Two Nigerians working with an Indian electricity company, Power Control Appliance (PCA) Ltd have filed two separate petitions against the firm and its management over alleged violation of their fundamental rights, and sexual harassment.
In an application for the enforcement of his fundamental rights before an FCT High Court and a criminal complaint to the police dated January 28, 2015, John Yahaya Bawa averred that a senior staff of the company, Mr Saravanan Manorahan had on October 10, 2014 accused him of stealing the sum of $ 4, 300 and N25, 000 from his bag in the office in Maitama, Abuja.
Also Chiziterem Mbadiugha, who resigned her job at the firm over alleged continuous harassment by Manorahan, has petitioned the Force Criminal Investigation Department (FCID) for his prosecution.
Bawa recalled that the allegation of missing money came up after he witnessed the attempted rape of a female staff of the firm on the 10th of October, 2014.
The office assistant explained that after the police officers at Maitama Police Station were invited, he was the only staff of the firm arrested and detained for two days over the incident.
In the suit filed by his counsel Ifeanyi Nrialike for Ikechukwu Ezechukwu (SAN), Bawa is urging the court to declare that his fundamental rights, as enshrined in Section 34 (1) and 35 (1) of the 1999 Constitution, were violated by the actions of the firm.
In his counter affidavit through his lawyer Samuel Akpenuum, Manoraham stated that Bawa was not directly accused of the theft, adding that he was neither harassed nor dehumanized in the course of police investigation.
