However, the case took a different twist today when two new motions for joinder was submitted to the honourable court involving Chief Chuka Odom who also contested alongside Senator Araraume in the December 8 PDP primaries in Imo State and got only one "1" vote and two other delegates who took part in the same primaries demonstrating their interest to join the suit. The delegates were represented by Barr. Ekoma while Chuka Odom was represented by Barr. Chukwuma Ekomaro (SAN)

"You could remember that the counsels to Rt. Hon. Emeka Ihedioha and counsel to PDP also supported two different motions for joinder which was thrown out by the Judge on the last seating saying that it has no basis to be retained"

In the last seating on Tuesday 3rd of February 2015, the Presiding Judge pronounced that the substantive suit will be presented for hearing before the honourable court today 5th of February 2015, but when the matter was brought up for hearing, the party seeking to be joined came up with filed notice of appeal accompanied with an application of stay of proceedings.

Chief Chuka Odom brought the application for joinder through his Counsel, Barr. Chukwuma Ekomaro, urging the Court that he should be joined in the Suit, arguing that the matter filed on the 19th of December 2014 and adjourned on February 3rd was not binding. All the defendant parties (Barrister to Emeka Ihedioha and Barrister to PDP) supported the motion for joinder but Counsel to Senator Ifeanyichukwu Araraume Barr. D.D DODO ( SAN ) refused to support the motion for joinder and argued with its acceptability by sighting Some sections in the Nigerian constitution which says otherwise.

The counsel to the first Party seeking to be joined prayed to be giving a fair hearing as it is his legal right and also asked for more time to study the proceedings and the verdicts of the 19 December 2014 and 3rd of February 2015 respectively in other to get him on the same level of understanding with the other counsels (according to him) that probably the court will now come back for the proper hearing next week.

An argument sprung up between the parties seeking joinder and the counsel to Senator Ifeanyichukwu Araraume Barr. D.D DODO ( SAN ) who told the honourable court that we have a very serous and delicate issue here affecting over 3million Imolites and an aspirant who got only one vote in the primaries is making arguments to waste the time of the honorable court when his joinder motion have not yet been accepted nor approved.

However the judge granted them the opportunity to be heard to enable him (the judge) to ascertain if actually their request will be granted or not.

What was heard today was the application for stay of proceedings filed by the first party seeking to be joined. He is of the opinion that everything in the matter should be stayed pending the determination of the Court of appeal in respect of the order made on 3rd of February 2015.

At this time ,Counsel to the plaintiff Barr. D.D DODO stood up to put the court through, by sighting some sections and paragraphs in the constitution of the Federal Republic of Nigeria, on why the motion for joinder lack basis of acceptance by the competent court of law.

He made the honourable court know that what he see is a mare conspiracy from some people who has no case to challenge nor defend, rather interested in wasting the precious time of the honorable court in other to frustrate the court into lingering the judgment till after general election which he strongly believes will not work for them. He therefore urged the Judge to properly use his good discretion on this matter as it concerns millions of Imolites.

And the court was adjourned to Tuesday 10th of February 2015.

MY QUESTION IS : WHY ARE ALL THE DEFENDANT COUNSELS AFRAID OF THE HEARING OF THE SUBSTANTIVE SUIT?

ON THE LAST SEATING, THEY CAME UP WITH TWO MOTIONS WHICH WAS THROWN OUT BY THE JUDGE, AND TODAY THEY CAME UP WITH TWO OTHER MOTIONS.

And the funniest part of it is that the defendant counsels have always been in support of all the motions for joinder.

It seems they are actually afraid they will lose the case should they allow it to be heard and debated on, if not why are they going for all these (supporting attackers)?

We understand they have no evidence and strong argument to win this case, if not they will seek to unveil the case and let the counsels take part in strong debate as the counsel to the plaintiff Senator Ifeanyichukwu Araraume has asked.

Therefore with the unbiased article above, use your good discretion to properly evaluate the situation and positions of all the parties involved.

Imolites deserves better.
