The Incorporated Trustees of Advocacy for Societal Rights Advancement and Development Initiative (ASRADI) has accused President Muhammadu Buhari of evading service of the process it filed against him at the Federal High Court in Abuja to stop the Chief Justice of Nigeria, Justice Mahmud Mohammed from swearing in as president. Buhari, the Independent National Electoral Commission (INEC) and the Chief Justice of Nigeria are listed as the 1st, 2nd and 3rd respondents respectively. Counsel to the group, Mr. Philips Ekpo, said Mr. Lateef Fagbemi (SAN) who had earlier filed a memorandum of appearance at the ex-parte hearing (when he was not supposed to be present) not only rejected service at his chamber, but also failed to appear when the case came up last week. He said the Chief Justice of Nigeria did not appear and was not represented even though he was duly served with the court process. He said that service on Buhari was rejected at Aso Villa gate. At the last hearing last Wednesday, one Chima Okereke appeared for Buhari but rejected service of the process in court. INEC was represented in court by Abdulaziz Sani. At the last hearing, the trial judge, Justice Ahmed Mohammed, suggested July 3 for hearing but Okereke said he would not be available until after the vacation. The judge, therefore, adjourned the matter to October 13. In the suit, the group said Buhari did not meet the qualification enshrined in the 1999 Constitution and the Electoral Act to have contested for the position of the president of Nigeria in the 2015 general election. Some of the plaintiff’s prayers have been overtaken by events such an order of interim injunction restraining the CJN or any person acting in his capacity from swearing in the Buhari as President of the Federal Republic of Nigeria on May 29, 2015 or any other date thereof pending the determination of the motion on notice. The group said it relied on the following grounds in making the application: “(a.)The 1st respondent (Buhari) gave false information in the affidavit he presented to the 2ndRespondent and on the strength of which he contested and purportedly won the presidential election which was conducted by the 2nd respondent (INEC) on March 28, 2015. “(b.) The 1st respondent deposed to an affidavit dated November 24, 2014 that his West African School Leaving Certificate is in the custody of the Secretary to the Military Board “(c.)The Nigerian Army on January 20, 2015, said that in the personal file of the 1stRespondent with the Nigerian Army, they do not have the original copy of his West African School Leaving Certificate (WASC) nor does the Nigerian Army have the Certified True Copy of his WASC results neither do they have a photocopy of the said result. “(d.) The 1st respondent has not met the qualifications enshrined in the 1999 Constitution and the Electoral Act, Cap E6, Laws of the Federation of Nigeria, 2010 (as amended) to have contested the position of President of Nigeria at the 2015 general election.” “e.” That the authority conferred by Section 140 of the 1999 Constitution (as amended) on the 3rd respondent to administer oath of office to any person who will occupy the office of the President of Nigeria cannot be exercised in respect of the 1st respondent who has not fulfilled the requirements of the same Constitution and the Electoral Act as they relate to his eligibility to occupy the office of President of Nigeria.” In the originating summons attached to the suit, the group asked the court to declare that: the information contained in the Buhari’s Form C.F.001 stating that his educational qualification is the West African School Leaving Certificate (WASC) and that same is with the Secretary to the military board amounts to false information. It also asked the court to hold that the information contained in the Buhari’s affidavit deposed to on November 24, 2014 stating that his WASC is with the Secretary to the Military Board amounts to false information. He also asked for the following declarations: “A declaration that the 3rddefendant is estopped from swearing in the 1st defendant as President of the Federal Republic of Nigeria, as the issue of perjury involving the 1st defendant has not been resolved. “An order restraining the 3rd defendant or any person appointed for such purpose from swearing in the 1stdefendant as President of the Federal Republic of Nigeria on May 29, 2015 or any future dates whatsoever forgiving false information to the 2nd respondent on oath. “An order annulling the certificate of return given to the 1st defendant by the 2nddefendant.” The case was filed yesterday and is yet to be assigned to any judge. http://www.thisdaylive.com/articles/alleged-certificate-forgery-group-accuses-buhari-of-evading-court-service/213360/?utm_source=twitterfeed&utm_medium=twitter 1 Like |

Brilliant! The law is mostly described as having a long arm! This means no matter how long and far you run, the law if fair and upright would surely catch up with you. It's a shame that a certificate-less man who outrightly refused to show evidence to INEC, the court and other concerned parties was still allowed to assume the presidency despite court cases and a massive protest from concerned parties. In a sane society, the dura born should be cooling his butt in jail for pejury, falsification and outright abuse of court process! But in this country the dura born is still allowed to parade himself shamefully as a president despite not meeting the qualification to be one. I pray the court fights this irregularity as this causing the Nigerian people to be a laughing stock world wide. The effect and evidence to show his unqualification are glaring for all to see, some are well documented as follows: West Germany, osinbade, Chibuzo All progressive confidence 1n = 1$ et al! Just to mention a few! I know for sure before this four years is out more blunders shall be recorded. God help us! |
