Staff and the
Inspector-General of Police.
INEC had declared Fayose
and his party, the PDP,
winners of the election,
defeating APC’s candidate,
who was then the
incumbent governor of the
state, Dr. Kayode Fayemi.
The petitioner’s lawyer,
Lateef Fagbemi (SAN), had
before adopting his
address, reminded the
tribunal that, as against
the impression created by
the defendants, the petition
was predicated on the
contention that Fayose was
not qualified to contest the
election.
The petitioner had
contended that among
other grounds, Fayose was
not qualified in the first
place to participate in the
poll because of his
impeachment from the same
office in 2006.
This, he said, was “aside
from the process of the
poll’s conduct, which was
faulty.”
He urged the court to
dismiss the responses by
the five respondents.
Lawyers to the
respondents, including
Yusuf Ali (SAN), Onyechi
Ikpeazu (SAN), Abayomi
Sadiku and Abdulkadir
Ajana, argued that the
petitioner failed to prove
its case.
They also argued that the
petitioner was unable to
provide cogent evidence to
support its petition. They
urged the tribunal to
dismiss the petition.
The APC is by its petition
urging the tribunal to
“unravel the hidden facts
surrounding the election,”
contending that the election
was more of “a mechanical
exercise than conventional
casting of votes.”
